    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sunday afternoon I was pulled over by the police for a random roadside check. I thought nothing of this as I know everything is above board. Sure enough, tax, mot, insurance and breathalyser tests were fine. Then it comes over the radio that my licence was 'revoked' by the DVLA in 2002.

The police immediately seized the car for driving with invalid insurance, pointed me towards the train station and that was that.

 

This morning I phoned the DVLA, who informed me I picked up 3 points for speeding in June 2002 but never had the points added to my licence. They are unable to give me any more details on the speeding fine as they have expired on their system. 3 letters were sent to my address but were never responded to.

 

Now I swear I never received these 3 letters, and I certainly wouldn't ignore a 'licence revoked' letter, but I guess this is going to be impossible to prove.

 

DVLA inform me I need to apply for a new licence with a D1 form from the post office, and this could take up to 15 working days. Problem is, my vehicle will be disposed of in 14 days!

 

So my questions are:

 

a) Do I have a chance of getting my vehicle back? If the licence takes more than 14 days will the police be sympathetic and hold on to it for me?

 

b) What kind of fine and points am I looking at for driving without a licence and therefore insurance?

 

c) How can it be that for the last 6 years I have taxed and insured cars, and nobody has ever told me my licence was invalid?

 

As you can imagine, this is causing me immense stress, as I now can't get to work, and my easter holiday plans have been ruined. I could possibly lose my job over this, something which I can't afford to do.

I have found that my MP is very helpful with the barrage of cock-ups I have had when I have had the inevitable contacts with the DVLA.

If you contact the compound where your car is and explain the situation then they should hold off on disposing of your car. They will charge you daily storage fees until you collect your car. There is normally a fee of £105 for them taking the car in the first place.

Wino, that's good to know that the compound should be able to delay the disposal of the vehicle.

 

I contacted DVLA again, and they gave me a different address to send my licence application to, so it should go through quicker. Items have been sent special delivery and should be with the DVLA this afternoon.

My brother had his van impounded before Christmas and they kept it for a further 3 weeks for him. Like I said before he was charged storage fees

There ought to be no problem arranging for someone who is licensed and insured for any vehicle to collect the car from the pound.

 

I have heard that some insurance companies have added a clause to say that you will not be insured for collecting an impounded car when the owner isn't insured. Also, it's difficult to find someone who's free between 9 and 4 on a weekday, everyone's at work!

Finally got my car back today. Took 16 days to get my license back.

 

Now time to gather evidence against the DVLA and find out exactly why my license was revoked.

 

Strangely I received a cheque in the post today from the DVLA for the £45 I sent them to replace my revoked license. I wonder if that's an admittal of their mistake!?

That's a rather laid back attitude to take for a miscarriage of justice!

You only say you never received letters of prosecution but you never stated that you had/had not been speeding in 2002.

Were you or were you not speeding in June 2002?

As far as i'm aware I was never caught speeding in 2002. I've only ever been stopped for speeding once, and I took my license to the local police station and the points were added. That was in 2000.

 

The only reason I said "the fine could be worse" is that I was worried I would get a ban and a 4 figure fine. I've kind of accepted it, as I can't see how I can prove that i'm innocent. I am though going to pursue this issue and request from the DVLA all the data they hold on me and my driving history.

Hi Andy S (wouldn't be Smith would it?) I think you need to find out if the speeding fine was to a namesake of yours as I have read about a bloke who had his motorcycle confiscated for a similar "reason" (he was allegedly banned). In his case the banned bloke had the same name and date of birth!:rolleyes: He was told by the police station desk clerk that to get his bike back he would have to write to the police HQ and pay the storage fees, because "that's how the system works". (No mention of apologies refunds, or compensation!) My own surname is fairly rare but seems to agitate the police so I can only assume that there is a really baddoppelganger of me out there but how can one find out?

Possibly you could lodge a claim for compensation from the Victim Support Scheme. They must have plenty of money by now as everyone who is fitted-up in court is charged £15. Alternatively when (if) the DVLAs error is proved sue them for all your losses in the Small Claims Court.

Yet another thought is that your car could have been cloned. Alternatively it only takes a typo at DVLA to send every thing haywire. (I once had a logbook for a Puch 50cc moped that said "2 wheel bulldozer" Probably these days the clots would try to fit me up for not having a bulldozer licence). This country gets more like Zimbabwe everyday.

Well, 3 days before I was due in court they've gone and dropped the case, presumably due to a complete lack of any evidence whatsoever.

 

I still don't know why my license was revoked, but at least I can relax in the knowledge that i'm not going to get a fine or any points on my license. And of course I can claim back my solicitors fees, car storage and transport expenses. Should come to a good £1200 I think.

Glad its finally coming right. As to the police trouble I have been getting, an unusually decent police officer admitted that there is "a rough bloke that looks like you and drives a similar car" - Ah, I had suspected this for several years. Whether this is also a case of ID theft and car cloning as well I don't know.

 

By the way there is now a new ID theft crime doing the rounds. Allegedly hackers hack in to wi-fi computers then download paedophilia. Whether this is done just to get the porn or is malicious is anyones guess. Anyhow there is the risk that anyone with wi-fi can be hacked and ultimately sent to jail for having obscene images on their computer! Needless to say the judges are most unlikely to have the perspicacity to comprehend this scenario.:Cry:
