    • Which Court have you received the claim from ? Northampton  Name of the Claimant ? Overdales solicitors  How many defendant's  joint or self ?  Self Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to.  13 may 2024 What is the claim for – the reason they have issued the claim? the claim is for the sum of £6163.61due by the defendant under an agreement regulated by the consumer credit act 1974 for hsbc uk bank plc. Account 4546384809766042. The defendant faild to maintain contractual payments required by the agreement and a default notice was served under s 87(1)  of the consumer credit act 1974 which as not been compiled with. The dbt was legally assigned to the Claimant on 23/08/23, notice on which as been given to the defendant.  The claim includes statutory interest under S.69 of the county courts act 1984 at a rate of 8% per annum from the date of assignment to the date of issue of these proceedings in the sum of £117.53 the Claimant claims the sum of £6281.14. Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC (Pre Action Protocol) ?   Not to my knowledge. Have you changed your address since the time at which the debt referred to in the claim was allegedly incurred?  No Do you recall how you entered into the agreement...On line /In branch/By post ?  Online but it was for a smaller amount they kept on increasing this with me asking Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim.  It was assigned to a debt collection agency  Were you aware the account had been assigned – did you receive a Notice of Assignment? yes  Did you receive a Default Notice from the original creditor?  Yes I also made offers to pay original creditor a smaller amount but was not replied to Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ?  No Why did you cease payments? I was made redundant and got a less paid job I also spent some time on furlough during covid and spent some 3 months on ssp off work. What was the date of your last payment?  May 2021 Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes at the time I communicated with all my creditor's that I was running out of funds to pay the original agreements once my redundancy money ran out that was when my accounts defaulted. I then wrote to all my creditor's with pro rata offers of payments but debt collectors took over the accounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks for the info, still had no reply from lloyds and i am now wondering if they think i don't have enough grounds to take them to the ombudsman. Surely they would try to put me off further. As you know my charges are an awful lot over 6 yrs, but my story goes like this

In January my husbands work dried up badly, and we were charged again for overdraft etc.

In February my statement said we were going to be charged £455 for all the D.D sent back etc

I telephoned them to ask if they could stop the charges as if they took them out my bills would not be paid and then all the others wouldn't and it would just escalate my problem, reply was 'cannot help and cannot stop the charges, but to put a claim in for the last 6 yrs.' They told me to do it! Low and behold they took the £455 out and all my other bills weren't then paid

Then i noticed this site and started the ball rolling to claim back all my charges. My bills were being sent back continuously and i have never recovered. I telephoned again in March and she looked at my expenditure and i told her my income. She agreed that i was in financial difficulty and asked me to change to a basic account, which i did.

She said they would stop further charges and would up my overdraft to cover a few bills. but every month they lower the O.D by £50. Which i am still struggling to find along with my utility bills.

I have since opened a parachute account and transferring my d.d to that account slowly.

Do you think Lloyds have done everything to help me?, Do you think the Ombudsman would see it that its all my fault?

I'm unsure whether to take it further because i'm not entirely certain that Lloyds have made it difficult for me.

Although i feel they haven't helped much, since sending the letters about financial difficulty they have nt really responded, only the normal formal letters that they send to everyone about the OFT in July and all that jarglon

What is the opinion you think of my case?

Senferlaka, you tick some of the boxes for financial hardship; income reduced, more than £500 worth of bank charges in the last 12 months. I would suggest from the above that you have priority debt arrears(mortgage/rent, council tax utilities) which ticks the boxes. without seeing your income and expenditure form it would be impossible to say for certain that you are in financial hardship as defined by the waiver. HOWEVER, you appear to tick more than two boxes and I suspect you might tick a few more.

Ombudsman wouldn't be looking at if its your fault or the banks' but merely whether you are suffering financial hardship as defined by the waiver.

I ll start the letter and keep all informed. Lookoing at the success stories of people in financial hardship Barclays seem to be forgiving but not many at all mentioned the dreaded LLoyds

Well would you believe it, stopped all my direct debits and LLoyds have started taking out overdraft interest charges now plus charged me for returned D/D's again. They had stopped all charges but since i ve cancelled all my D/D they have taken out last months charges again. Now i'm over my overdraft and can't afford to pay the charges to bring it under the overdraft, so next month more charges, great!

I did telephone FOS on monday and they are looking into my case for financial hardship, but not sure what happens next. More stress........

Furthermore you can go back further under the FSA Waiver which is to 27th July 2001 so you might have missed a few charges ;)

FOS sent LLoyds a letter about my complaint with them, Lloyds just sent a pre written letter to me stating the same thing, until the Test Case is concluded they will put everything on hold. Lloyds are now charging me for interest and overdraft charges, over £130 per month and i aint got any D/D in the accounts and not using account at all. In my opinion they are certainly not helping. CCCs have sent them a letter stating i am now on a DMP and have given them the amount they will get. I am now receiveing 2 phone calls a day, and have received a letter saying i am not returning my calls when they leave a message and i have not responded to my overdraft, meaning i should be paying £50 off per month(which is what i agreed with them some months ago). Don't know which way to turn, do i ring Lloyds and tell them about the letter they should have received from CCCS or do you think its a way for them to pressure me into paying more (that i can't afford) or should i contact FOS in 3 wks time (8wks are up then) and explain what Lloyds are doing to help my financial hardship( zilch)
