Hello, I am sure the banks do not care where the cash in the account came from or that is childrens allowance for the month for essentials...Child Tax Credits are paid to anyone with children that earn less than (I think 58K pa) on a sliding scale. Parachute account...well I have changed the Tax credits over to another account this month as I cannot allow them to operate in this manner.... Viking are the in house collection agency of Santander and have not and cannot buy the debt..,.what concerns me is the fatc the have access to my bank account...past transactions should be covered under the data protection Act...not happy with this. Anyway they have 7 days to refund the cash along with picking up the tab for all the bank charges I have now incurred due to no cash in account....plus compensation.....otherwise the will be receiving a summons without further warning......seeif the courts think this is the way for a foreign company to act in relation to UK banking procedures. Thanks for all support.....we have borrowed this month and are really struggling....everyone is now asking why have you not paid this month....Santander Stole My Cash this month and left is very very vulnerable.   2. Hello OldAndrew2007, Thanks for asking. Unfortunately the bank have refused to even deal with this situation on the telephone...they say we have made a complaint and they will be in touch within the 8 Weeks timescale the are allowed. Santander are shocking me the way the have acted and continue to act....I have complained to the FOS and really hope this is not the end of the matter. I have also cancelled all future Child Benefit Payments/Tax Credits from that account and we are now facing bank charges due to no funds in account.....BUSINESS AS USUAL FOR THE BANKS I SUPPOSE. We have been stuck in the house with no cash for food and nappy's for kids...it is real testament to our survival that we are eating the stored food and lying low until things improve. The worst thing of all is this kind of action only serves to allienate this bank...I will tell everyone that will listen to my story.....I will shout loudly and may even walk into town 5 miles and shout in the branch while cancelling Direct Debits for Council Tax Etc which I obviously cannot pay now this month. Funny thing is if Viking are meant to be a seperate company...although Santanders in house collection agency...I am not sure why they have the right to access our bank account and go through all past transactions.....Very wrong and in my eyes must be a breach of Data Protection.   3. Hello, A few days ago I noticed the balance of our current account was lower than expected as we had just recieved our Benefit Payment from DWP for our Child Tax Credits. We received a letter yesterday from Santander bank account explaining their right to offset any money due to our credit card with Abbey (In Dispute, Consulted CCCS, and advice of token payment of £1.00 where and when possible due to financial position unitil it changes.) They also said in the letter the account was £48. In Arrears..... So today I have been in touch with them and they now claim that they have in fact offset £455. from the bank account when we only received £580 in total from the DWP for the month to help with our children's costs two babys under two. I cannot understand how this can be possible or legal as we are now pretty vulnerable due to this draconian action taken by Santander....they paid the money to Viking Collections....I know a branch of Santander, but strictly speaking a seperate LTD company. They claim we have not been in touch to make arrangements when in fact we have been waiting on them answering our letters regards our request to review the amount outstanding due to financial difficulties. After spending all day ont the phone the Santander/Viking/Santander/ FOS/CCCS I am exhausted and to make matters worse....one of the satff at Viking in there frustration and evilness has passed a Burial Park's Number instead of their collections department...very close match but I recorded the call and have played it back and In my mind it was a malicious act of evil by someone employed by the one of the worlds leading banks SANTANDER>>how can this kind of action by governed by anyone in the UK. Further more on one of my final calls a VIKING member of staff sneered that did I know these calls were costing £1.50per minute and I had been on the phone to them for around 4 hours in total by this time...purely due to their refusal to A/ Let me speak to a supervisor and B/ They would call me back within 48 hours why was I still phoning. We have been left destitute for the rest of the month..unable to pay our mortgage...council tax payments and food and nappy's for the babies......Where is this country's banking industry going? PLEASE can anyone offer advice or action we should take...... I feel so angry the FOS have said it may take up to 8 weeks to investigate...I was hoping to get answers today but now who knows... Dandy

Thanks for that info dundeelaw, I have a Bank Account with overdraft and it mostly made of Bank Charges, I have Sent a subject access request to the bank and the have not really fully complied...It has since been a year and my case is with the FSO. Can I make a request for info through the consumer credit Act 74 and if they dont comply raise a Small Claims Action to have the agreement, judged non-enforceable for the non compliance? Sorry to ask a question on this seperate post? In Newport On Tay so not far from Dundee. Regards Dandy

