Hi, I've already got a thread but I thought I would start this one with a proper title.

 

I'm going to send the first letter to NatWest tomorrow to ask for my charges back (a total of £76). The thing is I have already accepted a £19 refund for one of the charges, bringing the total to £57 - will this affect me claiming back this amount (£57)?

 

It gets a little more complicated I'm afraid! The first charge (which is the one I accepted the refund for) was taken from me because of an unpaid direct debit. However, I cancelled the direct debit on the 1st of July - I was charged for it not being paid on the 3rd of July - work that one out! Because of this, Natwest said I will have to meet with somebody at my local branch who will arrange for me to claim this charge back from the company. I'm a little confused though - isn't it Natwest that charged me so how can I get the company to claim this back?

 

Any information would be appreciated :)

As 1st fell on a Saturday the DD would have shown as going out on the Monday part of the same working day so technically it had already been returned. You could argue that the Bank told you that it was cancelled and didn't advise you it had been returned, yes we can see the outcome. Don't go through the company. The remaining £19 is still fair game though and probably a quick settlement.

Quick question: I am a student with a £1,400 overdraft. If they close my account then I will be pretty stuck as to what I can do.

 

What are the chances of them demanding my overdraft back?

Quick update:

 

I've just got back from the bank. I spoke to a lovely woman who was very polite and listened to me, but said that she didn't know of any cases where charges have been successfully claimed back when there hasn't been a bank error. She spoke to the manager who popped her head round the door and told me she would send the letter for me. I told her, nicely, that I would rather send it so I know its all sorted. She wouldn't let me use a Natwest envolope :D

 

So, letter sent - 14 days and counting :D

Got a reply from NatWest this morning from Stuart Hidley saying sod off basically. However, he does say:

 

"In your letter you claim that we have acted as your fiduciary but I am unsure of the basis of your contention. This doesn't form a part of normal banker/ customer relationship."

 

It worries me that he is taking about my relationship with the bank; another thread says that Natwest claimed it had broken down so closed his account - is this a standard thing to say or do you think he is implying they will close my account?

Hi - some advice would be very much appreciated.

 

Without going into too much detail; a family member has become ill and so it isn't ideal for me to start proceedings at this point (I'm currently not at home and won't be able to get back for some time).

 

Should I write to NatWest and tell them that my action will be delayed (possibly up to two weeks) or shall I just leave it and start when I'm ready? Telling them seems like the courteous thing to do and also I don't want them to think I have given up and dropped the issue. On the other hand I don't want them to think I'm giving them a second change.

 

So any advice would be very much appreciated.

No problem, Northampton court handles all MCOL claims initially, then later they send them out to a court local to you, don`t worry, they`ll tell you.

Yes from viewing other posts, this is quite normal, they show as defending and then pay up, i have yet to see that they are actually going to court with this.
