  1. Capitan got offered via letter the full £520 yesterday - he has to sign an acceptance and it should be in his account shortly. will let you know once in so this can be moved to the settled section. Thanks!
  2. Over the phone yesterday i was verbally offered the full amount I asked for in my letter of 15 Novermber which was £83.40. This included interest up until 15 November. I ahve accepted this and await a cheque - i will let you know once recieved ao this can be moved to the settled section.
  3. Why don't you have a look at money saving expert for some info on credit rayings? Is it not the case that sometimes if you have nothing on credit this can be a problem?
  4. hi. I sent back my cheque cut in two today. with an ammended partial acceptance letter just saying... Thank you for your letter dated x I respectfully decline your offer of settlement and attach the cheque torn in two, and request, once again, that you return to me all charges imposed on this account, totalling £x. Because you note in your letter that an encashment of this cheque will be taken as an acceptance that the Clydesdale bank has resolved this matter, I have taken the decision to return this cheque on the clear understanding that I will pursue recovery of the full amount, with a Sheriff (county if england) Court claim if necessary. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest (currently standing at £x as of today – please see attached schedule) plus my costs and without further notice. I trust this clarifies my position.
  5. Hand delivered a refusal letter and torn up cheque to the waterloo street office at lunchtime. I have given them 14 days.. so they might well be getting a Sherriff Court Shaped Present for their Christmas if they don't come back with my full amount.
  6. he's gone back to them with an ammended letter saying they have 14 days to get back to him... clock now ticking!
  7. ladykenko.. what was the ins and outs of your letter - did you ammend one thats somewhere on the site?
  8. Okay... I recieved in the post in saturday a cheque for £37.08. Half of my charges. I was going to use the response to settlement offer letter saying thanks but this is just a part payment, but just rereading the letter thay sent me.. they say: The cheque is tendered without admission of liability qand is in full and final settlement of your claim and your encashment of ot will be taken as your acceptance of this. So, not sure whether to send the letter an cash the cheque anyway or not. Suggestions?? Thanks Kelda BANK NAME Address Address Postcode Re: Account number XXXXXXXX Response to settlement offer. Dear [named sender or Sirs] Thank you for your letter dated xx/xx/xx I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale. I trust this clarifies my position. Yours faithfully [signature] [print name]
  9. so he should just amm0end this saying that that letter acts as a LBA and that thay have 14 days to get back to him?
  10. 7 days notice letter to go out... the info hasn't come in yet.
  11. Hi there.. just to update you.. Capitan popped a letter as suggested by weej into the bank.. if nothing comes from that by the 40 day cut off (Tues) he will do the 7 days notice letter.
  12. Okay - I'm now going forward and am filling out Vampiras spreadsheets to work ou the interest rate. But I have probably a very silly question. Above, is from Vampiress' spreasheet - can I ask what I should put in for the DATE OF JUDGEMENT OR PAYMENT??
  13. Thanks weej. He's called the bank to ask about statements and will also pop in a letter today (he can't get onto the net so I'm posting on his behalf) One thing we were wondering though... They sent him a mandate saying that he will accept the £236 as a full and final solution to his complaint in relation to bank charges, so basically if he accepts it then thats its done and dusted. They say the money will then be credited to his ISA on conclusion of it all. Why would they credit to his ISA and not his bank account??
