URGENT HELP - speeding fine - not my car

I have received a notice of intention to prosecute for speeding - the problem is I have never been to the place where they say I have been speeding and at the time 8:13 and that date... I was in bed at a friends house....

 

I have rung up the number on the notice and have spoken with a really snotty woman who told me that i have to send in a shot of the back of my car and a side view of my car!!! I have asked for photographic evidence and was told that they cannot do that because of data protection, because I am saying its not my car....

 

This is a nightmare... someone has obviously used the same number plate on a similar make and model of car and is driving round willy nilly clocking up speeding tickets and im getting the notices....

 

The CTO will not do anything, I have been into and rung the Police and they say there is nothing they can do... what do we do now.....

 

PLEASE HELP ME ASAP I AM DESPERATE!!!!

Return the NIP asap with a covering letter explaining the situation in full as well as your suspicions.

Use recorded delivery & keep copies of everything.

Try not to worry, you have done nothing wrong.

thank you straw dog..... when i went to the police station with my dad last night the guy on the desk said he couldnt say too much but the "car" had been involved in an "incident" and my dad asked if he meant a robbery or something and the police guy said he couldnt give information out except to say it was involved in something.... but if that was the case why had the police not been in touch before now....... apparently my registration on a car the same as mine has been coming up on cctv involved in this "incident" on 25th October in the early hours but nobody has contacted me before this NIP.

 

I will send the NIP back with a covering letter and see what happens but it really does feel like everyone is out to get me and how the hell do you prove your innocence when nobody believes you - its like a bad nightmare or a film on tv!!!!!!!!

That bit is totall hogwash. A VRM is not personal data unless and until it is cross referenced with another database such as that maintained by DVLA. You cannot do this so the data protection act does not apply.

 

Unfortunately what you have been caught up in is a risk of modern life. You must follow through the processes though.

Even better - include the details of your visit to the police station in your letter of response. If you have the collar/number and/or name of the person you spoke to, mention that also. If not, a description of him & the time, date & place of your visit will cover it.

 

Don't take things personally - nobody is out to get you - sad as it is to say so, just don't rely on the police to act in a co-ordinated efficient/appropriate manner.

 

I stress again, you have nothing to worry about - just a minor inconvenience that has to be dealt with. Very important that you return the NIP & your letter though.

I had a similar incident a few years ago, fortunatley at the time I was supposed to be breaking the law I was in a meeting with the Police Surgeon. I later found out that the garage that supplied my car (new) had put the same plate on two similar cars.

make sure you do not fall foul of S.172 or you may still get done for six points and a bigger penalty. give ALL the information they ask for but make sure that you cover the point very clearly that you and your car were elsewhere at the time. Staple the accompanying letter to the NIP/S172 form. repeat your request for photos, tell them it must be either a misread or a clone and that it if it is a clone that you need to find out out ASAP to a) report it to the police b) report it to the DVLA, c) protect yourself form any further incidents involving the cloned plate. As said above - their DPA argument is rubbish. Just ignore that and don't mention it again. Or if you want to mention it then cover the S.35 exclusion (quoting it). They are playing hardball so cover ALL your bases.
