  1. Sort another account as soon as you can, even tho my account had always had peroids of being over the overdraft...... FD seemed happy to just charge but when i started the claim i was contacted and told they would be shutting my account but not just mine my husbands to even tho he was not odrawn and this seemed really unfair but they said it was because it was the same address, to be honest am not having that i really think it is due to the claim my account was closed as this had never been discussed before, bully tactics. So my advice is to cover your back.Open a new account asap.
  2. Ring them or write another letter to tell them you are concerned they have not sent the statements already, a gentle reminder will not go a miss. Good luck

I was in the exact same position as you guys, and i have filed for only my sole account initially starting with the original request for statements i kept all the letters separate, although the sole account i have now put forward the moneyclaim requst, i am awaiting the outcome of this claim before proceding with the joint and the my husbands sole account, what made me even more determained was the fact in the middle of my claim the decided to close all three accounts. this had never been discussed before as they seemed more than happy to carry on taking the charges each month they also knew we both earned enough to cover it, but when i started to question the way they thought this was ok, to take such massive charges each month they took the accounts away. Thank god we had followed the site advice and opened new accounts eles where. My advice is as the others say do it all seperate same letters different headers for each account, the cost of recored delivery is worth it to make sure no mix up. Good luck

Andy it depends on if the bank submit a defence or not. with my claim they did which bought them another 28 days. then if the claim is not settled then you will get the court questionaire which is the stage i am at now. I will have to pay another £100 for the case to be heard. Hope it will be resolved before then, we will see. Good luck clare
  5. I know number6 you are right and this is how Mad i felt when i got the letter, i was like ' how dare them' . So i am going to hold my bottle for a few days and see what happens now i have told them to Bog off ! got court questionnaire today so need to act on that soon as. thanks for keeping me strong, This site does Rock ! I have told them to shove it basically and i am unsure if i have done the right thing now, but it made me mad that they had had this money in the first place then they are telling me how to spend the settlement........ bad form i think. they are real bullies !   8. hiya richardje I sent a fax yesterday saying basically that was not the settlement we agreed, So i will be continueing the court action and i faxed and posted the 'NO' via recorded delivery. So i guess i wait now and see what happens. Today i also received the questionnaire from the court. It is scary isnt it, and you are right what you said about paying off any debts with the money, i do plan to do this however i have things that are costing me more to sort first. other wise i would have accepted the offer. Thanks for the motivation i will keep you posted.I will have to go on the site now to read up on the questionnaire, also that will cost me £100.   9. Please tell me, what happened did you get the full settlement ? did you stick it out as i am about to do the same. A LITTLE SCARY AS I REALLY WANT TO CLEAR DEBTS WITHT THE SETTLEMENT.
  10. THANKYOU, so much. I read on another thread, a similar story to mine and they too said No, and they did get the full amount, so am off to Fax a letter to this affect. What you say is so true about the credit game, i really want this money to pay all debt off we have, and start a fresh. This whole experience is a real eye opener, as it is a mugs game to have credit.Here comes 2007 and a new educated me about money. Thats why this site is so good, it not just helps you get back what is yours but if you are bright it makes you realize never to go back..............I WILL CHECK OUT THAT GUY IN AMERICA.   11. Hi Guys, To date i havn't set up my own thread as all pretty much the same as everyone eles. Could not have done this without the site help, and i was just hoping to give a donation and a big thankyou in my initial thread........ WRONG ! However as of today i am so mad. I have followed all the advice on the site and on my first claim for my sole account with First Direct i am claiming £4220,for the full six years. They initially offered me half, to which i told them thanks but no thanks, then i got the full offer. What i thought was a rather large coinsidance In the middle of my claim they told me they could no longer allow ME to run my account like I have been and shut them all down, which was a joint my sole and my husbands sole,which was bad for him as his account was not even over drawn, they said that didnt matter that they could shut all accounts down as they had the same address, As they did this they totalledd together all the overdrafts and that months charges of £400...... yeah £400, giving us a total debt of £2111. We agreeed to pay this back £50.00 a month (but i do also intend to do a seperate claim for the charges which are not included in this claim.) Any way the reason for my anger, is today after a two week wait after my acceptance of the full offer, was a letter of DG saying :- Our cliant has advised us that your account is in arrears. As such our client has sent part settlement monies totalling £2114.14 to repay the outstanding balance. Our client will be sending you a cheque for the £2108.86 the balance of the settlement monies. Now hang on a minuite, i did state in the letter accepting the full settlement that i would only accept it in a cheque to my home address, The other monies owing on the joint account which i have a signed agreement to pay £50.00 a month to has nothing to do with this claim and i think it is disgusting they can do this, So my question is Can they do it ? What should be my next move ? Any help be grateful.

