    • Hello All,  I’m hoping someone can help me urgently here. Firstly, I’d like to say I have read multiple other threads and have some what an idea of what I should be doing, however my case might be slightly different so coming with my own questions here.    my situation is I lived in Dubai and had a credit card and a loan, loan with HSBC and credit card with Emirates (or the other way round), I lost my job and was forced to leave the country as I was staying in the country on my companies visa.    since coming back, after a few years 2 different debt collections agencies have been approaching me (one being IDRW and the other J&P). I’ve never answered IDRWW and they constantly chase me by calling and messaging me and my employer. My current company is ok with this as I explained the situation but I’m soon to be joining a new company who definitely won’t be ok with being messaged and called. I’m afraid to continue to ignore them as they may message and calm the new employer as they have before and I’ll lose my job. However, it seems clear from these forums that dealing with the debt collection agencies is never a good idea. You shouldn’t agree to the amount or pay anything.    j&p caught me on my phone but I still haven't sent them any money or confirmed the amount they’re saying is owed, they keep pushing to pay off the “principal” amount by making monthly payments, from reading these forums it seems like if I make one of those payments (they have provided bank details for ENBD), then it’ll just be paying off interest and not actually clearing the principle debt and the bank won’t even approve receipt of payment or that it’s coming off principle.    this is my predicament as ignoring them might not be an option if they chase my new employer. Maybe there’s a way to ensure the debt collection agency don’t contact my new employer?? I don’t know? Massively appreciate peoples help here. Thanks,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am jsut going to get this thread started as i am anticipating a rocky road.

 

This thread is concerning my loan, taken out online about 2 years ago - i think. it's recentish anyway.

 

Many months ago i asked for the PPI to be cancelled to help lower the payments. I explained i have life insurance and good sick pay from work. I was told i would have to wait until my arrears were cleared. I paid some off and they agreed to absorb the rest into loan. I had no intention of reclaiming any paid premiums at this point.

 

I wrote directly to the insurance company in Shannon. They told me that i had to deal with Barclays to do this.

 

I sent a CCA request to Barclays to see what was what, but i have not had a response. They're in summary criminal default with that.

 

I have had to withhold payment because i can't keep up.

 

I am now going to S.A.R Barclays. I've decided i might as well look for charges too. No more Mrs Soft too nice for her own good person.

 

I will be happy to pay this debt when i have a true balance without all these added extras.

 

So, that is my introduction, i will update this thread when i receive my 1st unhelpful response :p

 

If only Barclays had just cancelled the PPI when i asked.....

I'd be interested to see how that claim goes Goldlady. I've had 2 secured loans in the past. I am planning to S.A.R them at some point. Mine were from sub prime lenders. Their rates are extortionate and i'd love to get something back from them.

 

I've just printed off my S.A.R request for Barclays. Luckily enough I found the 10.00 postal order i sent for my bank acc. statements which they had returned!! Every little bit helps :p

Mmm, Barclays are slowly creeking into action after my latest letters. I've received an acknowledgment of my CCA. Nothing much i know, but after 2 months of waiting....:p

 

By the new year i might have received my S.A.R info and roundabouts Christmas 2010 they might have refunded my PPI :rolleyes:

Still no S.A.R or CCA, but have had an acknowledgement (it's a start). If they don't satisfy my S.A.R request soon it's all going ot FOS. I've wasted so much time for absolutley nothing so far.

 

The demands are coming in for payment now, but this is well and truly in dispute until they cancel the PPI.

Hi HHNF :)

 

When i started the requests to stop the PPI i didn't use any formal template letters, because i started this a while before all the excitement really kicked off in the media. I had however, told them i have adequate sick cover at work plus life policies etc. I didn't realise it was going to be so complicated. When i started all this, i wasn't even asking for a refund!!

 

I want to see the credit agreement to see what i've signed up to. I've just checked my dates and i sent the CCA request at the end of August! I hadn't realised it was so long ago. Tut Tut - i've had at least 2 demands for payment from them. I'll have to check my S.A.R dates.

 

I'm on a mission with this lot now for both this and my bank acc.

 

How's you anyway? You are so efficient on here answering everyone posts. It's much appreciated ;):)

A courier has delivered 2 HUGE envelopes from BS (a polite version of my new nickname for them). There is page after page of info about the loan and bank account. (i have already had the statements for bank acc.) There is not ONE SINGLE statement for the loan account and still no CCA :evil:

 

On the 12th they said it would take a further 10 days regarding the CCA.

I have no idea whether charges have been applied.

