Stating that one of their Assistant Managers will look into my complaints and get back to me within the coming 2 weeks.

 

Original Letter was dated 9th August , Do i send LBA letter on or around the 23rd or should I give them 14 days from the date on their Letter ?

No it's 14 days from the date you sent your letter, they'll drag their heels anyway so no point giving them more time to do so.

 

As for your letter being sent to Glasgow, all complaints are forwarded to the Customer Service Centre so thats why the reply came from there.

Court paper lodged today, found staff at Dundee Sheriff court very very helpful and pleasant to deal with, no so sure of some of the character hanging about outside the court though,..lol.

 

Just have to sit back now and wait.... :D

My request

I am writing to ask you to refund to me the further charges which you have levied from my account between 01/03/2006 to 02/10/2006 the sum of £120.00.

As you may be aware there is a court case pending regarding previous charges at Dundee Sheriff Court for the Amount of £887.70. Case ref SA688/06 due to heard on 23rd October 2006 at 0930hrs. I would therefore give you this opportunity to settle both these claims on or before the 20th October with the refund of £1007.70.

If you cannot or will not refund the £1007.70 on or before the 20th October 2006, I will have no further option but to raise a second summons through Dundee Sheriff court for the Additional £120 plus Interest plus Court Fees. I will also inform the sheriff at Dundee Sheriff court on the 23rd October that there is a second case to follow, which I intend to submit whilst at the court on the 23rd October 2006.

With Lloyds TSB current track record regarding these types of claims where several cases have been raised, not once have Lloyds TSB won a case by providing evidence to demonstrate the costs to which you have been put by a result of any breaches do reflect your actual costs. Therefore making these charges a penalty and unlawful at common law. In fact not one case to my knowledge has gone to a full court hearing as Lloyds cannot or will not provide a full cost breakdown for commercial reasons.

Most cases are settled before the court date though recently, Lloyds have been leaving this to the very last minute. This I feel is an Abuse of the court system and I’m sure that the sheriff will agree that this sort of practice is putting our busy courts under even more pressure.

 

Your responsibilities

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

 

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

I consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them.

Your concealment of the true nature of your charges has prevented me from asserting my right until now.

What I require

I calculate that you have taken a further £120 from my account.

Charge Dated 04/07/06 £ 30.00

Charge Dated 02/10/06 £ 60.00

Total £1007.70

 

My targets to resolve this matter

I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets.

 

I will give you until 20th October to reply to me accepting, unconditionally, my request and letting me know a date by which I will receive payment.

 

If you do not respond, or you do not respond positively, within this time period, I shall raise a second summons for the additional charges on 23rd October 2006.

I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.

 

If you are not in a position or do not have the authority to settle this matter personally, I would appreciate if you can hand this matter over to someone who has the authority to settle this matter. If this is the case I would also appreciate if you can inform me of the contact name etc by return, either by email,fax or standard mail.

Just phoned Court..Lloyds have not submitted defence as of 10 Mins ago..Going to phone at 9am tomorrow..if nothing going in with my form 11 for judgment..

:o :o Just phoned Court again this morning, Lloyds had till 5pm yesterday to submit defence..Nothing on Computer this morning..But when Clerk checked ..Yup the submitted this morning..A day late but thats only to be expected by Lloyds...So of to court on Monday 0930hrs..

This one was Settled in full along with Second claim which was eventually settled in full today
