    • Hello all,   I ordered a laptop online about 16 months ago. The laptop was faulty and I was supposed to send it back within guarantee but didn't for various reasons. I contacted the company a few months later and they said they will still fix it for me free of charge but I'd have to pay to send it to them and they will pay to send it back to me. The parcel arrived there fine. Company had fixed it and they sent it via dpd. I was working in the office so I asked my neighbours who would be in, as there's been a history of parcel thefts on our street. I had 2 neighbours who offered but when I went to update delivery instructions, their door number wasn't on the drop down despite sharing the same post code.  I then selected a neighbour who I thought would likely be in and also selected other in the safe place selection and put the number of the neighbour who I knew would definitely be in and they left my parcel outside and the parcel was stolen. DPD didn't want to deal with me and said I need to speak to the retailer. The retailer said DPD have special instructions from them not to leave a parcel outside unless specified by a customer. The retailer then said they could see my instructions said leave in a safe space but I have no porch. My front door just opens onto the road and the driver made no attempt to conceal it.  Anyway, I would like to know if I have rights here because the delivery wasn't for an item that I just bought. It was initially delivered but stopped working within the warranty period and they agreed to fix it for free.  Appreciate your help 🙏🏼   Thanks!

    • Hi Guys, well a year on and my friend has just received this in the post today, obviously a little scared so looking for more of your advice.  Letter from the NCC dated 1-May-2024 is as follows.......   Before deputy district judge Haythorne sitting at the national business centre, 4th floor st Kathrine's house Northampton Upon reading an application from the claimant  it is ordered that  1. The claim be sent to the county court at #### (Friends local Court) Because this order has been made without a hearing, the parties have the right to apply to have the order set aside, varied or stayed.  A party making such an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this order.  If the application is one which requires a hearing, and a) the party making the application is the defendant: and b) the defendant is an individual, then upon filing of the application the claim will be transferred to the defendants home court.  In all other cases requiring a hearing the claim will be transferred to the preferred court.    As a result of an order made on the 1 May 2024, this claim has been transferred to the county court at ##### (friends local court)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If no-one else replies, give the court a call. Ive contacted them before and found them really helpful. You may be able to amend your claim. It would depends how far its gone I guess. id give them a quick call. There numbers on your claim form aswell as your claim number.

Best of luck to you. If they did take you to court I can not think of a better person for them to lose to! Lets hope if they do take you there and lose, it sets precedent! (I have no idea what I'm talking about, mind, I did a law unit about 7 yeara ago!!).

RESULT!!

 

Two mysterious cash credits into my a/c yesterday:

 

1 x £74.00

1 x £33.01

Total £107.01

 

My bill to them:

 

Charges plus interest £77.01

Court Costs £30.00

Total £107.01

 

Phoned customer relations who confirm this was an 'internal' payment but they can't confirm anymore than that.

 

I told them I would not advise the court to close the claim until I have something in writing from them confirming these credits were in fact a refund in full of my claim. They said that they would ensure I get something in writing if that is what in fact has happened.

Hi Bovvered

I have just read your thread and it sound so positive. I have been with Halifax for quite a few years now and had so many charges I can't imagine how much it adds up to. I have decided to claim for all of the charges they have taken from me. I have just bought a house with my partner and we are trying to pay our bills but as soon as one dd gets missed Halifax pounce in with loads of charges. It then becomes a vicious circle - you don't have the money to pay the dd, you get charged which they take from money you don't have, then you get charged for the privilidge of going over your overdraft and it escallates from there!! I didn't know where to turn until someone at work gave me this website and suggested I claim the money back.

Can anyone advise me as to how much/what timeframe you are allowed to claim back? Is it just the last few months or can you claim for the past 6 years? Advice would be greatly appreciated as I am a bit nervous about where to start.

Thanks in advance for your help.

If you look at my first post you'll see how nervous I was too - I think a lot of people are nervous at the beginning, but this is one reason why you absolutely MUST read the FAQ section where you will also see a very helpful thread called Step by Step guide. The more familiar you become with the process, the more confident you will feel. Don't get me wrong, this is a BIG thing we undertake - challenging the banks, and you must back yourself up with KNOWLEDGE!!

 

Well done for taking the first steps in joining this forum, now go read the FAQs then GO GET YOUR MONEY!! :)

 

Oh and yes, it is six years working back from the date you claim eg today...

I am off to engross myself in the FAQ's and find the letter to send. I'll update once I have all the details - I reckon the bank owe me a packet the amount I've been charged over 6 years. I knew I had kept all my statements for a good reason. Thanks for your advice and I promise I will keep you updated.

While I was in the process of claiming through Moneyclaim Online, I was sent a notice of charge for unauthorised O/D to be debited from my account end of this month. I faxed Customer relations to ask them to waive this charge. Well I got my full refund last week, and I checked my online statement to day, and they didn't charge me the £28 Unauthorise O/D charge, great, but they did charge me - wait for it:

 

'Interest Debited - notified last month £0.01' !!

 

They said in their letter they reserve the right to close my account should I get any more charges, maybe this is what they are trying to do? Otherwise, this is hilarious!!

Just ring and say, "I am questioning the credit to my account on May 2nd 2006. Is it correct?" If they say yes, get their name and spend it!!!!

Regarding Halifax refunding me for a second time, I spoke to customer relations again today as he has been looking into this for me, and said today they will write it off as bank error and not reclaim it in the future, and 'thanks for being upfront and telling us about it', (in other words they are letting me keep it) and he will send a letter to confirm this today. I will not touch any of it till I have this letter though.

 

I have to say I have found the person whom I have spoken to a few times in the course of my claim, to be a really nice, polite and helpful member of staff. Glad they have some gooduns!

That is just fantastic, and I hope you enjoy spending their money. You see... if they're letting you keep it, then they can obviously afford it! Which gives me hope!!

 

8 days since they acknowledged mine and still no cheque - but hey - I'm holding on to your thread..............

I refer to your telephone conversation of 3rd May and also of today's date regarding the duplication of the charges refund of £74 made to your account on 27th April and 2nd May.

As I mentioned during our telephone conversation, I believe that in the circumstances and the inconvenience you have suffered, the Halifax will close our file in respect of your complaint and we will not recover this overpayment from your account.
