Hi all,

 

I'm a few months into my relationship with CAG BUT alas have been on here for another purpose NOT to reclaim bank charges - until now !!!

 

Anyway I now wish to reclaim my charges from Natwest and am somewhat confused by a couple of things.

 

Firstly I've SAR'ed them and now received my 6 years worth of statements. I've already meticulously gone through them all and listed all the charges that this site tells me I can reclaim - I have ommitted all the monthly Advantage Gold Fee's, as instructed. I'm confident my list is accurate !

 

I've then downloaded a template claim form from here - the England complex charges one ! This is where I'm now stuck and would be really grateful of some help:

 

I've filled in the left hand section - date, the details of penalty and the charge amount. No priblems !

 

I've now moved accross to the right hand section and am struggling a little - I've filled in the interest date (as taken from my statements for the last day of each period) and the account balance that corresponds with this date BUT I'm 'snookered' with the final column - the one headed "Interest Charged".

 

I can't find any mention, on my statements, of the actual rates of interest charged, on my Advantage Gold account ? All of my claim is within the period July 2002 and March 2006 - can anyone please, please help me to locate the interest rates for this period ?

 

Once I have the above information do I enter the rate as a monthly OR yearly figure in the "Interest Charged" column ?

 

Finally what do I enter in the "Interst Free Overdraft" column - I had no element of interest free (I don't think, anyway ?) so do I just enter 0 all the way down this ?

 

Many, many thanks and any advise from you seasoned Natwest claimers would be very, very much appreciated.

PS Whats the latest on the 'stay' regarding the claiming of charges - do I hold fire OR get my claim in ASAP ? Thanks again.

Hi RB

 

"Interest charged" is just the amount of interest read off the statement at the interest date - the spreadsheet doesn't use the interest rate but estimates the proportion of the interest charged that is attributable to bank charges rather than your legitimate overdraft.

 

In the "Interest Free" column just put £0.

 

No news on the OFT case yet. Start your claim off though then you will be in the "queue"

Ahhhhh............. thanks Steven.

 

So I've done the worst bit then - the reest is actually quite simple !

 

So when I send this off I guess I send the spreadsheet and a covering letter ? The 3rd sheet, showing the 8% interest rate, is just in case of a later court case then, is it ?

 

Can you point me in the right direction fo a possible template letter ?

 

Do I send this to my local branch or to a central address ?

Hi All,

 

Thanks for all advise, to date.

 

Sent my 6 years charges claim, to Natwest, and I've now received their reply (as expected) basically telling me about the current test case and needless to say whilst the stay remains in place my claim will simply be held pending the result !

 

In my letter, however, I also added:

 

"I request that you deal with my case now rather than once the test case has ended as I rely, partly, on benefits for my income and the Social Security Administration Act 1992 says that charges should not be taken from income related benefits.

I request that you deal with my case now rather than once the test case has ended as I am currently experiencing financial difficulties due to disability and the FSA waiver states that you should continue to deal with hardship cases."

Can anyone please offer any guidance / a possible template for my reply OR is it really now just a case of sit and wait ? Does the above make any difference ?

Thanks Michael - so, to confirm, I do nothing at all except file my paperwork and ?

 

Is this the same with all courts staying or are some still hearing cases ?

 

Whats the expected timescale now ?
