    • Since you were stopped at the time there is no requirement for the police give you anything there and then or to send you anything before they have decided how to deal with the offence.  They have three choices: Offer you a course Offer you a fixed penalty (£100 and three points) Prosecute you in court  The only option that has a formal time limit is (3). They must begin court proceedings within six months of the date of the alleged offence. Options (1) and (2) have no time limit but since the only alternative the police have if you decline those offers is (3) they will not usually offer a course beyond three months from the date of the offence and will not usually offer a fixed penalty beyond four months from that date. This is so as to allow time for the driver to accept and comply with their offer and to give them the time to go to option (3) if he declines or ignores it.  Unless there is a good reason to do otherwise, the action they take will usually be in accordance with the National Police Chiefs' Council's guidance on speeding enforcement. In a 40mph limit this is as follows Up to 45mph - no action. Between 46mph and 53mph - offer a course Between 54mph and 65mph - offer a fixed penalty Over 65mph - prosecution in court So you can see that 54mph should see you offered a fixed penalty. Three weeks is not overly long for a fixed penalty offer to arrive. As well as that, there has been Easter in that period which will have slowed things down a bit. However, I would suggest that if it gets to about two months from the offence date and you have still heard nohing, I would contact the ticket office for the area where you were stopped to see if anything has been sent to you. Of course this raises the danger that you might be "stirring the hornets' nest". But in all honesty, if the police have decided to take no action, you jogging their memory should not really influence them. The bigger danger, IMHO, is that your fixed penalty offer may have been sent but lost and if you do not respond it will lapse. This will see the police revert to option (3) above. Whilst there is a mechanism in these circumstances  to persuade the court to sentence you at the fixed penalty level (rather than in accordance with the normal guidelines which will see a harsher penalty), it relies on them believing you when you say you did not received an offer. In any case it is aggravation you could well do without so for the sake of a phone call, I'd enquire if it was me.  I think I've answered all your questions but if I can help further just let me know. Just a tip - if you are offered a fixed penalty be sure to submit your driving licence details as instructed. I've seen lots of instances where a driver has not done this. There will be no reminder and no second chance; your £100 will be refunded and the police will prosecute you through the courts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi all

 

Back in January I reclaimed 1700 back from halifax and won.I have kept my account free from charges, until last week when I received another back charge I admit this one was my fault.Then tonight when logging in to my online banking I have received another charge of 39.00 as I was 3.00 short for a DD I had forgot about.Do I need to go down the same road sending for Data protection to get back 78.00 or can I just go ahead with the prem letter asking for these to be refunded ?

Had exactly same problem myself last week due to being 79p short to pay council tax and they refused point blank to refund so I have now told them I will be issuing proceedings for ALL the money they still owe me - not just the £39 they charged me last week. They are behaving like total idiots I'm afraid.

While at work tonight I was told that the bank cannot take a bank charge from benefit money is this true ? does child tax count as a benefit?

 

I have had a bank charge to be taken today,One next week and two the week after total 152.00 in 3 weeks I find this soooo disgusting

I phoned them and asked for the charges to be refund and they refused to do so.I have been paying a weekly bill by cheque since march funds was always available for cheque to clear .While on the phone to them the lady informed me that the system had changed and that the cheque would clear in 24 hours now due to the new system ,but it always took 3/5 days before so this is how I'm ending up with these charges.Wonder why halifax didn't inform their customers of this change in the system?

I just read another thread about the nationwide and benefits and the person concerned had taken his case to the FOS who have written to nationwide to say that they must repay his benefits. I have little faith in the halifax repaying anything more at the moment after trying to get £39 back off them last week. Worth a try but if you get nowhere it might be worth writing to the FOS. Or maybe you could threaten the halifax with the fact that you are going to do so.....

Someone else has just told me that the FOS are not taking on any more complaints due to the test case:mad:. It might be worth checking with them though.

ok enough is emough

 

 

Halifax are claiming to take £210.00 from my account within 2 days.I am not working at present and my husband earns £177.00 per week.I have been on a strict budget due to me not working my morgage payment is due to go out of my account day after the charges are due,so if they take the money that I have been trying to keep in my account for this payment My morgage won't be paid

 

So I phoned Halifax explained my situation calmly and I received a reply there is nothing I can do for you I'm Sorry isthere anything else I can help you with today.

 

I'm So mad at this the operator even told me that they have a complaint made by me on file in my account.

 

Just don't know what to do as they are going to sink me.

Get every penny out of the account and make sure no more goes in. Have you got another account - or can you get one sharpish?

 

I had same problem with Halifax as they said I was taking legal action against them. I explained that I had not, I had simply written and asked for a refund and they had paid it. But I then said that I now would be taking legal action. Fools.

Yes I have been to another bank on monday 21st they took 3 months bank statements form halifax and then phoned to say that I could open an account at their bank,As the forms were only filled in on Monday the lady said that I would be contacted with my account number.Therefore I have to wait untill this comes though to be able to transfer the funds to my new account.

If I do this can'T they charge me further charges for the monies not being in my account for when they decide to take this 210 pounds.Wouldn,t I then end up paying more out

Oh yes and they bloody well will!!! However if those future charges happen after you have switched accounts then you can tell them to stick them where the sun don't shine.

I'm just so worried (sat here crying whilst typing) that I will end up in debt if they keep hammering me with charges for charges due.I am geniuely looking for work at the moment,which is stressful enough without the halifax taking every penny that we have coming in at the moment.No point in phoning them and trying to explain as they just don't want to know.

Once you have stopped using the account they can charge as much as they want. I did that with natwest once and the account ended up £1000 overdrawn - all charges - eventually they refunded the lot.

 

Can your OH get paid in cash until this is sorted out? You need the money - not them. Also, are there tax credits involved?

OK, just wondered if the halifax were [EDIT] taking tax credit money - that's how I got mine back.

 

I'm sure once you have got your new account up and running you will be fine. Do not think of their stupid charges as debts you owe - they most certainly are not:mad:

The only other money we have going into account is family allowance and my sons DLA (he gets a caring compontent) they have taken this in the past.Can i do anything about that

 

I have sent a letter before informing them not to use this money but they ignored it.

Well you need to get this money moved to your new account asap. If there is a payment due before your new account is up and running I wonder if the benefits people will hold it back so you get it in the new account? I don't know if it's possible to do that, or ask them to send you a cheque until the new account is open.
