    • Just realized that the deadline for paying the £59.00 trial fee has passed on the May 17th. But when contacting the helpline this week, I was told the court hearing date is still on? By now, I have fully realized I have messed up. Should I just drop this case and go after Interparcel?

    • I've had to hide two of your posts.  Anyone clicking on your links gets sent to external sites.  On top of that your real name is showing on one screenshot.  Fellow Site Team member dx100uk has already politely asked - Anyway, jk2054 wants to see the communication you got from your local court which will have told you about the hearing date of 17 June, and will have mentioned a deadline for filing your Witness Statement.
    • I believe it is helpful to seek guidance from a range of places and decide on the validity of the sources and frequency of responses which are most helpful. A single voice can be a dangerous thing. As, of course, can groupthink. Scott, it feels like £4k on a solicitor for a £1.5k bill is overkill. Were we back in time I'd suggest small claims court as your claim sounds like it may be straightforward? By all means add that phrase on. I also suggest you contact the court and go and sit in on a couple of similar cases to get a better understanding before you shell out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I have just joined today and am hoping for some advice. I have been browsing this site for a couple of weeks now and have sent my first letter to Abbey requesting a refund of £904.00. This amount is for 18 months worth of charges all of which I have the statements for. I didn't go for the six years worth of statements because I have read that abbey are a pain in the butt at sending these out and I just wanted to get the ball rolling asap.

 

I have had enough of the monthly charges which I seriously cannot afford. I am living on the bread line as it is and they are cripplying me. So I have decided to take control of my finances and start a fresh by opening a new bank account and trying to close the Abbey account which I have had for approx 15 yrs. So now the question is when I tell them I want to close my account what is going to happen regarding my £450 overdraft? No doubt they are going to ask for it back and who've guessed it I havn't got it. So after reading this site I am confident enough to ask for some of my money back and hopefully they can then have their money back and we will be both be happy. That would be the perfect ending but I am waiting with baited breathe.

 

I sent my letter to them on 23rd June and I received a letter from them this morning which I though was a quick response. As I can tell from previous posts this is a standard letter acknowledging my complaint and they have a team investigating my complaint and this could take up to 4 weeks blaah blaah blaah signed Marc Winder, Head of Compaints.

 

Obviously I am not going to sit here waiting for four weeks just to get a reply that their charges are fair etc. The next stage I gather is crucial but I am not sure what to do. Has anybody got any experience with Abbey they seem to be the most stubborn of the banks. I can't wait to cut all ties with them.

 

What Should I do now? Is there are second letter to send or do I just go for the jugular and file a claim straight away which I am a bit apprehensive about (as this will cost me money that I havn't got) but am prepared to do. Any help would be gratefully appreciated. I am feeling a bit vunerable but confident.

You are right I'm not telling them at this stage that I want to close my account I am going to wait until the out come. Your input has been a great help, exactly what I needed to know. You definitely know what your talking about and I will no doubt be back for more help.

Hi! I've been using this group for a claim with ABBEY and have so far sent a letter asking for my money back ( result- complaints leaflet, letter from Mark Winder) Letter before action (result- complaints leaflet, letter from Mark Winder). This must be a standard letter and in my opinion they just send these out to 'cool you down' and maybe make you forget about it. I don't know if I'm right, but I'm sticking to my time table. They will get my claim on thursday. I don't think the ABBEY will shift unless they know you REALLY mean buisiness. Take heart that you can charge interest and costs from that point in! They are just trying to put us off- don't let them!! Good luck! Jengwilt

Hi, can I just ask, did you wait for them to investigate (up to four weeks) and for their second reply or did you send the letter before action straight after receiving their first reply? Should I complete a spreadsheet/table detailing all of the charges to send to them?

 

Also when I put in the form for the small claims court, do I have to pay out any costs initially?

Don't wait for their investigation. Remember you are in control of timescales, not them.

 

Send the LBA 14 days after your prelim letter. Together with a schedule of charges (type of charge,date,amount).

 

Court cost are paid when you submit a claim and these are automatically added to the amount you are claiming from the bank.
