    • retailer said they'd speak to dpd on Tuesday. I don't want to screw the retailer because they were doing me a favour by fixing it for free  I hope dpd will refund them so they don't lose out. Will keep you guys posted. 
    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were. Not to mention, delivery instructions are supposed to override actual customer's address which is why they asked for instructions I thought.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx  
    • There are a number of reasons why you may not have been issued a notice in the post within 14 days. If you were stopped by the police it may have been given verbally.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello Everyone, Joined this site on a recommendation of a friend as I am in debt and trying to tackle my problems.

 

In Nov 2006 I took out a loan with Welcome Finance for £2000,(24 months @ £132) then in april 2007 I decided to take out an other loan for £900. I thought this would be a 2nd loan but now appears to be combined. They said my new combined payments would be £217 for 36 months. I wrote and requested a CCA which I received yesterday. I think everything is in order but am not sure because i am quite new to this.

 

It is only through reading through the CCA that I have realised they have combined the loans as the agreement says 'Amount of Credit to Settle Loan £1965.25' The CCA also shows PPI having been added which was never on the 1st loan. I have now sent a letter to claim back PPI as I was never asked about any existing conditions or advised of any potential exclusions and when it came to me needing to claim they wouldn't cover me.

 

I suppose I am just posting this for any advice really to see if there is anything I can do.

What Date did you take out the loan? exact date

Hope somebody can please help. Apologies if I sound as though I am repeating myself! Tried to add more detail.

 

In November 2006 I took out a loan with Welcome Finance for £2000 (£132 at 24 months) On 19th April 2007 I asked to borrow another £900 - an amount which I thought would be a seperate loan. The 2nd loan had PPI on which I am now trying to claim back as I believe I was mis sold on medical grounds. My new combined monthly totals were £217 at 36 months.

 

Having recently requested a CCA agreement I have looked closer and the £900 loan also consolidated the first loan so has seen me taking out a loan to pay off £2000 + interest + £900 + PPI + interest again. So I am paying 2 lots of interest on the first amount of £2000.

 

Having spoken to somebody at National Debtline they have said although Welcome can argue that they provided copies of my agreement when I took the 2nd loan out I can retaliate with if they mis sold PPI then maybe they mis sold the terms of the 2nd loan as well. They have advised I write a letter of complaint and also mention forwarding my complaint to the FOS.

 

Can I please point out that although I did receive a copy of my CCA when taking out the loan soon after I was hit by numerous health problems which saw me unable to deal with my debts and it is only now that I am getting around to tackling them.

 

Can I also point out I am not trying to get out of not paying this loan off but to get the amount owed reduced slightly by hopefully having the 2nd amount of interest on the £2000 and the PPI removed.

 

However I am not very good at writing letters and would be grateful if somebody could help me out or offer any advice.
