    • I found that the parkin attended has a car with CCTV camera on it, however as I stated earlier, it seems that he did not take video of my car otherwise they would have stated so in the SAR. parking car .pdf
    • The rules state that "approved devices may only be used in limited circumstances"  I was not a threat. I was not present. I did not drive away. I think he has not fulfilled the necessary requirements justifying issuing me a PCN by post therefore the PCN was issued incorrectly and not valid.  What are your thoughts?  
    • I have also found this:  D.2 Service of a PCN by post: 54) There are some circumstances in which a PCN (under Regulation 10) may be served by post: 1) where the contravention has been detected on the basis of evidence from an approved device (approved devices may only be used in limited circumstances) 2) if the CEO has been prevented, for example by force, threats of force, obstruction or violence, from serving the PCN either by affixing it to the vehicle or by giving it to the person who appears to be in charge of that vehicle 3) if the CEO had started to issue the PCN but did not have enough time to finish or serve it before the vehicle was driven away and would otherwise have to write off or cancel the PCN 55) In any of these circumstances a PCN is served by post to the owner and also acts as the NtO. The Secretary of State recommends that postal PCNs should be sent within 14 days of the contravention. Legislation states that postal PCNs must be sent within 28 days, unless otherwise stated in the Regulations. This from London Councils Code of Practice on Civil Parking Enforcement.  The question is what is an approved device? Certainly, he had the opportunity to place the ticket on my car and I didn't drive away.  I looked further and it seems that an approved device is a CCTV camera - It seems that the photos taken were not actual film but images and it is not clear if they are taken from a video or are stills. I'm guessing if it was moving images then the SAR would have stated this.    From the Borough of Hounslow website: "There are two types of PCN issued under the Traffic Management Act 2004, which governs parking contraventions. The first is served on-street by a Civil Enforcement Officer, who will observe a vehicle and collect evidence before serving the PCN either by placing it in a plastic wallet under the windscreen wiper, or by handing it to the driver. The second is a PCN served by post, based on CCTV footage taken by an approved device, which has been reviewed by a trained CCTV Operator."   From Legislation.gov.uk regarding approved devices: Approved Devices 4.  A device is an approved device for the purposes of these Regulations if it is of a type which has been certified by the Secretary of State as one which meets requirements specified in Schedule 1. SCHEDULE 1Specified requirements for approved devices 1.  The device must include a camera which is— (a)securely mounted on a vehicle, a building, a post or other structure, (b)mounted in such a position that vehicles in relation to which relevant road traffic contraventions are being committed can be surveyed by it, (c)connected by secure data links to a recording system, and (d)capable of producing in one or more pictures, a legible image or images of the vehicle in relation to which a relevant road traffic contravention was committed which show its registration mark and enough of its location to show the circumstances of the contravention. 2.  The device must include a recording system in which— (a)recordings are made automatically of the output from the camera or cameras surveying the vehicle and the place where a contravention is occurring, (b)there is used a secure and reliable recording method that records at a minimum rate of 5 frames per second, (c)each frame of all captured images is timed (in hours, minutes and seconds), dated and sequentially numbered automatically by means of a visual counter, and (d)where the device does not occupy a fixed location, it records the location from which it is being operated. 3.  The device and visual counter must— (a)be synchronised with a suitably independent national standard clock; and (b)be accurate within plus or minus 10 seconds over a 14-day period and re-synchronised to the suitably independent national standard clock at least once during that period. 4.  Where the device includes a facility to print a still image, that image when printed must be endorsed with the time and date when the frame was captured and its unique number. 5.  Where the device can record spoken words or other audio data simultaneously with visual images, the device must include a means of verifying that, in any recording produced by it, the sound track is correctly synchronised with the visual image.
    • Hearing took place today.  Case dismissed with costs awarded. Neither UKPC or a representative turned up.  Apparently they messaged the court on 7 May asking for their case to be considered on paper.  Never informed me, which was criticised by the judge as not following procedure.  I was really annoyed as I would have preferred for the case to be thrown out before the hearing, or at least face them in court and see them squeal.   They are just playing a numbers game and hope you blink 1st!   Ended up having to change my flight, but  the costs awarded softens the blow. Was asked to confirm it was my signature on both the witness statement and supplementary statement.  Wasn't asked to read them, said she could see my arguments made and the signs were insufficient and no contract formed. Took maybe 10 mins in total.  Judge did most of the talking and was best for me just to keep quiet or confirm any statements made. Happy to have won as a matter of principle and have costs awarded. Maybe not worth all the time and hassle for any newbies or the technologically challenged.  But if you are stubborn like me and willing to put in the time and effort, you can beat these vultures! I big shout out to everyone who helped on the thread with their advice and guidance, special mention to FTMDave, thank you sir!  Really appreciate everyone's efforts. All the best!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Alanalana

 

Am fighting a Clydesdale missold PPI for a mate and they have just tried the questionnaire (fishing expedition) carry on too. I couldn't believe it....I have supplied less details when applying for huge loans or an MOD security pass!

