I've done my case and HSBC settled in full a couple of months ago.

I'm currently doing it for my dad who was charged about £1500.

Can i represent him should the case go to court or do i have to tell the bank/court i'm representing him. I'm doing all the paper work and he's signing the letters so the bank thinks it's all coming from him but if it went to court i would want to represent him as he's not got a clue what it's all about.

I'm looking into the courts and legal services act 1990 s11 but these things are hard to understand

also looking at acting as his 'lay representative' if anyone knows about that sort of stuff

 

I know it's not likely to end up in court but for both of our peace of minds i'd like to know if i could beforehand

Don't know about England but you certainly can in Scotland in a small claim.

Nationwide Total settlement for first claim £810.92 (Charges £570.00) total charges £2579.00 (Another 4 claims to make)

it is in engalnd (although my dad is scottish)

 

can anyone clarify this for me.

ie. what do i need to do to act as a lay representative or act on behalf of someone else in another capacity

I'm not entirely sure but I think you can - I'm hoping to do the same thing.

 

I've sent DPA requests for info on somebody else's account, including a letter of authorisation from that person with the request so I think there is a mechanism
