Why don't you have a look at money saving expert for some info on credit rayings? Is it not the case that sometimes if you have nothing on credit this can be a problem? -
hi. I sent back my cheque cut in two today. with an ammended partial acceptance letter just saying... Thank you for your letter dated x I respectfully decline your offer of settlement and attach the cheque torn in two, and request, once again, that you return to me all charges imposed on this account, totalling £x. Because you note in your letter that an encashment of this cheque will be taken as an acceptance that the Clydesdale bank has resolved this matter, I have taken the decision to return this cheque on the clear understanding that I will pursue recovery of the full amount, with a Sheriff (county if england) Court claim if necessary. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest (currently standing at £x as of today – please see attached schedule) plus my costs and without further notice. I trust this clarifies my position.

Hand delivered a refusal letter and torn up cheque to the waterloo street office at lunchtime. I have given them 14 days.. so they might well be getting a Sherriff Court Shaped Present for their Christmas if they don't come back with my full amount. -

Okay... I recieved in the post in saturday a cheque for £37.08. Half of my charges. I was going to use the response to settlement offer letter saying thanks but this is just a part payment, but just rereading the letter thay sent me.. they say: The cheque is tendered without admission of liability qand is in full and final settlement of your claim and your encashment of ot will be taken as your acceptance of this. So, not sure whether to send the letter an cash the cheque anyway or not. Suggestions?? Thanks Kelda BANK NAME Address Address Postcode Re: Account number XXXXXXXX Response to settlement offer. Dear [named sender or Sirs] Thank you for your letter dated xx/xx/xx I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. My letter before action sent previously indicates that you have until xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale. I trust this clarifies my position. Yours faithfully [signature] [print name] -
so he should just amm0end this saying that that letter acts as a LBA and that thay have 14 days to get back to him?

Okay - I'm now going forward and am filling out Vampiras spreadsheets to work ou the interest rate. But I have probably a very silly question. Above, is from Vampiress' spreasheet - can I ask what I should put in for the DATE OF JUDGEMENT OR PAYMENT?? -
Thanks weej. He's called the bank to ask about statements and will also pop in a letter today (he can't get onto the net so I'm posting on his behalf) One thing we were wondering though... They sent him a mandate saying that he will accept the £236 as a full and final solution to his complaint in relation to bank charges, so basically if he accepts it then thats its done and dusted. They say the money will then be credited to his ISA on conclusion of it all. Why would they credit to his ISA and not his bank account??

Hey just posting to bump this thread and get an answer... (he's my other half!) What should Capitain do now?? Should he say hes not accepting this until he knows his charges and remind him the clock is still ticking or what? Any standard letter templates we could use? I have to say he is pretty jammy - I am just about to fill in court claims for £75 only with Clydesdale and he gets an offer on his data protection letter - gha!

Received a letter yesterday in the post. Now – question – is this their usual delaying tactic? I wondering whether I should just wait the 28 days (until 1 November) to show reasonableness or press ahead to action. My original letter was sent on 18th and I received a reply back very quickly on 22nd. I then sent LBA on 26th giving 14 days – which would bring me to the 10th. So the options are: a) wait till 10th and then proceed forward. b) wait till 16th (28 days after the first letter was sent) and proceed forward. c) wait till 11 November and then proceed forward. Should I be writing to them again and reminding them they have until the 10th to get back to me before I take things forward. I'm tempted to wait till 1 November to show reasonableness but also aware that I want to show that I'm a sticking to what I'm saying. Suggestions anyone? Thanks Kelda -

heh. here was a lovely couch I'd quite happily take as payment for my bank charges - if you know - they don't have enough spare cash lying about!! -
For info an 01563 code is scotland. The Kilmarnock area and surrounds to be exact.
