Think I have come to a plan dx please correct me if I am getting you wrong but I am going to go down the route you suggest. simply stop payments for now until I receive a DN and it gets marked on my file. Then contact each lender and start making token payments to each one. i then assume most like they will then at some point sell to DCA. Once they are sold I’ll be coming back to see how best I deal with it.  Let me know if I am making some error in judgment or missing anything with my plan

    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

its so frustrating - when 1st posted on this site in july - everyone said oh it will be quick pay out when they gt claim form - then in septmeber when i got AQ everyone said - they will probably pay out day before AQ deadline - then now everyone is saying - they will pay day before court

 

i now think i will end up in court as by january they will have found a way to worm out of it - i am claiming 4k and claiming 8k off RBOS.

 

I have never had any money given me or never won any either - so i am not holding my breath but its worth a try.

 

just gettin fed up of waitiing - i kept telling myself - it will be sorted for xmas but now it wont be. - think i might send a letter to solicitors - but once i have received court date from court the solicitors will receive their notice too so they are not gonna pay out in the 4 weeks they said on AQ as they will now know they have till January.

I too spoke to court today. As they sent me a court date for January the 25th. I ask why it has been delayed so long they said the Judge at Chesterfield want all Bank claims to be on the same date and after the Houses of Commons have made a ruling on the situation. Not sure what that means she was very vague. It looks like I will not be getting my money this side of Christmas either. SC&M told me they settle in order of the court dates...

Wish I knew what the Houses of Commons thing is. The lady at Chesterfield court were very vague when I asked her what she meant....

As for trying to get Lloyds to settle... My month is over this week SC&M just keep telling my that Lloyds have not given them instruction, they also said "have you got a court date" when I said I had for the 25th Jan they just said that Lloyds settle in order of the court dates... So I guess it is another waiting game.

I don't know if all the courts are setting there dates for January or if it is just the Judge at Chesterfield County Court . Don't think you need to panic... I just think Chesterfield judge wants to delay things (may-be) till he see the out come of other cases.

I suspect she is referring to the OFt investigating charges - but got it wrong which is probably why she didnt or couldnt enlighten you any more.

 

We are not aware of any rulings due to go through the house of commons but if you find any further information from Chesterfield court please let us know.

sorry Molly, I have the flu right now and I'm also trying to nurse my two girls who are both down with heavy colds and sore throats...I'm in no mood for these cow boys to say the least.......if I bloody phone them I'll come accross as a heavy breather and end up in court for harrassment...lol......

Dear Sir/Madam,

 

Thank you for providing me with a copy of your completed N149 Allocation Questionnaire, which I received on xx/xx/xx.

 

Referring to the Allocation Questionnaire, I must admit to being somewhat surprised by your response to Section A (Settlement). You have ticked ‘yes’, thereby requesting a one-month postponement in proceedings in order that a settlement may be reached by way of negotiation.

 

Please note that throughout the process of this claim, neither yourselves nor your client have ever given any indication whatsoever that you wish to settle this matter without the need for litigation. In fact, in my previous attempts at dialogue with your client has been met with outright refusals to negotiate this matter, and on xx/xx/xx, I received a letter from Lloyds TSB’s service recovery centre which explicitly stated that the bank had issued its ‘final response’ and therefore would not enter into any further correspondence. It is for this reason that I felt I had no alternative but to seek redress by way of Court action.

 

Having said the above, I do believe that litigation should always be a last resort and would of course be happy to settle this matter without the need for a court hearing. Please be advised though, that I am completely confidant in the strength of my claim and believe that your client’s charges could indeed be proved to be unlawful penalties, which you are trying to cloak as contractual service charges. For this reason, I will only settle for the amount of the claim, namely £xxxxx (which includes interest to date and add on 8% interest per day until the I receive the money)

 

In light of your indication of your intention to negotiate, I will await your communication informing me of how you wish to proceed.

Nope, fraid not Molly. They are very secretive about their e-mail address for some reason. They have been asked for it a few times, but always decline and say to fax or write instead.

hi there

 

just to let you know i have had a letter this morning from chesterfield county court - my hearing is to take place 24th january 2007

 

the court have ordered that i send all particulars of my claim & evidence of other claims within 28 days - when they receive my particulars then they will write to Lloyds asking for their particulars and also for the breakdown cost of charges and evidence that they are correct - they also have 28 days from date court receive mine.

 

if they do not reply with particulars the judge has requested then the defence will be struck out.

 

i am going to take my stuff into court on thursday - hope that lloyds dont get theirs in - also been thinking that LLoyds have not given anyone a breakdown of costs and if the judge has asked for it they have to give it - or pay up (i hope)

 

On their AQ they have asked for 4 weeks to settle - that was 2 weeks ago - the court have decided not to allow the extra month and to proceed with court proceedings - just annoyed with how far away it is - but if they dont give all particulars required could have my money by end of november fingers crossed)

 

just thought i would let you know as i know alot of you are at the same stage as me

courts told me today that another stay has been granted..and she said that I should send a letter to the district judge so I'm drafting one out tonight.........I'll run it past you all later....and hand deliver it first thing in the morn.............
