Just sent a secure message requesting my information, and gave them permission to take the £10. Have people found this is enough with Smile, or should I follow that up with a written request? I may well do anyway just to make sure!

For the cost of a Stamp and about 10 mins of your time I would def send the data access request letter - I am not sure how enforcable email are in law?

i sent mine via email and got a response and £10 taken out within a couple of days, so maybe they are fussy with who they send emails too lmao :D

 

weird tho that they do some and not others? maybe a sign they are really really busy???

Maybe they didnt like the way I started my email with "OI! EDIT dogs,"...

 

They have till Saturday anyway when I'll be going to the post office to fire my MBNA letter off. If no response by then then I'll take it the traditional route.

 

Please do not use libellous terms that could cause problems for the site.

I have found smile very bad at responding to emails so it might be quicker by snail mail.

Apologies regarding my comment about Smile... That was tame compared to what I originally wrote! :rolleyes:

 

Does anyone know if they send the information via "Secure Mail" couriers? I have two "we tried to deliver" cards today and I'm not expecting any post of that kind. Whats even odder is that I live in a block of flats where the concierge usually signs for things, but on this occassion, the couriers wouldn't let him :?

DB77 - re the wording of emails and letters - try to keep them civil (I know that you dont feel that way right now). IF you need to show these emails to a third party further down the line it would look bad if the tone is somewhat poor.

 

any way get that DPA request in writting to them ASAP!

I don't know about the secure message route. I sent a snail letter with a cheque (paid from my husband's bank) and I got a reply within days saying "we will comply". They have now sent my documents but we noticed that they did not cash the cheque until a few days ago, presumably when they were ready to despatch them.

 

Seems to be no consistency in their dealings does there?

Just noticed that I have a secure message on my current account - It took them 9 days to resond to the secure message :

 

"Hello debug77, I've Passed your Subject Access Request to the team responsible. They'll be in touch with you shortly. Thanks The Banker"

Ok, I've an interesting problem now. I originally sent Smile a secure message on the 15th August, but didnt receive a reply to that (via secure message) until the 24th August. However, as advised, I sent off a letter via recorded delivery along with a £10 cheque.

 

In my original Secure Message I said they had permission to take the £10 from my account. They appear to have done that (on the 23rd) and not cashed the cheque.

 

My question to the forum is when did the 40 days start? After I sent the original secure message, or after they received the letter?

I believe it is from when they cashed the cheque or took took the money from your account, that is the answer I saw somewhere else.

 

Barclaycard Student credit card £400 partial refund received, S.A.R -

Open & Direct Finance- extortionate, cca to Rockwell debt collection they ran away, now with Bryan Carter, no cca 17/03/08 sent back to Open

It is from when they received the money. If it was when they cashed a cheque they could simply delay cashing cheques to extend the time limit. I would say it was from the date of the original message and that you should cancel the cheque.

I know First Direct do, they mark the package with something like 'Only to be signed for by addressee' so neighbours can't take it in, or like in your situation you need to be present for them to deliver it.

 

Still waiting for Smile, so can't comment on them specifically.

No worries Andy, it was something totally unrelated to bank stuff! :)

 

Anyway, received a letter in the post today from Smile. Basically acknowledging my SAR request, but also acknowleding that I had sent a secure message - the contents of which said they could debit the £10.00 fee from my current account (which they did). The upshot of that is they've returned the £10.00 cheque and said they'll provide my information by 22 September.

 

Both MBNA and Smile providing the info about the same time now. Lucky enough to be on holiday next week so that'll be something nice to look forward to when I get back :)

You could send them an LBA threatening action if they do not comply within 7 days. This can be found in the bank templates library.