Hi there, Not quite sure if it is still relevant but had a PPI claim against Lloyds TSB and they paid out through the insurance services direct into another account even though the balance remains outstanding on the credit card account that the mis sold the insurance on. There is also another two Llyods one current account and one mortgage account both in arrears and now I have the cash I was going to negotiate the balances down. Is this any help? I am now in the process of offering third party Debt Collectors a reduced sum fingers crossed they will accept and I can use the rest of the cash to reduce other debts. Never Never accept any first offers after I refused for a few months It was quite easy to get 5 times there first offer. Good luck to you mate dandy
  6. Hi there thanks for the advice. I have just recieved a letter asking for the full balance of the credit card as they had been informed from ther agent that we could not agree payement terms. I feel the banks are still making up the ruls as they go along. We specifically asked for PPI when we took the CC out as we were new in business and wanted some protection. When our business was liquidated we did not have many options...but were assured not to worry but to claim on the PPI policy. We did this and then they sent up and agent who informed us that if the claim was succesful the balance would be cleared off due to timescale involved. They then wrote to us telling us that our claim was being refused for some absurd reason that my wife was pregnant again and was not actively seeking employment. ??? They then wrote to us asking us for a reduced payment of half the outstanding amount to clear the debt off...which we refused as we want our day in court. Since that time we have been preparing to go to court and no the bank have offered a full refund of PPI premiums plus compensation which we have told them to shove it unless they confirm that the balance of the CC would be cleared also. Now we have received a letter from the bank asking for the full amount to be paid again. I am about send them ther summons and was hoping someone could help with the Statement of Claim and confirm that if they have admitted the mis-sold the PPI then the terms of the CC are now Unenforceable. If anyone can help appreciated and thanks for the info before alanana....but having the PPI offset against the balance is no better position in after losing our business.   7. Hi there alanalana, I would have agreed with you if this was simple bank charges refund and there was arrears. However, as Lloyds TSB put it if they refund me the PPI premiums and interest etc then I am as close to a position I was in prior to taking the PPI out. Yes, but unfortunately this is a little flawed as I cannot turn back time and select a PPI that would have been suitable to cover us in the event of our business going into liquidation at this stage. Our business went into liquidation leaving a large balance outstanding and witht he appropriate cover then perhaps we would be resting easy some three years down the line, but we accpeted the sub standard not fit for purpose PPI they sold us. It is my viewpoint that had we the correct insurance then there would be no balance. Have loads of other arguments regards this PPI that was miss sold. thanks for your help and input ...really appreciated. Dandy

Hi there all, Have not had a chance to frequesnt the forums as of late due to a family illness but I have now had an offer from Llyods TSB, fully accepting responsibility and offering compensation and the refunded premiums. I feel it is a victory....but was wondering there was no mention in the letter regards the outstanding balance of the credit card in question. sitting at £5K. It goes without saying that if they agree the PPI was not suitable for me in the event of me losing my business then I could have found cover that would have been suitbale therefore the outstanding balance should be cleared. Can anyone tell me if this is the standard procedure here.....This one has been refered to the FSA and they have given Llyods a kick up the backside that has initiated there offer.....Not sure if there offer is maxed out as I have read around the forums re compound interest amounting to ££££. Any help or tips on how the bank will deal with the balance is appreciated. Donation will be on the way after settlement. Without this site I would not have put up a fight. all the very best Dandy
  9. Hi there, I sent SAR and then sent the bank a letter think it was Andover office or Brighton, cant recall but they are now saying the Insurance Section at Newport SW are investigating my claims......In my eyes 8 months too late since my initial approach. I will find out and let you know. Dandy
