    • I doubt HMCTS holds any data on whether arrests by AEAs required police assistance.  They couldn't or wouldn't provide data on how many of warrants issued were successfully executed - just the number issued!  In my experience, arrest warrants whether with or without bail are [surprisingly] carried out with little or no fuss.  I think it's about how you treat people - a little respect and courtesy goes a long way. If you treat people badly they will react the same way. Occasions when police are called to assist are not common and, having undertaken or managed many thousands of these over the years, I can only recall a handful of occasions when police assistance was necessary. On one occasion, many years ago, I arrested and transported a man from Hampshire to Bristol prison on a committal warrant. It was just me and he was no problem. I didn't know the Bristol area (pre Sat Nav) and he was kind enough to provide directions - seems he knew the prison.  One young chap on another committal warrant jumped out of his back window and I had to chase him across several garden fences.  When he gave up (we were both knackered) I agreed to drive by his girlfriend's house to say farewell for a while.  I gave them a few moments and he was fine. The most difficult are breach warrants but mainly in locating the defendant as they don't want to go back to prison - can't blame them.  These were always dealt with by the police until the Access to Justice Act transferred responsibility from them to the magistrates' courts. The fact was the police did not actively pursue them and generally only executed them when they arrested someone for something else and found they had a breach warrant outstanding.  Hence the transfer of responsibility.

    • as long as aos is done by day 19 from the date on the claimform they get a total of 33 days to file a defence. (whereby the date top right on the claimform is ONE in the 33 day count) dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

But I still very conussed, I have done my letter for ''ORDER OF DIRECTIONS''..Got that bit.

 

Its this bit that is confusing me.

 

We recommend that include a request for the Judge to order a form of 'basic' disclosure from the bank. Many courts have now started to issue these, so the request is likely to have been seen by your Judge before.

 

A small note explaining its intended use would help ?. Do not make this too lengthy, just explain that it has been attached for consideration and you believe it will bring a speedy end to Litigation. State that it was devised by the Mercantile Courts for a similar case.

 

Do I need to write anything on the form for section G ''Other Information'' or do I just attach the ''Order Of Directins'' letter.........:?

Ive read 1000 times the filling in the AQ link but its the directiosn and any other info part im stuck on!

Plus think ive put the wrong amount in the claim (ive inc, all interest!)

I sent my AQ in on the 18th June along with the letter for Directions.

In the xxxxxx County Court

Claim number xxxxxxx

 

 

Between

 

Murphy - Claimant

and

Yorkshire Bank - Defendant

 

Order for Directions

 

The Claimant shall within 14 days of service of this order send to the Defendant and to the Court:

  • a) A schedule setting out each charge repayment of which is sought, showing the date, amount, and reason given (if any) for that charge being made;

  • b) Copies of any statement or other document relied upon as showing that each and every charge has been made;

  • c) A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise;

  • d) Copies of decided cases and other legal materials to be relied upon.

If the Claimant fails to comply with this order, the claim will be struck out without further order.

 

 

 

2. The Defendant shall within 14 days thereafter file and serve a response to the Claimant's schedule, stating in respect of each item claimed;

  • a) Pursuant to what contractual provision such charge was made, producing a copy of the contractual document relied upon;

  • b) Whether such charge is accepted to be a penalty, and if not why not;

  • c) If such charge is alleged to be a pre-estimate of the Defendant's loss incurred by the Claimant's actions (whether or not such action is treated as a breach of contract between the parties), all facts and matters intended to be relied upon as showing that such was a proper estimate of such loss, and all evidence to be adduced at trial as to what the true cost of dealing with the matter was;

  • d) If such charge is not alleged to be a pre-estimate of the Defendant's loss incurred by the Claimant's actions then facts and matters intended to be relied upon showing the basis upon which the charge was calculated and all evidence to be adduced at trial as to show that the charge was fair and reasonable.

  • e) Any witness statements.

  • f) Copies of decided cases and other legal materials to be relied upon.

If the Defendant fails to comply with this order, the Defence will be struck out without further order.

Should I have sent in to the Courts and Bank my Schedule of charges and copies of my Bank Statements within 14 days.

 

Tomorrow would be the last day.

He closed the account 3yrs ago because of charges.

Send the bundle without. You can always add them later if you can get them, but the chances are that YB will settle before court anyway.

I have got my PRELIMINARY HEARING court date for 30th August (what does this mean)?

 

I had already submitted my bundle before I got my Court Date, do I need to submitt any thing else?

Oops, I thinkI may have accidentally advised you incorrectly. I think I thought that the draft directions you posted earlier in the thread were actual directions from the court. Your bundle wasn't needed yet.

 

I think the preliminary hearing may be to decide on whether to accept the draft directions. Please can you post exactly what the letter from the court says so we can try and work it out.

Hi All

 

Well it has been a very long time as this is the first time I have been able to log on, I changed my computer and lost all the links I had. When I tried to log on direct from the site - would not let me. Only managed to log on as someone posted on the site and it sent me a link,,, anyway back on know.

 

My current situation is I was a week away from my Court Date, when the Courts decided to put a hold on everything....dam...:evil: My Court date was for the 30th August 2007.

 

Can anyone advise what I am to do next....has anything happened with the Courts?

Good to see you back Murphy. At the moment there still hasn't been a decision from the test case, and the latest is that it's likely to be July. Safe bet that there will then be appeals. Check your paperwork from the court to check how long your stay is for, or phone the court, but frankly I don't really think anything will happen for a while.

Unless you can convince the bank that you're suffering hardship, ie facing repossession, lost job, or similar, you're unlikely to be able to do anything. The banks are trying to appeal the OFT case so cases are still stayed I'm afraid.

Thanks, Yes I am in arrears on my Morgage due to looseing my job back in December. I have letters to prove this and talks of reposession. I dont think it is hard for me to prove I am suffering from HARDSHIP. What do I do know? Is there a template letter to send to the Court requesting they lift my STAY?. Thanks for your help. xx

To be honest the courts have rarely dealt with ANY hardship claims. Your best bet would be to write directly to the bank and just ask for the charges back.

I don't think it would hurt to attach copies of anything proving your hardship.

Hi Caro,

 

I have drafted the letter to the Bank. Would I be correct in stateing that I am willing to accept an offer WITHOUT the recent Interest applied...ie: The origanl amount submitted to Court and not add the interest which has accumulated over the past 18months? The bank sent me a check for £560 and I returned it. The amount claiming is £1,600.

Abbey National - Prelim Letter sent / LBA sent 10th August.

Capital One - Data Protection Act S.A.R - (Subject Access Request) sent - Offered £428 - Refused. Statement received Actual charges £1060. M/C ISSUED PAID IN FULL I WON

GMAC Redmption Penalty - Letter sent requesting full detailed explaination of charges/exspense and penalty charges received

Yorkshire Bank/Visa - Data Protection Act S.A.R - (Subject Access Request) sent. Visa Prelim sent £235. No statements as yet for Bank Account.
