      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi guys,

 

just a wee update, i went down to my sheriff court today (at last) i re-read all my paperwork and took it down and a helpful woman in the office looked over it, checked it and told me that it would take about 6-8 weeks.

 

i will keep you all updated as i go along

hi guys i have received a letter from the bank this morning offering me £868.35 inc court fees and saying this will settle my claim. They are asking me to write to the court and tell them the claim is settled and that they will do the same. Can anyone please help me. is this the final or do i accept the money but let them know that i want the rest. if i let them know i want the rest how do i go about it.

 

any help would be appreciated.

I just wrote a short note to the court with sm cl number sayng

 

 

"With regards to the Summons lodged by myself v Bank of Scotland, I wish for the action to be dismissed as the matter has been settled in full by the bank when they refunded the amount of the claim to myself on 8/8/06."

 

 

Sent another lba to bank

 

 

"Thank you for refunding my charges from small claim number SA 123/45. I have contacted the court to dismiss proceedings.

I am enclosing a revised copy of all the other charges, totaling £1234 that you have imposed on my account in the past 5 years and will give another 7 days to respond positively to my demand to repay all unlawful charges to my account.

Without further notice if I don’t hear a response or if you don’t respond positively then I will commence proceedings in the Scottish Small Claims Court on the "insert date."

Yours sincerely"

Hi Dawn,

 

Have they offered you the full amount you are claiming? If so then it's the end and accept and settle.

If however it's not the full amount, you can just write back and say you are not prepared to settle for anythig except the fullamount. Don't write to the court and cancel the claim if you haven't got all the money you are claiming.

If your going to continue to claim in Scotland I think the best idea is to now wait till funds clear from this claim and then send an LBA referring to your earlier claim (so they know your serious!) giving them 7 days to give you the rest of the money owed. Then in 7 days if they haven't complied then just do what you've just done at court all over again! Thats my plan though I may go through English system for rest of my money!

NIGHTMARE,

 

i thought that i would have a purse full of money this weekend but when checking the bank i have £42.50 left out of the over £800.00, they have paid off my overdraft (£300.0) fair enough, but they have transferred £500.00 to another account my account number 2 with them, can they transfer money without my consent or does anyone know how i can get my £500.00 back.

hi guys,

 

long time no hear i haven't been on the site for ages, i have been really busy and have been totally pratted so i could not take the banks to court for the time being until i had cash again, that was until today, i read that if you were unemployed then you could be exempt from paying the 39.00 court fees so i phoned the court and asked and they confirmed that if you were unemployed then you were exempt.

 

i am so happy that i can now proceed with the rest and carry on from where i finished, i will be at court tomorrow morning and there is a form i fill in when i go down. so anyone out there struggling for cash just now this might help them.

 

Can anyone please advise me i have 3 account with BOS and 2 with RBS is it safe to fill out papers for BOS and RBS together or will they class this as one claim and i will loose out on the small claims also would it effect me if i went for 3 accounts.

i went down to the court today and filed my next installment only this time i filed a claim against the rbs aswell as the bos.

 

i hope that all goes well and that i have a nice wee earner for xmas (not likely) but would be nice

hiya guys

 

i need some advice quickly please, i have received a letter from MR Tommy McLean this morning offering me the sum of $825.00 in full settlement. There is a piece of paper that i sign and post away in a prepaid envelope.

 

The thing is the RBS owe me over 3Grand in this account. Do i write them a letter acepting the $825.00 because i am desperate for the cash with it being near xmas and let them know that i am going for the total or what do i do because i do not want to loose out on this.

 

If i accept the £825.00 is this all i will get or will i get the rest and also if i do let them know that i will be going for the total amount do they not give me the $825.00 and i have to hold on until court or what.

thanks polly, i hope i don't have that long to wait, have you any ideas? i filed a small claims against the RBS for the same account yesterday so mr mclean will no have received that yet, do you think that when he receives that he will realise i mean business and pay out at least something

Hi guys,

 

Just giving you all a wee update on my ongoing sagas well, i thought that i would have heard from the RBS regarding my e-mail and letter that i posted on Tuesday regarding my offer of part payment.

 

I also received my date for court for the 2 banks, the cases are held on the same day the return date is 12th January 2007 and the calling date is the 17th January 2007, i was really really hoping for a wee something for xmas but a doubt that i will just have too wait until January. Okt well at least i know when my court date is.
