      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Spiders are a regular occurence in our house. We're the last house in the road and there is a large spinney on one side of us, populated by loads of creatures, up to, and including, foxes.

 

It's now reached the stage where I've only got to walk into the room holding a closed hand, in front of me, and everyone's climbing the walls, in case the spider gets loose! :D

I. Was just sat watching telly without the lights on and a spider has just lowered it's self down from the ceiling in my direct line of the telly about 4 inches from my nose. You would never see anyone quicker than I was at launching myself backwards over the sofa!

Changing the subject for a minute.

I have come across 7 very large wasps in my house today, in different rooms. My friend who lives about a mile away said she has had a lot of wasps in her house this week. Whats going on? Are they looking for spiders?

Hi everyone:)

 

All this talk of spiders is making me itch - I feel like there's one inside my clothes.

 

I'm glad it's not only us that's being plagued by the horrible things at the moment - we have also had at least one every day for the last three weeks or so.

 

They are huge beasts and seem to be escaping the clutches of our three (admittedly rather lazy) persian pusses.

 

They (the spiders, not the cats, LOL) are turning up in all sorts of places - and usually when OH is at work leaving me, who's absolutely terrified of them, to deal with them on my own. Last week there was one sitting in the strainer basket in the kitchen sink when I went to do the washing up - yuk:eek: Good job we have a dishwasher too! I had to cover the damned spider up as I couldn't bring myself to remove it, even though it was apparently dead and had to wait several hours for OH to return home.

 

Every night without fail a huge spider trots across the living room floor while we're watching TV - I told OH he should stop wearing shorts as he sits on the floor and I'm concerned one will crawl up inside the legs! I actually have to leave the room as they make me feel physically sick, but if I am on my own and have to deal with one it gets a bash over the head with the nearest hard object - there's no way I'd let it survive.

 

I thought it was 'cos we live in a semi rural area, although I read somewhere the other day that you get more house spiders in the city than the country - I don't believe that for one moment as prior to moving here two years ago we had lived in a city for 10 years and yet we see more spiders here in a week than we saw there in the whole 10 years.

 

Luckily we don't seem to get many upstairs - which is the only place I feel safe at the moment!

 

God, I've scared myself now and can foresee a sleepless night ahead - those pictures haven't helped:-o

I am thinking of taking one to court for attempted murder.

 

Last night, the Mrs was sitting in her office (the lav) when I heard the

loudest scream that would have made a Hollywood director jealous. I also heard

a loud thud upstairs. I rushed up and there she was, on the landing with

underwear around ankles and the kids where watching and wondering

what was going on.

 

Apparently, she was just sitting there minding (and doing) her own business when a 8 foot long 8 legged monster fell from the ceiling right on to her magazine. The noise she made was horrendous. Maybe these bombers that we come across can just lob one of these spiders at the target in future.

 

I went to investigate and moved the wash basket and there it was, alllllll

8 foot of it. Well maybe a slight exaggeration, it was only about 6ft 7inches. I must admit, I would have got a bit of a fright if it landed on me unawares.

 

I did get rid of it but had no receptacles big enough in the house to catch it. So I just emptied our wheelie bin from outside and tipped it upside down on top of it. Then stuck an 8 by 6 plaster board underneath and then 6 of us carried it outside. No Seriously it was.................

 

 

 

 

THIIIIISSS BIIIGGGG

I've done nothing other than watch out for creepy crawlies thanks to this thread.

 

No large spiders to report although there are lots of webs about, which aren't small.

 

I had a Danish one living in the mirror on my car. Chuck a teeny piece of paper in the web and he'd come out, untangle it and throw it away. English ones don't seem to have the same determination.

 

Head Lice ...now that's a subject that makes you scratch your head for a solution...............

Lol Sod em you made me giggle... Another monster in my lounge last night.... banned to the bottom of the garden, even more worrying though, every morning I go out my kitchen and there s the most enormous web from one end of the room to other, it looks like a blanket.... I dont want to see the spider that made that one:eek::eek::eek::eek:

I whacked my head off a shoe cupboard this evening when I stooped to pick up what I thought was cotton fluff. It was a large and very dead spider, hence the cut and bump on me noggin'.:eek:

 

I've left it to the mercy of the cats who probably helped in its demise ..fancy words..sore head and watching out for any 'presents' from the moggies.

Did anyone see The One Show last night with the mad guy letting the huge spider crawl all over his hand...... he reckoned they are the males coming in to homes looking for lurve lol.... typical.... anyway also said theres an increase in false widow spiders in Britain coming in from the Canaries... can give you a nasty bite... who said spiders are harmless... :(

I hate them! the big ones absolutely terrify me! my son bought me one of these:

I woke up on Sunday and found a huge black monster on my curtains - the bl**dy thing must have been running round my bedroom all night - nearly had a heart attack !