I have no idea what the terms of the agreement was re PPI.

There are figures in various parts of the paperwork sent, in relation to the loan, which vary from over £6000 to over £9000 :eek:

I have no idea how much of the loan is PPI.

 

If possible could someone help me focus on how to tackle all this, please.

I have found a statement for the loan after about the 10th sift through my mountain. I am GOBSMACKED:

 

each month they are adding between £118 - 135 in interest :shock: What the hell have i signed up to???

 

Ha Ha - i have just spotted the PPI figure. I will PM Goldlady and HHNF with my figures in case there are any BS spies around!! 9if that's ok with you both) :rolleyes:

 

I have missed several payments on this and am withholding now anyway due to the no show on the CA. Having seen the interest, i don't think it's worth paying anyway grrrr :?

Right, i need some help digesting this please...

 

BS have sent the loan CA. I have 2 pages:

 

1. Barclayloan Agreement - Bank Copy (B) to be signed and returned with (a).

Fixed loan sum agreement regulated by the consumer c a 1974

 

This is a CA regulated by the CCA 1974. Sign it only if you want to be legally bound by its terms.

 

I've signed and dated it.

They haven't signed.

It then says:

 

I wish to purchase Barclayloan Payment Protection

 

I've ticked the box and signed.

On the 2nd page are all the figures, which i will PM to GL and HHNF. This loan totals over £12,000 :eek: :eek: . I thought it was only for around £6,600 :o

 

I have requested the PPI be refunded on the basis that i have additional insurance that will cover me and my work sick pay is adequate.

 

I can't remember if i discussed any of this over the 'phone. I applied online as i was offered the loan in the 'My Offers' section. A courier brought the papers to the door for me to sign and then took them away. I think info was then sent to me but obviously i didn't use the 14 day cancellation period.

 

Am i right thinking i haven't got a strong enough argument to say this was mis-sold?

 

Can i still have the PPI cancelled without being reassessed for a new loan?

 

They haven't sent me a copy of the policy document. I'm assuming this should have come in the S.A.R?

The day after i recieved my long awaited credit agreement BS sent a default notice :mad:

 

I need to formalise my argument for reclaiming PPI. Initially i just wanted them to cancel it because i realised it was increasing my payments. Now i want everything i can get :mad::p

 

I have told them i have alternative insurances and a decent sick pay scheme from work (i work for the local authority) since making my cancellation request.

 

Is it enough to say i was not asked if i have alternative provision?

 

Also, i was not aware of what an impact the insurance and interest would have on the loan balance.

 

I have ticked yes on the agreement which i signed on the doorstep as a courier brought and immediately took the documents. I did have 14 day cancellation rights though.

 

Not sure how strong my case is with this, so all opinions will be welcomed!

I obviously need to respond quickly because of the default notice - oooo they make me mad :mad:

There is a thread somewhere that lists the reasons for reclaiming - I will see if I can find it. I read somewhere that 'front loading' it onto the loan and charging interest on it is an excellent starting point, and as you rightly say you were not asked if you had alternative cover.

I've been mooching around reading up on PPI. The bit below is from the Martin Lewis site. I know some people don't like him, but he does explain things very simply, which is good for the daft ones like me:

 

When you try to cancel your insurance without ending the loan, some lenders make you start a new agreement. They are allowed to do this as long as the new loan is on the same or better terms and does not detriment you in any way, for example it shouldn’t be more expensive or last longer. You should ask for this to be done without making a new search on your credit file.

The FSA says: "When consumers cancel the PPI without repaying the loan, some firms will need to reissue the loan without the PPI. Firms should ensure they treat their customers fairly in relation to the terms on which they reissue the loan."

I found this useful 'cause not cancelling the PPI is an issue for me at the moment with BS.

Life sucks.

 

 

The way i look at things now Tonycee is that all the yacky bits can only make us stronger. My focus is to get all this money stuff sorted the best i can for me and my little boy. Nothing else has ever made me feel as low as my financial situation did pre-CAG and i won't let it either.

 

So yes, i am ok. I've had a difficult decision to make and over the next month or so i need to find the courage to discuss it with the person concerned. Everything will work out for the best though. I am confident of that.

Well, this loan has now been passed to debt collectors :mad:

 

I have started a new thread in the debt and debt collectors forum as it is no longer just about PPI. I really am pi$$ed off now with this lot. I've posted the link to the annoying tale below:

Just to update, all has gone VERY quiet on this account since i sent the info off to FOS.

 

I'm sure things will change any day now, but in the meantime i am enjoying the peace and dealing with a few other situations.
