    • That isn’t actually what the Theft Act 1968 S1 actually says, BTW. https://www.legislation.gov.uk/ukpga/1968/60/section/1 (1)A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it;   The difference between what you’ve said and the Act? a) intent to permanently deprive rather than  just depriving (which is why the offence of “taking without consent” was brought in for motor vehicles, as otherwise "joyriders" could say "but I intended to give it back at the end") b) dishonesty : If I honestly believed A's pen belonged to B, and took it and gave it to B - B might be found guilty of theft but I shouldn't be. 
    • Received a call and follow on confirmation email from the police about my cabinets! They wanted to confirm that I was prepared to support police action for the matter and that I would be happy to provide a statement and attend court at a later date!!! I think that something might actually get done - it won't get my cabinets back I know that but hopefully it will put a stop to this so called courier doing this to people!
    • Around a month ago I had to send a sympathy card to a friend in GB. Logistically it made sense to buy a personalised one on eBay and get it sent straight to my mate, rather than faffing around getting it sent to me.  This mighty purchase set me back all of £3.05 (including postage costs). I was taken aback that, when it was sent, I got a tracking number.  For a flippin' three-quid card!  I had no idea that technology had moved on so much and that tracking was so easy.  The shop has feedback for 16,300 purchases so tracking must be easy & automatic. It's unlikely your case will get to court, but in cases that do this got me thinking that we need to aggressively challenge the PPCs where they have lied about the timescales of sending their rubbish and have no proof at all of posting - when it would be so easy to provide it.
    • Thanks for uploading the appeal.  It was a waste of time but well done in not outing the driver. Why have your friends paid £60 they don't owe to a cowboy private company that have no means of making them pay as they don't do court?  If they paid by card, as I presume they did, they should get on to their bank and do a chargeback immediately. We call the £70 the Unicorn Food Tax.  The law specifically states they are only allowed to charge the original £100 but the PPCs and their bezzies in their trade associations allow this made-up extra £70 so £100 becomes £170.  Unfortunately for them the law doesn't. Anyway, snotty letter time.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My husband and I have just gone into a IVA (individual voluntary agreement, or is it arrangement, not quite sure) with Hsbc and all our other creditors due the the unfortunate financial possition we found ourselves in. Would we still be able to reclaim all the costs that we have incurred over the last 6years even though we have tecnically had alot of our debt "wrote off".

 

We were with HSBC as our main personal bank for 10years and also had a personal loan and a credit card with them, incurring massive charges over the years for one thing or another.

 

Your imput would be very helpful in this matter as they are no longer our bank.

It makes no difference whatsoever that you have closed your account, and you can go back 6 years.

Well, I finally got round to doing it. The DPA letter has been written and going in the post this very morning.

 

All I hope is that things run smoothish for this one as it is my first of many;-)

I think you can for the overdraft fees but the interest only gets applied if it gets taken to court.

 

i am a relative newbie on here so only know what i have been reading.

Oh Cr@p I think I have sent my letter to the wrong place.

I sent my initial letter requesting my statements to the head office address rather than to my branch address. Is this going to be a problem?

dont worry , it will be redirected via the internal mail system, however i would advise you to send your next one to either your local branch or straight to the customer service centre in leeds

Recieved half of my statements yesterday. Still waiting on the rest. Also recieved a letter day before yesterday stating that they were on the way and that our cheque was being returned to us. However the attached cheque belonged to some one else and had statements in my pile for 4 other people.... :eek:

 

What is it with HSBC.... Can't they get anything right. It must be against the data protection act that I have access to someone elses statements. Will be taking them into my local branch tomorrow and have yet another embarrassed look from the cashier as she has to sort out the mistake.

 

Will keep you all posted anyway.

I finally recieved the remainder of my statements last friday, but been away all weekend so not yet gone through them. I totalled up nearly £600 on what i already had so i am sure I am looking at around the grand mark, if not more.

 

Will post again when gone through them all with a fine tooth comb:smile:

Ok Guys........ been through all of my statements and have totalled up £992.50 in excess overdraft charges.

 

I am now ready to send off my preliminary approach letter, but I am unsure how to work out the overdraft interest.

 

Please could someone point me in the direction of the correct spread sheet so that I don't mess this up .

Ok sorry I have been reading a couple other threads and it seems to me that I don't actually add the interest at this point.... Am I correct?

 

I know I have really been dragging my heels on this 1 but I have had my head all over the place for the last few months and have been really struggling to even concentrate on my statements let alone any thing else. My friend came round this morning who has just won her first case against HSBC and went through my statements with me ( baring in mind I have trawled through them 6 times already) and she managed to find another £70 worth of charges.

 

I really want to get a wriggle on with this now... her success has definately spured me on, however to do so I really need your help.

Just doing my charges spread sheet and now got a question on wording.

 

95% of my charges have been excess o/d charges however on the itemisation sheets i used to get from HSBC with my statements it just says Overdraft fee.

 

would it be better to word it as they do or as what it is and thats an excess o/d charge

thats pretty bad about recieving other peoples statements. I would have written to the people myself so that they could complain and have a case against HSBC with regards to the data protection act. hehe.

 

I swapped my charge discriptions to match the ones on my statements but i dont think it matters too much.

 

Anyways, good luck. What u gonna do with your grand when u get it back? :D

I have been waiting for a reply about the spread sheets but I eventually found them myself and could not work out how to calculates the excess o/d interest on it so I made do with just claiming for the costs to be returned.

 

I have an existing IVA in place and one of its clauses states that any wind fall over £500 has to be returned to our creditors so to be honest I am unsure if we will get to keep any of it, especially as HSBC were one of our creditors. I am hoping that we may get the £500 but not holding my breath.

It's been 10 days since posting my Prelim letter and so far I have heard nothing.....

 

Is this normal for HSBC to leave things till the last minute?

 

Still they have untill Monday to reply then I will be sending off my LBA....

it's your schedule - obviously most people want to do it quickly but just carry on - send lba tomorrow - it was somewhere after the lba we received an 80% offer, wrote back saying we would accept it as partial but then heard no more - 14 days from the lba - you file your mcol - then probably they will acknowledge (just to get more time) and if current theory applies, about 21 days into the 28 you will get a request for a breakdown of charges and then 80% offer from dg solicitors (which now includes 8% + court costs) which you again say you would accept as partial or your claim will have to go on and magically before you need to pursue it, an offer for 100% comes in which you accept. be sure all letters are sent registered post for £1. and don't conclude your claim until the money has cleared.
