My partner has received a letter from 1st credit demanding 8K, first thing that sprang to mind was this appears to be on a photocopied head sheet.

 

Connaughts managed to get my partner to panic into paying something 3 years ago, and after 2 small payments heard nothing till now, would i be right in thinking this just a phishing exercise for now and hold off the cca request.

 

The debt claimed is for a bank loan if this is of any extra help.

OK - first thing is, is this debt known about? You do not dispute it was yours, or your partners? You can't really use the 'prove it' letter - http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/174962-intro-much-appreciated-help.html#post1888908 - as that could be seen as avoiding the matter if you say you have 'no knowledge'. But, some people do us that as a first point of contact. :cool:

 

If the letter is addressed to your partner at their current address then the debt collection agency (DCA) have no doubt done a trace to get to that point. If you ignore them they'll just keep pestering. :evil:

 

Bet bet is tackle this now, before they get silly and start issuing default notices or whatever. Send them a CCA request, letter N in the templates library. DO NOT sign it, print the name only, and use a postal order, not a cheque. Send by recorded delivery, so you have proof they got it.

 

See if they can come up with an enforceable agreent, they only get 12+2 days to comply. If you don't hear a thing in that time, consider it that they are a useless bunch and simply ignore anything further, unless they get silly with any court proceedings - very rare. There is a letter to tell them they've failed if you would rather send that, - http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/170674-reply-cca.html#post1840880 - after the time limit runs out of course, or if they send a load of trash pretending that's all they have to.