 

They sent a questionnaire that asked basically everything except the colour of my grannies underwear:

 

Full financial details from the date of application, salary, outgoings, dependants, full employment circumstances, loan details, loan application details, PPI application details, recollection of events, the works! Honestly...about 20 questions!

 

Basically asking for everything that should be in their system anyhoo, its a blatant fish for info...how dare they?!

 

Sent a letter clearly stating it would not be filled in as it was an attempt to gain information about the sale of the insurances disputed which should already be in their records, repeated the basic reasons the policies were useless and ended with:

 

Should you have any further genuine queries please ensure these are put in writing to which you will receive a prompt response.:D

 

They really want to play with you though don't they! Have they been warned about you? :lol:

You have given a quality response to them searching for information they should already have on your accounts. It is a definate ploy:

 

1. to slow things down and delay.

2. to gather information they should have to answer your SAR but have either destroyed it, lost it or put it out with the garbage so everyone can have access to it without having to pay the statutory £10.00 fee.

Update on HSBC.

 

went into local branch today to express my anger at the way things have not progressed.

 

The SAR postal order was encashed by hsbc on 27 may on the 17 July I get a letter from the Assistant Manager of the data protection office basically stating the original letter authorising me to act as a third party signatory to the account was not acceptable despite providing proof of my identity (passport and driving licence and an additional copy of the original letter authorising me to act) to the local branch.

 

They are insisting that a mandate authorising me to act is sent to the data protection officer before they will release the information. I Consider this to be overkill as they have a letter of authorisation. the local branch have confirmed the signature as valid and confirmed my identity.

 

The local branch have apologised for mishandling my documents and in fact could not find the photocopies of my driving licence and passport in thier files. (they have been fined this week by the FSA to the tune of £3m for losing confidential customer data.

 

So a further letter of complaint will now be issued and copied to the FSA.

 

The data controller has now insisted that a mandate is provided by familiy member to authorise me to ask for information and they have quoted the Data Protection Act 1998 Section 7 (3) (a) and (b) here is the quote from the act.

 

 

[F2 (3) Where a data controller— (a)

reasonably requires further information in order to satisfy himself as to the identity of the person making a request under this section and to locate the information which that person seeks, and

 

(b)

has informed him of that requirement,

 

 

the data controller is not obliged to comply with the request unless he is supplied with that further information.]

 

I have responded with a letter before action stating that the "reasonably requires further information" has been met by virtue of a letter of authorisation, provision of passport, provision of driving licence, provision of additional copy of original letter and copies of letter from the bank asking me to provide this information.

 

I understand fully the need to protect personal data but I believe HSBC are using this to further delay the requirement to provide the data to enable me to start on a claim for the mis-selling of PPI.

 

This is an extract from my letter:

 

I quote that section:

 

“Where a data controller-

 

(a) reasonably requires further information in order to satisfy himself as to the identity of the person making the request under this section and to locate the information that person seeks, and

 

(b) has informed him of that requirement,

 

The data controller is not obliged to comply with the request unless he is supplied with that information.”

The act does not specifically state that the account holders signature must appear on the request for data as you mention in your letter.

 

In light of all the requirements on identification requested by HSBC to date I strongly believe that your request for further information is not reasonable within the meaning of the act especially as this information has already been provided to the Brampton Branch with the original letter and a further original has been produced upon my attendance at the branch to verify my identity.

 

The failure by your branch at Brampton notify you of the Subject Access Request and to register the information on proof of identity on HSBC records is a failure by the HSBC and I will shortly be visiting the bank to discuss this matter and to provide them with a copy of this letter.

 

The fact of the matter is, that xxx was authorising me to act on his behalf as a third party signatory to his account. That authorisation allowed me to submit the Subject Access Request. I do not consider that you should then require xxx signature on the Subject Access Request.

 

Legal advice welcome but complaint to the ICO will still be submitted :)

Is all this rigmarol trying to get a hold of a specific signature? hmmmm

 

If it must be a specific mandate (ridiculous, the DPA states no prescribed form any authorisation must be in) then it would be a standard bank one...so why didn't they get you to do this when in the branch half a dozen times?

 

You are right..stalling tactics. They shouldn't have cashed the cheque if they couldn't process the SAR yet. Goo dluck

oh oh.. in that case you can expect another letter advising you that they missed that question out.. :rolleyes:

 

I suspect they are fishing for information they can then pass on to their CRA buddies.

Thank you for your letter dated 24th July.

