Hello,

 

I wonder if anyone can point me in the right direction here.

 

My brother sold his house to a company that was going to rent it back to him.

 

However after a couple of years that company went bankrupt and the property was reposessed with my brother as a tenant. The new owners have now decided to sell the property and given my brother 8 weeks to leave.

 

Does this sound right? He is up to date with his rent and this seems harsh. Although I guess he has no say on the matter.

 

I would appreciate any advice.

What sort of agreement did your brother have? I assume he started with an AST which, if he did not sign a new agreement at the end of the fixed term of that agreement, will have rolled over to a Statutory Periodic Tenancy.

 

What were the dates on the original agreement (e.g. what date did it start and what was the fixed term).

 

When the property was "taken over" did the new owners properly inform him that they were the new landlords?

 

E.g When a property it taken over by a new landlord, new LL should serve on T:

a. old L's Letter of Authority;

b. Notice under s.3 of LTA 1985; and

c. Notice under s.48 of LTA 1987.

 

(a) is the letter from your old LL saying that you can now pay rent to new LL. (b) and © inform you of your new LL's address and notice that this is who you now pay your rent to.

 

You said they have given your brother 8 weeks notice - was the rent paid weekly or monthly? What form of notice was used?
