    • What was your estimate of the depreciation in value? Frankly it is such a vague measure of your loss then I think that it was a mistake for you to suggest that. What is the value of a free service? What did you actually lose by not having it with you at the time? Where do you normally keep it? Do you think it is now fully repaired or are there some outstanding issues? Have you used it or parked it up in the rain?

    • Hi all,  Many moons ago (2012)  I had a Virgin credit card (issued by MBNA) that defaulted.  They did provide a valid CCA so I was advised by the good folks on CAG to make small payments to keep them quiet - I set up a standing order to pay them £5 a month, and it's been that way ever since.  The debt has been sold on a million times, but £5 is nothing so I've paid no attention to it.  Anyway, I received a letter from Capquest (who must be the current owners of the debt) back in March asking me to contact them to discuss a suitable repayment option, and the account will now be managed by Resolvecall.  Now £5 a month IS a suitable repayment option so I ignored their letter.  A few days/weeks later, I received a letter from Resolvecall, acting for Capquest wanting me to contact them and threatening a home visit if I ignored their letter.  Obviously I DID ignore their letter, and last week a lady knocked on the door (unanswered) and put a card through asking me to contact Resolvecall. Interestingly, their letter said if I didn't reply within 7 days from the date of the letter, and...you guessed it, there was no date on the letter! Out of curiosity, I logged in to Resolvecall's account, and it shows my two most recent £5 payments, so they ARE receiving my money but clearly want more - which they're not getting.  Now - do I play silly b*ggers with them, and ask them to provide the true copy of the CCA to see if they can come up with the goods? Do I just ignore them and carry on paying my £5? Do I stop paying altogether?  I know the case isn't SB as I've been paying regularly, but not sure how to play going forward?  Any suggestions gang?  Thanks you!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've addressed it to Penny Berryman, is this correct? We're going to post them tomorrow and send by recorded delivery so they should get it on Monday so I put Monday's date on them, is this also ok?

 

I was amazed when I read about this situation earlier this afternoon and indeed have spent most of this afternoon and evening reading about it.

 

Lloydstsb have generally not been helpful nor supportive to me, particularly during my divorce several years ago and also recently when my card was stolen and they refused to reimburse the stolen money because I knew who the thief was and tried to recover the money myself before involving them, so I feel that they owe me.

 

One thing that does worry me is that because of their mismanagement of my money, on many occasions they left me unable to pay other credit card bills and a loan that I had and so my credit rating is wrecked. If they decide to close my account, which from what I've read is a distinct possibility - does anyone know of a kind bank which will let me have a current account with direct debits/standing orders and a debit card?

Hello and welcome. Try Natwest Step Account. As a Bank they are as bad as Lloyds but I suppose they are all the same.

Emailed the dpa letter instead, received standard reply from "Keith Boden"

 

Also applied for step accounts and recieved the paperwork today so hopefully that will all go thru ok and we'll have back up accounts ready soon.

 

Just have to wait n see what happens next.

Read the FAQs. They can charge a maximum of £10 and have 40 days from receipt of your payment.

 

Can you scan your letter and email it to [email protected]?

well........... sorry I've not been here sooner - got all my statements and gone through them and the gits owe me £1264!!!

 

They also sent me a list of I presume manual interventions, they seem a bit gobbledegook to me tho :s

 

Just typed and printed off the letter before action and going to send it to customer care in the morning :D B/F has lost his nerve after speaking to his lawyer father about it, so it's just me now :(

 

Also got my parachute account in place.. natwest step acct.

 

Richard I will scan the letters as soon I get my scanner working (something wrong with the usb thingy)

Please, please PLEASE give this forum address to bf's father, it's unacceptable that as a lawyer, he should be able to put people off reclaiming charges unlawfully levied, he obviously is in serious need of re-education (Chairwoman Mao, me :D ). Even more worrying is that if he can put off your bf, who knows who else too?

 

Or maybe, when you get your money back, your bf will have more faith in you than in Daddy? :D

hehe.. daddy's a nice man, just a bit old fashioned. When b/f saw the letter before action I had written I could see he was mulling it over in his head so we shall see :D

 

He is going to give daddy the link to here next time he goes to visit them :D

 

Forgot to say.. I've also contacted the LTSB insurance dept about getting a refund on my mis-sold PPI.. chap I spoke to advised on the best way to go about it and also wished me luck :D He wasn't bothered as he's leaving soon to take on a whole new career route (ended up having a good old chat with him (minor flirting even..), and got his full name and ext hehehe)

 

Wondering now if he'd be willing to say something aobut the penalty charges although I'm not sure he's in the right dept cos he's in the insurance bit?

Whoaaaaaa!! is this a record? I handed the letter in to my branch at 4.30ish on monday afternoon and got a reply this morning.. that's about 36 hours turnaround, hehe.

 

It was just the standard.. it's your own fault blah blah if you dont like it go elsewhere letter with a leaflet enclosed.

 

Time for the letter before action one now.. something tells me they won't be as fast to reply to that one ;)

ooh errrrrrrr the 14 days is up tomorrow.........then I guess it's off to court we go :s

 

 

On a positive note however, they have agreed to refund me the PPI I had on a loan without protesting at all :D they've said they'll credit my account within 21 days of receving my acceptance. BTW... can someone explain what ex gratia means pls?

This seems interesting.. am just on the money claim site.. starting to fill in the particulars and was going to use the customer care address, is this correct? anyway....... I put it in and clicked on look up and there are two solicitor firms listed at that address.. seems a bit weird to me, dunno bout anyone else, lol

I've not received any statements since march on this account, which seems a bit odd and I know I went over my overdraft limit a couple of times in March/April so I just called their phone banking service and asked for the most recent charges so I can put the most up to date figures into the moneyclaim site.. how bizarre that now the operatives don't have access to that information and I was advised to call the account management dept tomorrow.

 

Just seems wierd to me that all the other times I've called up and asked to know the most recent charges they've always been able to provide them there and then :-/