 

Once again I apologise on behalf of HSBC Bank pIc that our office only became aware of the request on the 17th July and confirm we are doing our utmost to resolve the matter.

Unfortunately, you did not enclose the letter from xxxxxxxxx authorising you to act as a third party signatory on his account as stated. If you are referring to his letter dated 30th April I would advise that this only authorised you in relation to acting on his behalf "specifically with a view to recovery of unfair charges against my account and PPI added to 2 personal unsecured loans". Whilst.xxxxxxxxxxx Jid advise a full subject access request would be received our requirements are that this request must be signed by the account holder in order that we can identify the person making the request as a full third party mandate is not held.

I acknowledge the point in your letter about section 7(3) and would advise that the Information Commissioner has confirmed that the Bank's procedure of requesting the original signature of the account holder, to avoid unauthorised disclosure of personal data, is acceptable.

I re-iterate that this office can only deal with Data Subject Access requests on behalf of HSBC Bank pIc which is why you were advised of the address you needed to write to for information on Payment Protection Insurance (PPI).

 

However, in order to assist you I have contacted HSBC General Insurance Services (UK) Ltd on your behalf. They have confirmed that they will deal with your request in line with the specific authority in letter dated 30th April 2009 as a matter of urgency. I have been advised that the data they will supply, if held, will include the loan agreements, terms and conditions and Demand, Needs & Recommendations.

 

I have also arranged for our Service Centre to action your request in relation to any charges that may have been applied to bank account by providing you with a report detailing charges. Should you have any queries regarding the receipt of this report, please contact the Service Quality Team on 0800 88 11 55 or email servicequality@hsbc.com.

 

The above information should enable you to request a refund of default charges and PPI and is being provided under the original £ 1 0 statutory fee cashed by Brampton branch on 27th May 2009. However, if you require any further information about banking relationship 'with us, we will require him to sign and return the form we sent him as previously advised.

A copy of your letter has been forwarded to Brampton branch for them to respond under separate cover in relation to the issues raised about your visit to the branch.

Thank you for your reference.

 

Your letter suggests that a list of charges covering the period 06 April 2001 to 10 July 2009 was enclosed with your letter.

 

This in fact was not the case the only item enclosed was a leaflet entitled Listening to your comments.

 

No list of charges was enclosed. The request for information commenced on 30 April 2009 and to date no information has been forthcoming.

 

I will now require the list of charges as a matter of urgency.

 

 

Up until this latest fiasco, I have held off from submitting a complaint to the Information Commissioners Office.

 

 

I must now inform you that the complaint will be submitted together with copies of all correspondence exchanged so far.

 

I believe I am addressing this letter to the correct address to raise my concerns as pointed out in your leaflet.

 

It would appear that your department are also incompetent when enclosures are stated to be present but clearly are not.

 

It is difficult for me to see this omission as anything other than a further delaying tactic in supplying data

that has been requested under the statute of the Data Protection Act 1998.

I bet they do!

 

It's amazing what banks cannot find when it doesn't suit them, and what they can find when it does.

Well at last, the data arrived today sent via courier to local branch.

 

I collected in person and I now claim the CAG (Possiby world) record for data supplied under a Data Subject Access Request.

 

Actually delivered in a box and weighed in at 6.8Kgs or 15Lbs (for the imperial members.)

 

I had to produce proof of identity as per their letter so took a passport along.

 

Kept hold of it until I was formally asked for proof of identity and as I passed it to the manager I stated "You already hold a photocopy of this passport from my last visit" Reply "ahh yes but we do not keep documents in the local branch". ( really clever bunch )

 

I kept my calm and did not respond on the issue of HSBC losing photocopies of passports, driving licences and such.

 

I did however request the return of the letter I had produced to the bank which was sent to me telling me the information was ready for collection. (it was addressed to me after all).

 

So now reams of paperwork to view but I already have seen another loan that I was not aware of and I would guess there is PPI there somewhere.

PS the 6.8KG may possibly be due to the fact I have a complaint lodged with the Information Commissioners Office !!

Ok so 6.8Kgs is kind of small in comparison. Your letters obviously worked but I will bet it will take you a lot of time (what the banks want to keep your cash) to sort through everying. So I bow to the bigger box :) of data.

Letter received today full offer of premiums paid plus 8% statutory on the loans. It is not a bundle of money but it isw another PPI success.

 

Money to still to be repaid to an account (Thankfully there is an account available other then HSBC)

 

The offer has been posted for acceptance as I was only the go between on this claim. More details will follow but it is IMO another positive result for Reclaiming mis-sold PPI.

 

Keep up the fight on PPI it is important and the bank charges ruling by the Supreme Court is due on the 25 th NOV so keep on top of that as well.

Twas a great result.
