Hi

First response from Abbey re my Cahoot flexible loan - a 9 page letter which includes a 14 point questionnaire asking intrusive questions from marital status, income and outgoings at the time I took out the policy to details of other policies including assets. Also asking for a 'current insurance schedule' ?

 

I don't see what any of this has to do with my claim, they had my full details at the time - 2001 - they also ask questions regarding the reasons for taking out the policy, seeing as I had no knowledge of the policy being sold to me I can't answer any of it !

 

I'm thinking that I should just return the questionaire unanswered with template letter 2, adding the points that they have all this information.

 

What have other Abbey customers done ?

Advice appreciated

Hello Frugal jo,

 

They perhaps are looking to obtain information to help them try and locate some info about you. These institutions can be careless with data.:eek:

 

When they ask for "current insurance shedule" are they looking to see if you have taken out PPI and whether you know about it?

 

I am not with Abbey but on a light hearted note.

 

I would return the questionnaire with a covering letter saying you cannot give them the data as they did not include the statutory fee of £10.00 when they requested the data.

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

Been doing some searching, seems a few companies are throwing the questionnaire into the mix. I think it's a trick question so to speak.

The questions are designed to trip me up and from what I've read I'm under no legal obligation to fill it in.

 

Everything they ask they have on file, I will just send a confirmation of receipt covering letter to advise that they have required information.

I have received the same questionaire and am also of the belief that they are hoping to trip me up with this form so I also plan to send them back a letter thanking them for the questionaire but pointing out that they will have all the information already within their records and rather than me fill out a complicated form I require them to check their records!

 

Really don't see why I should waste more of my time filling in their forms!

 

Has anyone had any response after not filling in the questionaire?

I have good news to report. Upon receiving the questionaire I sent the following letter:

 

Thank you for your letter dated 13th March regarding your complaints procedure, however there are several points I feel I need to raise regarding the questionnaire you enclosed

 

Your questions regarding my occupation, personal circumstances and earnings at the time I took out the loan; I furnished you with this detailed information at the time and you have it all on record.

 

Your questions about the sale of the policy –- my complaint is about the mis-selling of this policy, I was not given the correct information when the policy was sold to me as your salesperson did not tell me that the policy was optional, so I am therefore unable to answer these questions.

 

Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

Received a letter middle of April confirming I had been mis-sold and am receiving a full refund by cheque.

Oh that is good news. Did you manage to get interest as well (if so did you get contractual interest?). I believe I should get the contractual interest on this back as they charged it to me but have read around and seems they are willing to fight it all the way if you include contractual so I'm not sure what to do!

Good news.

I recived full offer today of a refund for miss-sold PPI on my cahoot credit card. After sending 1st letter I received the questionaire but returned it blank with the following letter after reading the posts on here. Many thanks to all who posted info/advice.

This policy would never have benefited me in anyway and I feel I have already highlighted my complaint clearly in my first letter dated 1st February 2009 a copy of which is enclosed. I have therefore returned the questionnaire incomplete.

My offer arrived today, within a week of returning the qustionaire. It's almost as if they had worked out how much they were going to offer me and they waited to see what I would do.

I too was very successful with the Abbey recently regarding a mis-sold ppi complaint for loans from 1996, 1997 and 1999.

 

Only sent the prelim, then the rather bias appropriatly worded questionnaire, which I refused to fill in, with a covering letter explaining my reasons and within a week they made me an offer of a full refund plus 8% interest from 1996,1997 and 1999.

 

I was rather shocked that they did not even argue a little bit as the loans were well over the limitation act.

 

Possibily they know what they have done in not treating their customers fairly and are just settling before everybody reports them and the consumer watchdog (FSA) goes in snarling to investigate and fine them millions:D

 

My advice to any ABBEY customers, check out if they applied ppi regardless of how long ago and get after them for it:D

after a rather snotty person on the phone to cahoot who was totally unhelpfull i went straight to 2nd level complaints and today received an offer of £8794.....

 

 

Good result no questionaire was sent just a straight offer after making two phone calls

 

 

offer was from Santander??
