    • Do not under any circumstances plead guilty until we know what we are dealing with. It's a sure way to 9 points. The tried and tested way to handle this is to plead not guilty to both charges and offer to plead guilty to speeding provided the "Fail to give information" charge is dropped. But I am concerned about this "ticket refused" sticker. I've never heard of this before. A "ticket" is not a term used in connection with speeding offences. There seems a distinct possibility that your response was received by the police but one thing worries me: I've never heard of a sticker being placed on a response and it being returned "Return to Sender". t's just not what ticket offices do. If you could post a picture of this document and the sticker it might help.  If you can show the response was received you may have a defence to the "Fail to Provide" charge (provided you completed your response properly). If the police are saying you did not respond they cannot succeed with a speeding charge (as they have no evidence you were driving). But if you did not respond, who put the sticker on the document and sent it back yo you?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well im new to this website and have found all the threads and info amazing......to think 3 days ago i thought my charges were irrecovable

I rec'd a letter from 1st direct on friday 23rd june stating that if i incurred any more charges they would revoke my banking faciltiys, so of course i rung them and was informed as soon as i called up (before even stating my query) that i would have to be passed to another department. I asked for a reason and the lady on the phone ummed and ahh'd a biot and gave me no reason. she did however pass me through to a lovely lady called jjane who went through various details with me then explained that over the past 11 months banking with 1st direct has cost me 1463.17 OMG what a shoock that was. So she then said she would cancel my cards and i would have to call her back in two weeks to discuss how i was going to pay back my overdraft of £340.

this was fine but obviously i was in shock about the charges so with a little bit pof research i came acrross this site

luckily for mt first direct keep your statements online so i have details of my charges already

so no subject access for me!!!

1st 14 day letter is going out in the morning so i should have a reply by monday 19th july which i know will be the same letter everyone gets. I will then promtly send on the 10th my second letter giving them a second chance and 7 days to reply so in theroy my money claim will be logged on wednesday 19th july and hopefully i will have a refund by beginning of august!!!!

we will see i will keep this post running as i know its handy to see how other people who bank with the same bank as you arre working out.

Any advice will also be greatly appreciated

Ive only had the account 11 months so i have all the statements online, have just printed them off as they will probably withdraw my online facility as they cancelled my cards

- i know the charges are crazy for that amount of time, wont try to justify them but i will say for a chq of £25 bouncing £37.50 returned chq fee £30 overdraft fee and £35 unauthorised overdraft fee does make up the extent of it - £102.50 for a counced chq is ridiculous.

also just sent of a subject access request to halifax for 6 years muct be a coupld of grand there aswell. i will start a new thread in halifax for that one.

If this works i will of course make a donation - without this site i wouldnt even know to claim!!:-D

Well got a reply from first direct today for my prelim

 

it stated the normal rubbiish of how they dont agree etc, sayong that they are unable to agree to my request of refunding my money and to escalate to KERNAGHAN which is blatently a sudaname,

 

my letter is hand signed thou, quite shocked as i thought it would be printed automatically......its signed Maureen Watson has anyone heard of her yet.

 

Well as it says they aint gona pay do i have to wait 14 days as i have already had a responce or can i send my LBA now givening them till the end of my 14 days.

 

I note some people are doing this but all different ways

 

some say wait 14 days then send LBA for 7 days some say wait and give 7 and others say dont wait just send lba wiith 14/7 days very confused..............HELP!!!!:???::wink::???:

well i waited in the end and sent it last thursday, was actually a couple of days early but my prelim went out with the wrong date on it when i checked the copy so it works out just about.

 

I only gave them 7 working days - so they have until this friday to reply.

 

 

nothing as yet but will post as soon as i hear

 

hopefully when i get home!!!!

Hiya all

 

Well i got a reply from mr kernaghen (or whatever his name is) saying he doesnt gree - thing thats funny is that i did bring up another query which did require a specific reply to - still standered responce though stating the matter is completley closed as far as first direct are concerned and to contact the ombudsman- i think mr keranage is the name of a printer lol.

 

 

well i done my moneyclaim on 16/07/06

 

it was showing as issued 17/07/07

 

so now just have to wait for it to be acknowledged...................does anyone have any idea how long it takes them to acknowledge - just really impatient so any details about what happens next would be great - anyone else who just done there money claim also would be good to know as soon as something happens:cool: :razz::|:(;):D

Saturday morning i go a letter offering half from DG Solicitors - have written back stating that i accept this as a partial paymentand will continue my claim for the rest. Hav ealso put my tel number on it and stated they can call me to discuss if they wish. they would have got it todays.

