Well, got my reply: "When dealing with any complaints we receive we work to timescales set by the Financial Services Authority. Due to the volume of similar complaints we've received we're unable to respond to dates set by customers. In line with the above mentioned timescales you should receive a reply to your complaint within 8 weeks of us receiving it. hi... Fortunately my company 'fessed up to being late getting the CHAPS payment in so it was a day late. I guess I was too quick to point the finger at Smile on this occassion!

Well, week in, week out I get paid via CHAPS to my Smile Current account - the money's in my account by close of business Monday. Now, for the first time ever, no salary. No, I've not been sacked, and I've even had confirmation from my employers that I've been paid. Seems odd that this first time is just after sending the LBA! Come on Smile, play fair...

Nothing received (apart frm the standard, thanks for your complaint letter), so the LBA has now been sent.

Ahhhh sorry, I understand now. Good question. When I was looking through my statements I couldnt see any credits that were the opposite of my charges. I've never asked them to refund charges before so I wasnt really expecting any so I'm not entirely sure what they'd list them as. On my MBNA account my refunds have been listed as "ADJUSTMENT TO BALANCE" so perhaps something similar? Sorry thats not much help!

Hi... Smiles charges appear as items such as "Late Payment" (on credit cards) and as "Daily Excess Charge" and "Service Charge" on current accounts. I believe they also sometimes use "Commission".

I had to wait for the SAR data to arrive and when they did reply they included all a list of all of their charges and offer me a goodwill payment of 50%, and basically said the cheques (I have three accounts) will be sent out. I called them after I had that information and firstly thanked them for the payments so far, but pointed out that the goodwill payments were only 50% of the total figure, and that there was no mention of compound interest. I think they pretty much know the drill by now!

Received my statements on the 26th and have posted off my Prelim letter today.

Used the forum's spreadsheets to work out interest etc... and was ready to post them but a few fellow CAG'ers suggest I call them instead. Well, I finally got round to calling them today and they've made me an offer for the full amount including compound interest. Fantastic result. It's being paid straight into my account (that I currently have a balance on) but that's good enough for me! Thank you for everyones help and advice!

Indeed, I just called them regarding my MBNA accounts, and have been offered a settlement figure which included compound interest etc...

I'm actually quite surprised how much information they did send through considering they're an enviromentally friendly company. Mind you, I did ask for all of it! Quite interesting to see all the call log for things like them calling me up offering me loans and declining. Funny to see a few saying "customer disconnected mid call" lol. How rude of me!

40 days have gone since the original secure message and other than the intial "we'll get back to you" I've not received my information. Anyone else experienced this with "Smile" ?

Well, just within the 40 days, a letter arrived today offering me £210 (split across the three accounts). That's 50% of the amount listed in the charges accompanying me letter, so onto the next stage of getting it all back plus compound interest!

Has anyone been threatened with account closure (on a credit card) when they have a balance oustanding? What do you need to do? I'm a bit concerned as although I'm chasing MBNA for charges on 3 different cards, where 2 are closed, 1 is still very much my card that I use (too) regularly and as such has a non-insignificant balance on it. Is there a chance they'll say "pay up!" and close the account?

No worries Andy, it was something totally unrelated to bank stuff! Anyway, received a letter in the post today from Smile. Basically acknowledging my SAR request, but also acknowleding that I had sent a secure message - the contents of which said they could debit the £10.00 fee from my current account (which they did). The upshot of that is they've returned the £10.00 cheque and said they'll provide my information by 22 September. Both MBNA and Smile providing the info about the same time now. Lucky enough to be on holiday next week so that'll be something nice to look forward to when I get back

Well, their letter said something along the lines of "Thank you for your letter of complaint dated the 20th August 2006, which we received on the 23rd August 2006. We will reply to you by the 19th September 2006" So well within the 40 days. Now, whether I get my data access documents by that date, or just another acknowledgement, is another matter! I'll keep you posted.

You have to wonder about the morals of some of these companies! You could imagine that they'd send that same letter out to thousands of people. They may hit on one or two people who don't know better and just send the cheque regardless. It's absolutely disgraceful the way some people operate! I'd take NailPost's advice and ignore it until they provide you with more information. I bet you dont hear from them again!
