Defaulted loan but no DCA involvement is that possible?

Mording everybody,

could anyone help me i wonder? HFC/Beneficial finance defaulted me on my loan, and i've been reading some threads on DCA'S. I for one have had no involvement with a DCA, i've made no arrangement with anyone apart from the person who sold me the loan ( which is in dispute)and not the bank itself, although i'm paying half the contracted amount of the loan. Can the bank enforce the default without the involvement of a DCA?

But as it stands, i've nothing to say that i have been defaulted, other than whats on my credit file. I have sent then a request for my file with a CCA, but i already know what the outcome of that will be, then i will send a S.A.R ( subject. access. report), then hopefully find out some info as i have absolutely nothing, if they don't comply to my requests and execute them accordingly, then i will send a letter to Trading Standards. Have you an idea of what i should do next?

I also have record's from the Ombudsman stating the had said, "that no payments were recieved from Oct 2005 - Jan 2006, and as by the HFC statement it clearly shows payments were made ,also that, HFC contacted me in writing saying that," as you have maintained three monthly payments as agreed with in Oct 2005-Jan 2006", (which was never agreed in the first placed). they have basically admited with regards to the documentation they sent to the ombudsman that they have lied.

I am sending a (Subject Access Request) in the new year, but the thing with the ombudsman, after reviewing my case twice they said the case was closed,after receiving the false info from HFC, only after this did the info turn out the way it has.

was it the fso you made your complaint to,if why not try ICO and explain it all in their that they are in breach and also the false information they reported to the FSO ,this might help speed up things and also get you some answers enough to go back to the FSO but phone them also see if they will listen and if not e mail them for their complaints handling forms as you wish to make a complaint against them,i am sure they would rather handle your complaint again but more thoraghly
