    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right to cut a long story short my wife and i have split leaving me alone in the house. My weekly income is now aound £40 a week ( usual JSA for a single person less what they take for a budgeting loan debt ). No doubt it will drop furthur as we had 3 kids and another on the way so im gonna get hit with maintainance. she left as financial problems pretty much tore us apart.

 

Anyway, my current brighthouse bill is £96 a week, all in my name, i can see why my wife got upset as that was almost half out weekly income :(

 

We pay for : Fridge freezer, 2 laptops, Xbox360 elite, mobile phone, dvd recorder, 3 computer monitors, and a wii console

 

Now the problem, it would be easy to return all the stuff but i cant do it. When weve been struggling ive been forced to sell stuff just so we can eat. I know im stupid for doing it. IThe only thing i actually have of thiers is the fridge freezer. No so far ive never missed a payment and paid loads of agreements off in the past, many of them early.

 

The next problem is we moved last year and i really dont think they have chnaged my address on thier system. Im certain i told them but thought nothing of it until i checked my latest agreement ( the xbox which i signed for last month ) and they still have my old address on the agreement.

 

What can i do, im so scared and feel so helpless and stupid. i sold these things to please my wife ( she has a lot of the cash as well but she could just deny it )

 

Im due on saturday and i just cant do it. I dont want to tell them ive moved but no doubt they would find me anyway.

 

Whats going to happen to me, ive been stupid, really stupid

 

And to top it all i had a mini stroke last week :(

Sorry to hear about your problems.

 

There is no practical advice I can offer unfortunately, as you have acted very dishonestly. If you have sold items belonging to Brighthouse then that is plain and simple theft. Sorry.

 

If you were hoping that the consumer action group forums would assist you, and help you further in what is quite clearly a serious deception, then I think you have come to the wrong place.

 

This forum is designed to help people having problems with Brighthouse and not to help people break the law.

I would ring the store and tell them what you have done i wouldnt put it off

you done they crime now face the music

but on a lighter note most you would get is comuninty service and a fine if you have been that short of cash that you had to sell the stuff to servive then so be it i can understand your plight

what i cannot understand is that if your are in that much hardship why get a xbox last month knowing you cant afford it

like i say time to face the music

Yep. I thought the exact same thing. (Infact, I'm not entirely convinced the whole thing isn't just a wind up!)

 

Without wanting to judge too harshly, it seems to me that much of your hardship is your own doing. Let's be honest here, BrightHouse didn't hold you at gunpoint and MAKE you order laptops, game consoles, mobile phones and DVD recorders, did they?

 

Near to where I live there is a Brighthouse store with a Cash Coverters right next door. You will often see people walk out of Brighthouse with, say, the latest new phone or stereo, then march straight into Cash Converters and flog it!

 

They usually end up before the judge within a few weeks... :confused:

I'm afraid Lefty and DK are right. You need to tell the Manager at BH what you have done. The longer you leave it, the worse it will become.

 

On another tack - your situation generally is quite grave. You may find useful information in the general debt forum on this site and help with benefits, etc on the benefits and tax forum.

Instead of using Brighthouse why not use your local Freecycle group - there have been six fridge freezers going in the last two days on mine, plus numerous sofas, dvd players, phones etc. I think it depends on the are you are in as to what quality the goods are in but it is a good stopgap.

 

My sister used freecycle when her washing machine packed up, got one from there and put the money each week to one side, six months later she got a newer machine and freecycled the other machine.

This brings back memories too!

 

I remember on many occasions walking past the Cash Converters near to branches I worked in and seeing the pile of DVD's in the window that STILL had the BH asset number sticker on the back!!

 

I remember a team of North African guys who were going through the stores in the Birmingham area in 2002 that were signing up for TV's and stuff, 1 in each store. They would use each other as references, then get the TV delivered to a property they were using for the day and then dispappear, sell the TV and cash in!

 

I almost got done in my store, but the manager from the city centre store noticed something wrong, and called me as he recognised a name on a reference. As I dug a little deeper, I discovered that we were due a delivery of a TV to one of these guys that morning. At the same time, the landlady of the house called us and said that we need to look out as BH has now delivered 3 TV's in 3 days to this address!

 

My AR's were running debt in another area of Birmingham and in Saturday lunchtime traffic, would have taken them 30 minutes to get there. So I ran out of the back door into my own car, on my own and sped there in 10 minutes. The front door was open, and the hall led into a lounge with nothing in it except the TV and a weedy little African guy texting his mates.

 

I just said "Hi", picked up the TV, still in its box, and left. I don't know who was more shocked, him or me, but on reflection, it was very frightening.

 

Needless to say, I called the landlady and thanked her profusely, promised a bottle of something nice to my fellow manager, then spoke to my area manager to ask the CSC what the hell they were doing deliveing 3 TV's to the same address in 3 days, without asking questions!

THE WEEDY AFRICAN GUY MIGHT NOT OF HAD A PHONE IN HIS HAND IT COULD OF BEEN SOMETHING ELSE!

No I wasn't insured. Yes the African guy could have had something else, that was the whole "unknown" of the situation.

 

And on reflection, no it wasn't worth risking my life for. But the very way in which BH targets its stores and bullies the staff into getting the job done, means you don't think about that at the time. And with average police response times, it's a no brainer really!

 

Your final comment, just does not deserve a reply I'm afraid!