  10. Does the Hardship waiver not allow the banks to consider reclaim applications if the criteria is ,met? And can you still reclaim unfair charges on credit cards and loans? I have not been keeping up to date. ant pointers appreciated. my Mrs thinks I am mad trying to read through all this info on this sitefor hours on end but to be honest it just makes you more deteremined to find an angle to fight the bullies.   11. Again sorry for sounding a bit dumb...but what happens to the overdraft interest on the account. I have left it off the schedule of charges at the moment. I have used the compounded interest on the main calculator...Again do I take the figures and add 8% to the total sum or individually again. Little bit brain dead with it today. I wrote to Lloyds TSB and copied the letters to every possible department. After I finish with the PPI nonsense I will be getting my bank charges back on this and on other bank accounts/credit cards. or at least try. The bank sent me a letter the other week still charging the account that has been domrant for over two years and is wholly made up of charges now. Whats up with these people? Thanks again Buster, Ive been telling them Im Recording the calls for the last year or so since discovering this site and then realising if you play them at there own game they dont like it. I have already submitted my complaint form to the FOS and I will still press ahead and raise a court action against Lloyds. If the FOS wont help due to the court action then thats fine. Cheers Dandy
  13. Hi there Buster, thanks for the reply. The PPI was on a Credit Card and I have gone through the last 10 months hassling them to try and get somewhere. I have now came to the conclusion that I should just get the court action lodged in court and stop trying to get them to cough up first....it's not there game. I have logged all the calls with details...the annoying thing is the calls from India at 9pm while my kids are trying to sleep they keep calling and wake them....I will raise a court action if the persist with regards to Harrasment procedures...Ive had enough. will check out the thread...not sure if I have filled in the schedule of charges correctly as it is the return of the Inusurance premiums Plus 8% interest plus Contractual interest.   14. I have been corresponding with the above bank regards the mis-selling of PPI and I have 2 x complaint forms from FOS completed and ready to go. I was about to issue the PPI schedule of charges with my letter before action...can anyone tell me is it different than Bank Charges Reclaim. I am really annoyed as the bank has just started hassling me again with phone calls at 9PM at night having no regard for my private family life and I have threatened them with Harrasment Enforcement Action if they do not cease and desist from this behaviour. Please if someone could help point me in the right direction for the schedule of charges and interest that I can claim then that would be excellent.   16. Hi Ida, Sorry my jumbled up garbaggio story. It was a work partner of Sky, Sat Services,who have depots all over the country. The job is booked by the neighbour throgh Sky and subbied out to this mob. Summons coming to Sky and they can deal with it any way the want. Thanks for input.   17. hi Ida, Thanks for the input ....it was an independant install as the roof is so high that the sky engineers are not insured to go on the roof. Sky passed the buck the ....neighbour was not covered for accidental damage and I think the recourse would be to raise a court action against Sky. But when I say and independant they are a partner (subbie) so Sky are responsible. Sat Services were the company and they do not care what goes on up on the roof....they do not think there actions on the roof are monitored...but they are wrong on this count. Again thanks for the input.....I am considering going after compensation from Sky...what do you think? cheers

LTSB....yea I have gethered from the info on this site that there customer services and acknoweldgment of the charges/ppi situation is shocking. We are struggling at the moment but compared to last year or the year before I would have worried non stop re the debt we are in....but now...no way after you see how the greedy banks have behaved it makes us sick....fight on never give up. thanks again for the info and support Dandy

Hi thanks for the help, It is a credit card that I am claiming the PPI on and Bank Charges also...but was thinking they will rely on the usual letter to hold me up....but if I am reading your post correctly. the Hardship waiver need only apply to banc accounts. Is this correct? I have also served Llyods with a SAR re my select account also so I will be prepped up with my hardship claim...I am in arrears with mortgage, arrears on Electricity and Gas acoount as well as Coucil Tax, Struggling on benefits with three children. I have worked all of my adult life and since my business went into liquidation the debt situation has just went from bad to worse.
  20. I thought the law is unenforceable if there has been procedural impropreity by the Local Authority, but I dont know I thought I read this on this site. I does not matter anyway the LA and there employees are supposed to act with integrity, honestly and follow procedure and statute as dictated by the Scottish Executive in our neck of the woods. Your LA have not and therfore are acting ultra vires, Fact. Its always good to get the good, the bad and the ugly version of input from posters.....there is a fair share of knowledgable people on this site....negative, positive and matter of fact.
