So after a 14 day investigation with p2g i had a live chat with them yesterday ( 8th June) who said they didnt know where the parcel was but closed the case as i didnt take out their protectiove insurance.  So now at 07.33 on the 9th of june i was repling to this thread with all the relivent information to start a claim and i check the tracking of the 'Lost' parcel for specific dates to find the tracking has updated and the parcel is now at the recipients local depot  ? which is annoying because ive already refunded the buyer as i didnt want any negative feedback as it was an ebay listing and id want a refund if i was in his postion. So i posted the parcel with Evri on the 20/5/24  The delivery date was missed due to it being sent to the wrong depot and a case was opened on the 25/5/24 14 Investigation failed to locate the item in Evri's system and case closed on the 8/6/24 and now the tracking has updated on the 8th saying its at the recipients depot so is likey to receive it in the next few days .... Typical.  Oh well nevermind , thanks everyone

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What about PPI if one cannot claim Job Seeker Allowance

I've got a personal loan in 2006 with HBOS with PPI added. Then topped up the loan in 2007 again with PPI.

 

Recently one of my friends (Non UK Citizen), who had a loan with PPI lost his job and tried to claim for his repayments based on the Unemployment from HSBC. Then he was advised to register at the Job Centre and for Job Seeker Allowance. But he is not entitled for the Job Seeker allowance as he is in the UK on a Visa with "No Recourse to Public Funds" endorsed on the Visa. So he hasn't registered for the Job Seekers allowance and hence his claim is turned down.

 

Now I have the PPI again with the same clause in my Visa, which I've paid for the PPI over 2 years for HBOS.

 

Could anyone let me know has this been the case for you if you have the similar status in the UK?

 

Also, what if I want to stop the PPI now and get the money back I've paid so far?

 

I understand there are many "No Win No Fee" places to work on behalf of you to claim the money you paid. But wonder what should I do first?

I know for a fact that this is Misselling because he was ineligible to claim. Was he made aware that he could not claim for unemployment? I doubt it.

I had a call to the Bank this morning.

 

PPI Advisor straight away agreed that the PPI was missold given that I cannot claim "Job Seekers' Allowance". So she said my loan has to be re-keyed without PPI. This will be as a new loan without the PPI.

 

I presume, that everything I've paid towards the PPI will put forward for the capital repayments. But not sure whether I'll have to take a loan at a higher rate. Now the personal loans usually around 10% APR, but I had it initially for 7.9% APR. Eitherway I am losing my money, unless they offered me the same rate.

 

They said they will contact me within 4 weeks.

 

Any expert advise, what should I do next?

I would decline that. If it is missold they have to put you in a position that you were in if you had not taken the PPI out. A new loan?? How about a refund of all premiums and that the payments are EXACTLY the same amount as if you had not had the PPI in the first place. Same term ie if it was over 5 years then it is 5 years minus current payments to date. And refund of premiums taken from you up to that point plus interest(confirm whether it is a single premium or not).

Happy Happy !

 

My Bank has refunded all the money I paid for the PPI with Interest.

 

My monthly loan payment has decreased by just over £100 a month.

 

So folks, if you have "No Recourse to Public Funds" in your Visa and have a PPI with your Personal Loan, Credit Card, etc Better you call your Bank and inquire.

 

Not sure about Mortgages, how that works, but one of the Mortgage Brokers I spoke to at Countrywide Residential, showed me a Booklet, which states "You must be a Permanent Resident to get the PPI Benefits". He was the only one who had such a written record, not even my Bank :)

Did they re-finance the loan at the same rate as the first.
