I've recently left the family home due to domestic abuse,the property my ex and I lived in had an assured shorthold tenancy this ended in jan and became a rolling tenancy,however the landlord is my ex's boss and I'm not sure if he has given my ex a new tenancy without me on it.Is the landlord allowed to do this without me signing or knowing??? Or does the landlord need me to sign something to say I have left the property?:???: I'm very confused I've looked at many sites that says I can give notice on the property to end the tenancy but I cant find anything that gives me advice about what happens if the loandlord writes out a new tenancy without me on it while I still have the rolling tenancy in my name

You can give notice to terminate a periodic tenancy and then that's it. You will probably have to give at least one months notice to expire when you normally paid the rent. For eg if the rent is due on the 15 May you need to give notice by the 14 April. You will still be liable for rent etc until the tenancy determines.

 

What the landlord then does next is up to him - if he agrees a new tenancy with your ex then that is a new tenancy, nought to do with you.

Becareful. The correct date your notice must expire is not the rent due date but the same date in the month that the fixed term came to an end. Rent due dates and this date are sometimes the same, but not always.

thanks for your advice will use the link as I have found out today that the landlord/his boss has backdated the tenancy to jan this year when the old tenancy's date turned into a periodic tenancy and has omited to put my details on it without giving me notice to quit or without me giving notice on the flat and it still has all our belongings in it an they also changed the locks and are refusing me access hmmmm

In order to help, whats your angle on this? what are you looking to achieve?

 

- Do you want to return to live in the property with your otherhalf (former otherhalf)?

- Do you want to wah your hands of the entire situation and move on?

- Do you want to move back into the property and your former otherhalf to move out?

 

Let me know which it is an I can advise if there is a way to do it and the best way to go about it.