 

 

Payday is getting closer£££££££££££££££££££££££££££££££££

really happy right now hopefully it wont take them to long to pay up.

She didnt ring me back - it came in the post. i actually rang her from work this afternoon as i left before the post this morning to check if she had my respnce...she said that she didnt know and she would have someone look at mmy file - if they didnt they would ring me. i dont think she is dealing with them personally they have admin assistants that are. i think that its just her name on the letters etc

 

you will probably have yours acknowledged tommorow and your letter on friday.

I'm still waiting on my claim to be acknowledged as I filed it on 17th July but nothing yet. I could really do with the money being returned asap as the children are on school holidays and days out are expensive. Hopefully they'll pay out just as quick as they did for you once it's acknowedged.

Has anyone managed to pursuade them to put the money into a non hsbc/first direct ac**** by BACS transfer it just i sent them a fax asking for this today - i stated on there i would accept the BACS charge of £20 LOL

 

I know i should wait for a chq just had a hefty red letter from britch gas saying if i dont pay with 77 days they will install a watermeter - halifax takes 5 clearw/days to cash a chq so BACS would be so much better!!

i just checked my online banking (my accounts closed so i rarely bother and i have just noticed that an extra £202 in charges were added last week - even thou they reckon there charges stop at £149 even if you go over. my account has been closed for a month and my most recent statement did not show these on there.

 

Do you think i should ring debbie a'abney at DG and say that i want them added on to my settlement or we i have to claim seperatley now...........what a nightmare!!!!

 

 

 

I have already agreed that my overdraft be settled with the proceeds. i know i am able to say i dont want this and demand that they pay direct to me but to be honest i want rid of the debt before it goes to a debt recovery agenency cause at the moment it aint affectiing my creadit file.

I would just send a letter saying these extra charges wouldn't have occurred if they had not delayed and ask they be added to the claim.

I actually phoned them this morning (first direct) and explained that they had not otified me of these charges and therefore i would like them back. i told the lady that i only had a statement two weeks ago and there were no details of charges on there.

 

She then said that they dont have to put them on there if the account is closed ................this is how ridiculous they are im sure there is some law that states they have to notify me.

 

Anyway she said that she would credit the account £74. not even half but better than nothing. im gonna call DG in a bit to explain that these charges have been added since the claim and could they also be erefunded. if not i will state i will do another moneyclaim.

 

I actually put in my letter to mr kerr that i wanted all future charge not yet applied to be taken off. so if they wont refund he has already had notification of sort that i dont want to pay these so i will ddaft a letter giving him 7 days to pay these back- if he dont i will moneyclaim straight away. im not going through the 28 days again lol

the account is closed so they are sending me a chq apparently so it will be about 10 days till i get the funds cleared as halifax take 5 clear w/days and i have to rec've it

Congrats on your win! Ive also just sent for extra £75 in charges, hoping they will just roll over and give it to me like they did my first lot! Cant believe they charged you nearly £250 in one month - its shocking

I know, its daylight robbery, just hopeing the banks are gonn lower there charges soon like the credit card companys, i know we can claim them back but we have to wait and with 2 kiddies to feed sometimes you need the money quicker lol good luck with all your claims, hopefully they will pay out straight away for our second time, they know we aint bluffing about the court action and as its smaller hopefully we will both get a chq shortley :-)

I am made up you have won against them i have been having sleepless nights with F.direct i am in a pure snowball situation.

Each month i get paid i pay them the money i already havt got in charges. Nightmare.:o

 

Anyway i have sent them the first letter, asking for the money back and today i got the standard letter back from them saying NO !

Here is my question i hope you can help with,

do i know have to wait another 14 days to send them the second letter ? or do i send the other letter giving them 14 days, before i go ahead with the moneyclaim letter ?

Also is the second letter the LBA ? I have read the FAQ and the steps but am still not sure.

Also do you know if when the steps say keep the claim to £5000 that means in more than one account or if this is just one, as i have a total claim of £5350 coz my joint account had £2500 and my sole the rest, do i let them off or can i claim them seperatly ?

Any help would be most appretiated.
