hi im new to this forum have been reading through but its all a bit too much info for me to grasp!!

i had a lyods cc and i recieved a f & f settlemnt fee paid it but he ccj still shows as not being paid i was under the impression once i paid they would remove it??

aldo i have a default from next i never signed a credit agrement but bailiffs came round so i was bullied into paying them again

hte debt is satisfied but this is on my file still are these supposed to stay n my file??

avon and 02 have also placed a ccj on my file but i never signed any agreement with them how do i go about removing these? the 02 and avon i still owe money to but llyods and next i have paid

here are some basics to digest.

 

 

  • If you have failed to pay one of your creditors the amount they claim you owe, they will usually put into action a series of measures to attempt to recover the debt.
  • This process will generally involve issuing a series of letters to remind you of your obligations, if these do not produce payment of the account, then the next step will involve passing your file to a firm of debt collectors.
  • The debt collection agency will issue a stern warning that if you have not settled your indebtedness within ten days or so, then your account will be referred to county court for recovery and costs.
  • If the debt remains unpaid a county court summons will be issued to you, and you have the opportunity to defend the action, either in writing, or by personal attendance at the hearing.
  • If there is no dispute, then the court will award judgement against you.
  • A debtor will usually have 28 days in which to settle the amount, before the action is recorded on the Register as a County Court Judgement.
  • The County Court Judgement will remain on your credit file for 6 years.
  • If you settle the debt before the end of the 6 year term registration period, the entry will still remain on the Register, however, it is possible to have the County Court Judgement noted as being "Satisfied", by providing a certificate of satisfaction from the court for a fee.

 

You are entitled to make a notice of correction on your credit files-its a good idea to get copies of these,its only 2.00 and quite quick to get (usually just a few days)

 

As regards the issues you dont agree with regarding Next and O2-you should consider doing SARs to get the info which should allow you to prepare a defence to challenge it.

Have a look in the index in bank templates.

You will find the letter to send.

The fee is 10.00 and send it to their Head office (their registered office should be on some of the communications you have from Next)

 

When you say Baliffs came round-do you mean debt collectors ?

Can you say who this firm was?

What was the money you paid them for ? do you have any paperwork that breaks the figures down that was paid-to show what it was for ?

right it went origionally from nxt to robinson and way then to northampton court from then the court bailiffs came down from the local essex office to collect the full payment i dont have any of the breakdown paperwork is this possible or has it gonetoo far innto the system?

Ok.

CCJs are very difficult to remove or overturn unless there are exeptional circumstances ie was wrong person/name etc.

Are you saying that you had ALREADY paid the Next before the CCJ was passed ?
