    • “Not realising it was a no parking zone” doesn’t help you if the timing is correct, as (at least, on Google Maps / View) there is clear signage ('7am to midnight', parked at 15:22) What might be worth pursuing is the "ticket handed to driver" aspect : do you have any view on why they would be  stating that?

    • Hi,   A few pointers from yesterday to take note of evris cpr 27.9 failed again so we should really make issue of this also their WX fail to comply with CPR so again we should take issue with their statement of truth  you cant get tort if you get damages under subsection 7 of CRA because its double recovery  - not sure what we think of this? however its the first time i saw the judges make reference to your non automatic rights from s49 which s54 and 57 assist with. We should start stating this specifically for claims as I think its much better than just 49 and 57 as we need to make it clear where our non automatic rights come from as 54 automatic frankly dont help  I have sent the claim form and defences to the admin email because I can’t upload them for some reason as it wont let me but thought this may help as its the first time we’ve taken tort to trial. although i think the DDJ was honestly struggling to understand some parts of the law because he was asking me about them and how he should interpret them, especially for the automatic. Will apply for transcript if you want it?
    • I decided on confrontation - which I hate.  Omg the arrogance of the driver.  They refused to say who had given them the alleged permission to park on the private land - unless I proved ownership.  I couldn't believe they could be so objectionable.   They advised they couldn't take public transport to work as they lived too far away.  They couldn't rent a local garage as none were available. I simply said that's their issue not mine. It was infuriating that this person had such misplaced entitlement.  However I decided to humour them and show them the title deeds.   They couldn't respond.  Although at this point they alleged some guy in a city up north - whose name they couldn't remember - gave permission!!    They then asked if they could buy the garages and land!! Yet can't afford to park on a meter !! They seemed to back down and agree to now park elsewhere.  I hope so.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys; I am traveling to M from London (Heathrow side), I am not a very confident driver and i am meeting a person in M who is not a driver at all and would need to use public transport to some place to meet me. What would be a good place for two dummies like this to meet?

It's actuaslly not at all easy to get into Manchester form the Trafford Centre - there are buses but the tram doesn't go out that way - you have to get the shuttle to Stretford and then a tram from there.

 

Which way are you planning on coming up to manchester and where are you going when you get here?

 

For instance, if you come up the M6/M56 then you will approach from the south or west, if you come M1/M62 then you come in from the north east.

 

And when you say your firiend is using public transport what type are you talking about and where from? There are 4 or 5 rail stations (if you include salford central) plus trams throughout the city centre and of course buses.

I shall be travelling on M6 and the person I am meeting will need to be flexible (I am doing someone a great favour!- i.e. delivering my daughter to her boyfriend, as she wants to meet his friends! bloody taxi service! :D )

Well in that case I agree with cal - if you don't need to actually get into town yourself then tell the boyf to get a tram to stretford and then the shuttle bus to the Trafford Centre and you can do the handover there.

Its right next to the M60 south western side so easy to approach from M6.

Otherwise, Altrincham is on the tram line only 30 minutes south of Mcr and 5 minutes from the M56.

Much easier to get to and no city driving if you don't fancy that.

If you're driving from London, why be nervous of driving in Manchester???!:grin:

 

I'd always suggest driving to points that will always be well signposted.

 

In this case to Manchester from the M6, head for Manchester, head for Manchester Airport and then the train stations (Picadilly being easier).

 

(Obviously the basics but a good pointer)

 

All well signposted and you end up in the centre with good parking too.

Not a bad idea; M/cr airport is really easy to get to - M6 - M56 and you're there. But why not let miladdo come to you and meet at the airport? There are shuttle trains every 10 mins from Piccadilly.

 

Having said that, Trafford is one of the biggest shopping centres in Europe and is pretty well signposted also (much to the chagrin of shopkeepers in the towns surrounding it).

Take ur daughter to the nearest airport in ur own city, ie London and let her board a plane to Manchester where her man can meet and greet her on arrival. chances are the cost will be cheaper and it will save a hetic drive on the motorway for you and ur girl can arrive rested and eager to grab her man.

Hi Joa!

 

I'm driving up to Manchester from BEDS this Sat 8th Dec + returning Sun 9th Dec.

If U got your daughter to change her dates, I wouldn't mind taking either U, her or the both of U up there.

U would then only have to drive as far as Jct 14 on the M1 (signposted Milton Keynes).

There is a FREE Park & Ride there, where U could leave your car.

 

It has the added advantage that it is also where the National Express Coaches stop off at Milton Keynes Coachway.

National Express - Coach Travel

...So U would always have easy access to your car if your travel plans change etc.

 

Alternatively, U could get a Coach from London Victoria straight into Manchester City Centre @ Chorlton Street (...just behind Piccadilly Gardens).

 

Let me know if U want to take me up on my offer of a lift.

I've had a last minute cancelled seat resevation!...:rolleyes:

U could always do a 'Dry Run' this Sat/Sun yourself + go to the Manchester CAG gig??...;):D

 

Am a native from Manchester.

The suggestion that the Trafford Centre has GOOD Public Transport Links is a TOTAL myth.

...Hence the traffic probs cos of the private car generated trips around the area.

I debated this with hedgey06 somewhere on a Thread once (...can't remember which one though!:rolleyes: ).

 

Personally, if I was a 'woose' at driving, I would catch the Metro from Altrincham Train Station, straight into the heart of Manchester.

Or else catch the Train ex-Euston, or get the Coach ex-Victoria.

You should meet at the lowry. Its right at the end of the M62/602 realy easy to find and avoids the city centre. It is also on the tram route for the other person. It also has cheap parking in the lowry shopping centre.

I don’t come from Manchester, I only said TraffordPark because that’s where I get met if I have a meeting in the city.

 

However having noticed you are driving your daughter up and having 4 daughters of my own, I would deffo say stay well away from TraffordPark if you want to keep your Credit Card in good order. :eek:

 

In fact the Airport has shops too, stay well away from there too, you could meet in a lay-by in the middle of no where, one with a burger van, the tea is cheap and no shoe shops .............:grin:
