    • Another update. Got a letter from Mortimer Clarke. It says that they will continue court proceedings but that I should phone them and discuss 'my debt'. No mention of the items that I requested in my LBC form. No evidence of the phantom payment either. Seems like they are just contributing to global deforestation... Shall I continue to ignore?
    • I see 2p farage has been shamed into running Hes chosen Clacton - Carswells old seat -  high percentage over 60 + white with poor folk living in beech huts - so likely no vote = so probably his best chance .. .. which will make it even more amusing when he fails Given the 'crowd that didnt turn out for 3p Lee and 2p Farage (depreciation) in Andersons home seat, I'm looking forward to some belly laughs

    • Thank you again Dave, this is all really useful. I booked directly with Bookin.com and had messages from the host. I'll look at this further tomorrow and also contact the host again via the Booking.com website. I wonder how much experience the host has if they don't understand the website way to cancel a booking. The message I had from the host was asking if I'd heard from Booking.com so it sounds as if they don't know what process to follow. HB
    • After 4 weeks of being told my parcel has been misplaced they are now telling me it was damaged so they disposed of it. They did this without my permission or take any fotos of evidence. I have also been informed there will be no compensation as it was a non compensated item. Who can please help me and how do I sue

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In the past 6 months or so , i have twice attempted to purchase shares

via the Equiniti (formerly LloydsTSB ) share dealing service.

 

On each occasion i have used my H.S.B.C maestro debit card.

 

The transaction is fine up to the point where i am prompted to press the o.k. button in pop up window which will direct me to the maestro card MasterCard secure code.

upon pressing this button the page does not load but reverts back to the previous page with an error message " card error" 1827

 

The first occasion this happened back in Feb 2008 i was repeatedly

bounced back & forth by both Equiniti & H.S.B.C.

 

This has eventually led to an official complaint to the financial ombudsman

against Equiniti , whom i blame for the problems i encountered.

They have been unable to provide me with any reason to believe that it is anything other than a technical problem at their site.

This case has yet to be decided upon by the F. O.

 

Today for the first occasion since Feb. i have again attempted to buy shares via the Equiniti share dealing service.

the problems that i encountered above were exactly the same as 6 months ago,nothing had altered whatsoever.

 

Yet again Equiniti refuse to that it is a problem with their site, & continue to blame the card provider,H.S.B.C.

 

They (H.S.B.C. )again continue to assure me that there are no problems with my card & that it is most likely a technical issue with the Equiniti web site.

 

I would like to know if anyone else has experienced similar problems

either in dealing with Equiniti or with their H.S.B.C maestro debit cards.

(all other transactions with my card, albeit for smaller amounts, always go through fine)

 

If there are any technical boffins out there to explain if these sort of problem ARE indeed down to the web site (Equiniti) or whether

MasterCard or card provider (H.S.B.C.) may in some way be responsible.

Hiya Blue and welcome to the HSBC forum :)

 

I sometimes have similar problems with my Visa Electron card. There doesn't seem any rhyme or reason why this happens or who it happens with, some transactions work like clockwork and some just stick no matter what you do.

 

The only thing I can suggest is ask HSBC about different types of card or if its really a problem to you change banks to one with a reliable card.
