  1. yes but now you do not have consumer credit agreement they can only charge normal base rate. Much cheaper than credit card rate
  2. A simple acid test would be to multiple the number of interventions by the time needed and see if it adds up. I would guess that at the rate quoted and time taken they would need millions of staff doing the same job. Poor Emma could only do 5 jobs a day? Yer right.
  3. Ok decided to settle for this. So I guess my thread need to now read I won! Waiting for dosh to arrive then ready for survey and donation! Just Egg left.
  4. One point I have on this and it's just a thought. If they do cancel then surely the consumer credit act no longer applies and it becomes civil debt. If you then rigth back offer a reasonable repayment plan then they should accept (unless they think a Court will award more). However they cannot charge high interest rate just normal 8% etc ? Much cheaper way to pay back the money. Just a thought!
  5. Not fair boo hoo mine has taken at least 10 days before any response. Well done !!!
  6. Can someone advise. Had a response to my MCOL from Halicrap. Two of the charges I am reclaiming are greater than 6 years. I know I can argue that the statute of limitations doesn't apply because they hid the true charges until OFT found it i.e. preventing my from exercising my legal rights. When I put in my claim I thought I'd at least try. Had a look for previous threads with no luck yet. Not sure if it is worth a big fight for £662 out of £2579. Has anyone gone back to them on this then been paid? Anyone out there can advise. I need to respond to Halicrap.
  7. Guess I was wrong. Now 8 days since money claimed issues and nothing after acknowledged. Typical - most post seem to get a response in a couple of days. Maybe they like to make me sweat -
  8. Let them collect ! it will be interesting for the bailiffs to go to Head office and collect.! ps. Avoid CAPs it's classed as shouting
  9. Congratulation. My MCOL was submitted the same day! hope they don't put it in my closed account.
  10. Ah finally aknowledged the claim. Guessing by other thread I should expect it will say they intend to defend.... Bring it on.... but suspect they will deflate me by paying up in 2 days... shame I was ready for a fight...
  11. It obiviously makes sense for them to go to hearings but whether they are a good barrister or not only time will tell - plus they have to have the law on their side! and they haven't, so it seems. Even the best barrister in the world can't make a silk purse out of a sow's ear.
  12. Well guess I was a valued customer. At the time I suspect they thought "this guy spends lots on cards - so big bucks for us in this" Little did they konw but even by then I had learnt the hard way. Credit cards are not a sensible way to take credit.
  13. I afirm that. Follow the procedures they have worked for lots of people. Unless you are a lawer and think you have a better route. If you don't you might get tripped up big time.
  14. They sent a cheque to full amount without court or claim.

Cancelled my Egg card today and paid off balance. Now I am in a better position to do the rest.
  16. finally issued money claim Wednesday. Showing as issued. Now the waiting This is virtually the last of my banks. This time I will have plus balance and can at last make contribution to the site. sorry to the mods in taking time but even though I got paid by FD and Amex still couldn't find money. Now things look great. I will be in credit for the first time in about 6 years. Thank CAG.
  17. I did - Some don't. I think they only bin it anyway. They alway know them.
  18. Good luck with Amex - I actually found them OK to deal with.
  19. Did I read you agreed for it to be transfered to the home Court? To this I would say a big fat "no way Jose!" The Courts should hear it at your Court.
  20. I would suggest you write to Oliver Blair and tell them you are in dispute with the Halicrap over the amount outstanding. They should they bounce it back to them
  21. I think you need to write to the Debt agency and advise you are in dispute with the Halicrap over the fees and they owe you money. Therefore they should take no further action. Ask that no further person calls you and that all further correspondence to be in writing. Or you will consider it harrassment and pass it to trading standard and or the police.
  22. This sounds so familiar - I went through the same thing 2 years ago. I had to take out a 2nd mortgage to repay the £10,000 they demanded. To be honest it was hell. If I could calculate the cost to me of the knock on affect I'd take them to Court. After finding this site - I wrote and demand default notice and found they hadn't issued one and again they removed it quickly - but I have had 3 years of poor credit and increased interest rates. They seem to pass stuff quickly to agency but don't sell debt. So "it is not out of their hands'. Glad you got it sorted.
  23. Depending how much the debt is and the charges you can advise debt recovery people the debt is in dispute. That will mess them up.
  24. Yes money in account. Yippeeeeeeee Sorry been away on business so didn't have time to update. Now back for a day then off again. Just time to celebrate. Will make donation on my return you can bet on that. Need CAG still got lots of claims lol. We love you CAG XXXXXXXX
  25. I would suggest they cocked up - I take when you got sent the money you reminded them of the 8% and Court fees. If so they are going to defend them. Not much chance of them winning that I think.
