Hi, please could anyone help with the following.

 

I have a credit card with HSBC which i believe I took out in 2007. I have sent them a CCA letter on 01/12/2008 as i do not have any copies of my agreemnet. to this date i have not had any response to my letter. They have not even acknowledge it. I sent them the letter by recorded delivery.

Please can someone advise me on what to do next, i.e which letter to send them and if anyone has any templates please could you send them to me.

Sorry , JD 2002, you seem to have sipped through the net for a couple of days ,- but better late than never , eh? :)

 

This be something like what your are looking for - you can tailor it tio suit your requirements ......

I am disappointed that you have failed to respond to my request for a copy of my Credit Card agreement to which I am entitled under the Consumer Credit Act 1974 (Sections 77−79). A copy of this letter is attached for your convenience.

I have previously enclosed a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

I understand a copy of our credit agreement should be supplied within 12 working days.

I am sure you also understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

Failure to respond positively will be reported to the Financial Ombudsman Service and the Office of Fair Trading.

Yours faithfully

Hi, update on this. I received a letter from HSBC today regarding my CCA request. It basically states they will not provide me any details until they receive a signed letter from me! Says they are not obliged to send anything. I have scanned it on Photobucket. Please could someone have a look at this and tell me what to do.

Do i indeed send them a letter with my actual signature? How should I respond to them?

This seems to be the usual response at the minute from hsbc.You could try sending them the letter below, but they will still probably refuse :roll: The same thing happened to me.They have until tomorrow before i report them to the ICO and then possible court action.

RE Account Number: xxxx xxxx xxxx xxxx

 

Thank you for your letter dated xx/xx/2009 the contents of which are noted.

In your letter you make reference to requiring my signature before you will comply with my request. I draw your attention to the fact that the Consumer Credit Act 1974 does not require that i supply you a copy of my signature before you comply with my S77/78 request.

 

If it is for Data Protection purposes then i can happily supply you with documentation to substantiate my identity to you.

 

However please note that to date you have happily sent statements and correspondence containing extensive sensitive private information to my address. I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this?

 

As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998:

 

7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.

 

My request for a true copy of my credit agreement under section 77/78 was made on (insert date) and the 12 working days for your compliance expired on xx/xx/2009. I note that there is no provision that removes the requirements of the act to provide this information on time, even if you are unsure of my identity.

 

I look forward to receiving the documentation requested

Any further refusal to comply with my request will not be tolerated . You have (insert no.) working days to produce the documents which I require , before this agreement is considered unenforceable .

Furthermore , I consider that this account is now firmly ‘In Dispute’ until this matter is resolved .

You should also be aware that I will pursue compliance through the Courts using CPR if necessary

Please help,

 

I have again received another letter from HSBC saying the same thing. They want my SIGNATURE!

 

I have written to them again today, with the following response:

I would give that a try JD2002 - (well I would say that wouldn't I ? ) :rolleyes:

 

However , have a look at lee's thread to get an idea of where they may head for next ....

But carry through your threat and report them to ICO & FOS if they don't comply ........ and also consider taking court action to make them produce . A judge would be pretty unchuffed if they suddenly produced a valid agreement in court after failing to provide it to you as required under normal DPA regs .