  21. Hi birchaveO miss, thanks for the info, I am struggling to locate the spreadsheert that works out the interest any pointers please? I have requested the return of (1)PPI and (2)unfair charges....will not accept any fob off re awaiting outcome of court case.....definetely meet the criteria for hardship...arrears of mortgage, owed Gas and Electric sums and a multitude of other of debts. I was being asked for a income/expenditure to be completed from Abbey on another claim and I am hesitant to complete...I thought it might give them the info to go for bankruptcy....and this I dont want. Any ideas? any pointers is appreciated. dandy
  22. green and mean is this a guise that you adopt or are you really like how you are coming across in the posts. Have you never felt wronged, why do you help people on here if this is how you feel? It is all about Natural Justice and you dont seem to grasp that. I would not even begin to establish how many people you may have helped on these forums...you may have your reasoning for this stance.....but being a council employee does not justify this. Again I do not want to be drawn into any arguments that I have nothing to gain from ....I have enough issues needing addressed myself and I am thnkfull for the help I recieve. FACT, Local Authorities across the country are generally overstaffed and running way below the capacity that the would be if they were a private firm. It is a bit of a generalisation, but one that I have confidence in stating. I would wind your neck in a little it is not personal just an opinion. Please dont be offended I am sure you do more good on the forums than most but get off the old boys back eh. choi
  23. Hi there, Was wondering if anyone has had a rpoblem with Sky engineers going onto roofs to install dish and damaging roof. My neighbour had a dish that was faulty inspected by engineer and I did not want anyone on the roof as it is a old Victorian roof and it was not made for anyone clambering about on least of all some of these so called engineers! After the guy came off the roof I went up through my roof space to inspect my roof and the idiot had ripped up the co axial cable from under the lead flashing and this had came away from the wall head and the coping stone that held it ....He had clearly slipped while up there as my wife and I had heard a thud from above while he was up there. There were slates missing and he had replaced parts and left them lying in the gulley. I was furious and initially my neighbour...(we dont get on) had said he would be responsible for any damage the caused as I was lettign them onot our mutual roof to carry out this maintenance. I tried my best to fix what damage was done but three nights later the heavens opened and at one in the morning we had a deluge of water come through our living room cieling....all this awoke the children and I was on the roof wrestlling with the weather to try and stem the ingress of water. I approached my neighbour who reluctantly said he would get in touch with Sky....who in turn said its a third party installer and they would investigate...which they did and they claim the roof was old damage and this was always like that .Now I have pics of what it was like before the bafoon went onto the roof as there was a problem with the chimney and I have pics right after and the next day before the water came in. We ended up having to claim on our insurance and they only paid ourt 50% of the claim as the neighbours were responsible for the other 50%. My insurers then asked the neigbours for their share only to be told by their Insurance that they are not covered for accidental damage. We cant believe this...it seems really unfair that they can cause this much hassle not take responsibilty. 1/ Should my neighbours Mortgage Lender be insisting on the right cover for accidental damage if they are mutually responsible for the roof? 2/ Should we sue Sky/Satelite Services over this whole fiasco...we did consult a lawyer who said we had been paid half so it was unlikely they could get much more out of them from any court action? hmm 3/ Should I sue my neighbour for their part in the whole fiasco as he did say he would be reponsible for any damage? That was 6 months ago and since the neighbour has just arranged to have the roof fixed (The Insurance fixed it with a temp repair meantime). Which we paid half off £250 and now our premuims on the policy has increased I feel a little aggrieved at this. Can anyone help with a little advice of how best to proceed. I am a little concerned that if the roof came in for whatever reason then the we will be picking up the bill and the neighbours would not be covered or concerned. Thanks in advance for any pointers
  24. This is a great thread and Spellboy you've got them and they know it. I wonder if the Director of the Department or Local Councillor/MP would be interested to know were our hard earned taxes are being spent. Shows up LA's for what they are.....a law unto themselves...across the board.....across the country in every department. Please keep the info flowing