GREAT NEWS FOR YOU AND I BET YOUR WIFE JUST LOVES YOU ! i am going to ask for a cheque also so your thread has helped me to have the confidence to do this now, as they have closed my account and i o them the overdraft,which i do want to pay but not with this claim. So thanks for a great info thread with copies of letters etc, your right it is worth it all and holding your nerve is key and reading all the FAQ, as it would be very scarry on your own, this site does ROCK ! So i sent my letter today saying thanks but no thanks for initial offer, so lets see whats happens, arararararar ! in a strange way its really excited. !

Hiya, I too received the first offer today from DG, and will post tomorrow the letter to say thanks but no thanks, But i just wanted to ask if anyone knows, if i am successfull in gaining the full amount back how do they pay you the money ? As my first direct account was closed down just last week, by them as they said i was running it so badly....... (oh i wonder ? why as you said earlier i paid in aset amount a month which should have covered everything however one month you go over drawn and them charges just keep rolling in on top of one another making a bad situation a whole lot worse, they had never talked about closing the account before i really think this calim had added to that decission but you know what am not arsed now, the laugh is on them if this comes off as it has just made me more determained to get the money back. But going back to my original questions i dont want this money to go into that closed account and them take the overdraft i o them straight away as i have plans for the money eles were, so can i request a cheque ? Any help be appretiated, TA
  16. i have had the acknowledgement letter and first offer on the same day, today. will fax a thanks but no thanks. and obviously will not be signing the confidentiallity form. Happy days hey i really hope i get it all back i will be well happy !
  17. well done you..... I sdded the 8% on last night and it worked out a further £800, so hope i have it right. I am about to do the moneyclaim form now. It is true what you say it is a case of holding your nerve i will be glad when its over the be honest.

Hiya Guys, I have had the letters from first direct not agreeing with my claim etc.... and i am now at the moneyclaim stage, two things since my original claim i have been charged a further £300 across two accounts in charges can i sdd them to the claim or do i have to request them seperatly, and secondly do i have to add the 8% interest at this stage, i added it up last night on the spreed sheet and it comes to a further £800. But it is more complicated and i am terified i have it wrong and this will result in them defending it in court etc. Any thoughts would help. Thanks

I am at a similar stage to you i have sent the LBA, they have until the 18th to respond before i go to money claim, am getting excited now, you would think tho they would stop being silly and if someone has gone this far just pay them back as i have nothing to loose my account is closed, so am getting that money back.   20. Thanks for your help with this , todate i have sent everything seperate for each account and i will continue to do this with the moneyclaim, they have until the 18th aug to respond to the LBA. Tell you what though i would never have got this far without this site, real POWER TO THE PEOPLE stuff. My account is also closed as off today they rang me with that news tonight (great) but again thanks to this site i have a new account set up. Will keep you posted regarding the claim, and congrats to you on your win.

Good luck with it, you are one letter ahead of me, i am expecting to be told again to Go away again.then i will fill in the moneyclaim form on line i am claiming a total of £3143, sole account and £2500 joint account. So i have requested each as a seperate claim so it does not go over the £5000. Is it just me or do you get the feeling it will all change with your claim, and even though all the other claims have been paid in full, your cliam will be the one who they take to court........
  22. Hiya Hannah, I am made up you have won against them i have been having sleepless nights with F.direct i am in a pure snowball situation. Each month i get paid i pay them the money i already havt got in charges. Nightmare.:o Anyway i have sent them the first letter, asking for the money back and today i got the standard letter back from them saying NO ! Here is my question i hope you can help with, do i know have to wait another 14 days to send them the second letter ? or do i send the other letter giving them 14 days, before i go ahead with the moneyclaim letter ? Also is the second letter the LBA ? I have read the FAQ and the steps but am still not sure. Also do you know if when the steps say keep the claim to £5000 that means in more than one account or if this is just one, as i have a total claim of £5350 coz my joint account had £2500 and my sole the rest, do i let them off or can i claim them seperatly ? Any help would be most appretiated.
