    • Thanks. Time to move on this. 1.  You need to tweak the magnificent WS that dx suggested.  Adapt it to your case.  It should take you about half an hour (I recently wrote a WS from scratch during a train journey which wasn't optimum 😂 with lots of cross referencing and it took me an hour an half, you have one already cooked thanks to dx). 2.  We will add bits to ridicule VCS's WS - it's rich that they moan about your defence being standard when their Particulars of Claim are too and also include the rubbish about keeper/driver that has been criticised numerous times by the courts. 3.  Who wrote their WS?  Was it Mohammed Wali or Ambreen Arshad or have they got someone new? 4.  We need to see a good chunk of VCS's exhibits.  I don't get why we have to keep asking you for things rather than them being volunteered.  Isn't it obvious that we can't help you compile a decent WS if we can't see what the other side is arguing?  All their silly signs aren't needed, but any contract with the landowner is important as are all the photos of your vehicle. 5.  You've never shown us the court order which fixes the hearing date.  It should be obvious we need to see what the court has ordered.  This is the second time we've asked. 6.  VCS were using Elms Legal.  Are Elms Legal still involved? 
    • As per my post above, I believe they are attending - either themselves or a representative on their behalf, as I have not received any notice either by post/email that says otherwise
    • I actually did one better and came to a settlement, didn't cost me a penny. so great result...case closed. Many thanks for your help, much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello

 

I am hoping a Barclay Bank employee will be able to answer a question I have.

 

I applied for a cash card acct with Barclay. I just wanted a basic acct with internet banking but no overdraft or other perks... because my credit rating is extremely poor didn't thnk I would qualify for a current acct.

 

Anyway, I called and requested internet banking - told by the call centre that details would be sent via email (ie password ) in 5 days.

 

Today I called up again and told there was no record of my request. Furthermore password details are sent via post and not email. Barclay stated this has now been posted out to me.

 

Got home to find a letter stating I did not have a current account and therefore online banking is not an option on the type of acct I have. And to go to my local branch to discuss an upgrade.

 

However I MANAGED to register online this evening and I do have access to my acct.

 

I am a little confused! One minute I'm being told no online banking, yet I can logon and view my acct???

 

Any Barclay Bank employees shed any light on this query?

Hi columbo,

 

I had the misfortune of working for Barclays for 10 years, but left 2 years ago. My information on the cash card account may be out of date, but I doubt they do many updates on this type of product.

 

The account is basic and doesn't come with any extras which includes online banking. When you call the call centre you will get through to someone who has had 1 weeks training on all aspects of barclays products and services and then let loose on the general public. They will treat all accounts as standard current accounts and therefore will tell you your online banking passcode is on its way. It isn't.

 

You can log online to view your account and see past statements, but you cannot make any transactions online. If this is all you need to do then thats fine. Unfortunately you won't be able to conduct bill payments or set up standing orders.

 

Interestingly, direct debits are not supposed to be available on the cash card account either. This does not prevent them being set up or used on a regular basis. Every so often a jobsworth admin may see some dd's set up on one of these accounts and summarily cancel them all without notice because "they are not allowed".
