That is fantastic binkhus and the first time that I have heard of this happening. Have they included interest and court costs? I hope you don't mind but I have changed your thread title to reflect this development. If you have not already done so can you pm me or one of the other mods with details of your court claim for the litigation forum.

I wrote back 2 YB querying this paragraph which seemed like gobbledygook in their letter of partial offer: "Please note that as this letter is written in an attempt to resolve this matter without the need for court action it is without predjudice to the Bank's whole rights and pleas and may not be founded on in any action to follow without the bank's written consent".

Their reply was: "simply put, you may not produce our letter to court without the bank's written consent".

Does this mean that they can deny the offer made? or is it just B-ll-cks?

It means exactly that. You may not produce the letter in court without their written consent. What they haven't mentioned is that they may not produce it either without your written consent.

they had!!! i filled in the form they sent out saying that i accepted their offer and would stop the court case as soon as i had been refunded so i thought it was all over with but i just recieved the acknowledgement today.

YB are unreal it seems very clear that they will do anything as a delay tactic. Dont understand why they do this I think in order to try to get their own back they enjoy playing mind games with people. You would think that the courts would frown upon this kind of behaviour and punish them. Unfortunately for all of us we just have to accept that we really do have to fight to the bitter end. Keep on keeping on according to the experts they seem to be positive that we will win in the end. Good luck and keep us posted.

It could just be that the claim was still proceeding and things have crossed in the post. Give them a ring to check that they received your acceptance and have sent the form to the court stopping the case.

hi everyone, i left a message on the number listed for yorkshire banks solicitor, kirstie ross asking her to ring me back..... then rang again this morning and the line has been cut off. so i guess i just wait now?

binkuhus. Don't panic! DON'T try to speak to them on the phone about it. If it isn'r sorted out beforehand, all that will happen is that your case will call in court and you'll show the judge their letter offering to settle in full. Forget anything it might say about not being allowed to produce it in court. The paragrapg you quoted was very technical, and not something a lyman can be expected to understand. Let the judge decide if it's admissible or not. The judge will make them honour their offer to settle, and YB know it. They'll write to you in the meantime to sort everything out. The other point to remember is that until you have actual cash in your actual possession, you shouldn't be stopping your claim anyway.
