      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been corresponding with the above bank regards the mis-selling of PPI and I have 2 x complaint forms from FOS completed and ready to go.

 

I was about to issue the PPI schedule of charges with my letter before action...can anyone tell me is it different than Bank Charges Reclaim.

 

I am really annoyed as the bank has just started hassling me again with phone calls at 9PM at night having no regard for my private family life and I have threatened them with Harrasment Enforcement Action if they do not cease and desist from this behaviour.

 

Please if someone could help point me in the right direction for the schedule of charges and interest that I can claim then that would be excellent.

Hey Dandy,

I am claiming back my ppi from Lloyds also. I haven’t claimed bank charges yet so don’t know whether it is the same, but if you go to my thread here… http://www.consumeractiongroup.co.uk/forum/payment-protection-insurance-ppi/184074-payment-protection-cover-2.html#post2368560 PF gives the instructions for working out the interest. You’ll need to change the APR to the one Lloyds have been charging you. With regards to the statuary interest, I’ve read on here various rates. Some people say you claim 8%, which is what a court would award and others say claim the contractual rate…

I would also make a log of all the harassment calls (date, time and name of person calling) and include it with your other documents.

I’m no expert but somebody else with more knowledge should be along shortly. Is the ppi on a loan or credit card? The more info you give, the more people will be able to help.

thanks for the reply.

 

The PPI was on a Credit Card and I have gone through the last 10 months hassling them to try and get somewhere. I have now came to the conclusion that I should just get the court action lodged in court and stop trying to get them to cough up first....it's not there game.

 

 

I have logged all the calls with details...the annoying thing is the calls from India at 9pm while my kids are trying to sleep they keep calling and wake them....I will raise a court action if the persist with regards to Harrasment procedures...Ive had enough.

 

will check out the thread...not sure if I have filled in the schedule of charges correctly as it is the return of the Inusurance premiums Plus 8% interest plus Contractual interest.

hiya Dandy you can go for compounded + compounded interest but u need to ask yourselve if this went to court would a judge agree

Hey Dandy,

If they phone you again, as soon as you know it’s them I’d say that the call is being recorded and will be used as evidence of harassment and you are not prepared to discuss the matter over the phone. It’s a bluff but has worked for me in the past. I haven’t really had any problems with Lloyds, although they have reduced the limit on my card since sending my first letter, but that isn’t a problem.

What your next move is has to be your decision. If you go straight to court you wouldn’t be able to go to the FOS should the courts find in Lloyds favour. I think if you go to the FOS they might be able to help you with the harassment by telling them to back off. It would be worth phoning them to ask before you make a decision.

Thanks again Buster, Ive been telling them Im Recording the calls for the last year or so since discovering this site and then realising if you play them at there own game they dont like it.

 

I have already submitted my complaint form to the FOS and I will still press ahead and raise a court action against Lloyds. If the FOS wont help due to the court action then thats fine.

Thats it Dandy keep all avenues open to you so FOS first and then Court after if you get no joy from the FOS although they are upholding the majority of PPI complaints.

 

It is currently running at 89% of claims given to them.

 

Also remember the longer they take the more interest in your pocket as statutory interest is to date claim settled.

Again sorry for sounding a bit dumb...but what happens to the overdraft interest on the account. I have left it off the schedule of charges at the moment.

 

I have used the compounded interest on the main calculator...Again do I take the figures and add 8% to the total sum or individually again. Little bit brain dead with it today.

 

I wrote to Lloyds TSB and copied the letters to every possible department. After I finish with the PPI nonsense I will be getting my bank charges back on this and on other bank accounts/credit cards. or at least try.

 

The bank sent me a letter the other week still charging the account that has been domrant for over two years and is wholly made up of charges now. Whats up with these people?

Sorry Dandy, I didn’t know you had another thread, should have checked earlier. They’ve really been giving you hell haven’t they. I knew they employed underhanded tactics and think they’re above the law but it’s incredible how far they’ll go.

 

I’ve no idea about the over draft but the statuary interest needs to be added to the individual figures

Edit: Sorry, by individually I mean to the figures you got from the compounded interest calculator.

As there is a court case ongoing at the moment re: abbey bank and others V the OFT which is currently being challenged in the house of lords any claim for bank charges will be stayed until the outcome of this very important case.

 

You need to do the claim for bank charges separately and do get you claim into the bank so that you will be one of the first to get paid out if the case goes in the consumers favour.

Does the Hardship waiver not allow the banks to consider reclaim applications if the criteria is ,met?

 

And can you still reclaim unfair charges on credit cards and loans?

 

I have not been keeping up to date. ant pointers appreciated.

 

my Mrs thinks I am mad trying to read through all this info on this sitefor hours on end but to be honest it just makes you more deteremined to find an angle to fight the bullies.

Hi there,

 

I sent SAR and then sent the bank a letter think it was Andover office or Brighton, cant recall but they are now saying the Insurance Section at Newport SW are investigating my claims......In my eyes 8 months too late since my initial approach.

 

I will find out and let you know.
