  1. New one this for me...a little help required?! My Wife has a TSB credit card, has had it 17 years no CCA at all. Have nt heard from them for over 6 months. Have sent Resolve Call, Moorcrofts and 2 others letters in the past asking for CCA AND Letters and they all give up and say they have passed it back to Tsb. Today though we receive this new one "We have been instructed by our client to recover the overdue debt. We DEMAND that the sum stated be sent direct to this office IMMEDIATELY using the payment slip below. Your failure to comply could result in a DEBT COLLECTOR calling upon you for payment or a COUNTY COURT JUDGEMENT being registered against you. Yours sincerely swiggly autograph! By the way this is from the DEBT ENFORCEMENT OFFICE in Whitchurch, Bucks. I am quaking in my boots....NOT! Any help what road I go down please with this one Is it same approach as the previous four and has any one heard of this company?8)
  2. Hi I'm so glad to have found this forum. I hold 5 student loans from years 1996 - 2000. The 1996 & 1997 loans are with Thesis The 1998, 1999 and 2000 loan are with Erudio I have never received a DAF from Erudio or signed any document with them. My loans have always been deferred thorugh the Student Loans Company, who now seem to have rebranded as SLC. Historially I've occasionally been late submitting deferment but it's never been an issue. I did not receive a DAF from anyone in 2017. Erudio have sent me a default notice letter saying I had to pay my arrears of £1254 to "remedy the breach of Agreement" by 21st Oct. For personal reasons I didn't open this letter until after that date. I rang them (sorry! - I won't make that mistake again, it was before I found this forum) to see what could be done. I've been told that I'm no longer eligible for deferment. I was explicitly told that the agreement has been cancelled and that I'm no longer entitleld to have the loan written off in 2025 and that I need to enter into a repayment plan. When I started receiving letters I spoke with SLC (last month) and they have sent me a replacement DAF, however it only lists the 2 Thesis loan account numbers, not the 3 Erudio ones. I'd greatly appreciate advice on where I stand legally and what my next step should be. Thesis are also now calling, emailing and texting but I haven't yet responded to them. Many thanks DJ
  3. Hello everyone I wondered if someone had some advice on what i should do, the problem is the following. I was out of the country for nearly two years and suffered a succession of financial problems, work came and went as did accomodation. As a result of all the stress i neglected to contact the Student Loans company about deferment. It is very expensive to call them from Holland. Well I actually sent them a fax about this time last year explaining my situation and asked them to contact me via email or reply to the fax number, but they didn't, they just kept calling my parents. Now I am back in the country and i want to sort it out but i worried that it might have gone to the debt collectors. Can anyone tell me what to expect after this time? CHeers, S
  4. Hello I have two Student Loans dating from 1995 and 1996 that I took out whilst at Aberdeen University. For many years I deferred them with the SLC with no problems until 2011. In 2011 whilst self-employed they refused my deferral due to the chap that I was sub-contracting for not writing the letter regarding my income on headed notepaper. I probably had some communications from them which I ignored as this was during a spell of depression and ignoring my debts. Back to present time, and this week I have received a letter from a company called Thesis Servicing (only has the 1995 account number on the paperwork) advising me of there intention to register defaults for over £3800. (this must be both loans combined.) There is also a letter that appears to be a default notice. I am still on quite a low income, what shall I do? I was hoping that after 20 years the sums may be written off. I really don't want a CCJ, is it best to see if they will accept a low monthly payment? Many thanks in advance for any advice given.
  5. Hi, this is my first post on here. I have 5 student loans taken out 1994-99. I have never earned enough to make repayments and deferred each year (usually with lots of hassle and documents being lost by SLC etc). Then I had to start dealing with Thesis Servicing. In 2010 (I think) I made a decision to voluntarily make repayments on my loan, phoned Thesis and set it up - or so I thought. 9 months or so later, I got a letter followed by a phonecall to say I was in arrears and had to pay. I contacted them and disputed it and was told they had taken down the wrong bank account details but they would only wipe 3 months of arrears. I argued with them as it was a voluntary payment and I still wasn't earning the threshold. I took to ignoring their calls and letters or on the odd occasion when I did speak to them, I reiterated that it was their cock up that had caused the arrears and I would not be held accountable. I have not received a deferment letter from them since I first arranged to make a payment. Last week I received a letter from them stating that I had defaulted on my loan. Today I received a letter from Link Financial demanding full repayment of £7,413.20. Where do I go from here? I'm adamant I should not be liable for this debt until I am financially in a position to repay it. Thanks in advance for any help Jo

Hello I`m sorry to start a new thread about this as there seem to be a multitude of other threads regarding Thesis but I have spent the last couple of days going through them and am still unsure whether I should respond or ignore so would be grateful for any advice I have 3 loans which were taken out 95-98 and have always deferred due to never earning enough to pay back. For some reason I did not receive my deferrment forms for this year but didn't realise until someone from Student Loans (I assumed at the time they were) rang to ask why I had not sent my deferrment forms back. T hey sent more out and I returned them and received notification that I had deferred until May 2014. Not long after this I started receiving calls on my mobile and tracing the number I found that they were from Link Financial / Thesis. Some wide boy left me a message asking me to call them back which I have not. Since then I have had numerous calls per day (with them using different numbers or caller unknown which I have ignored). I have now received 2 letters from them. The 1st stating that they have been trying to contact me in reference to my student loan which is being serviced by Thesis Service and are wanting to speak to me as a matter of urgency to ensure they have the most up-to-date information before they action my account which may result in arrears being applied to my account before I have had the opprtunity to adress the situation. I received this at the end of May. I have another letter dated 7th June which states that they acknowledge I have deferred until 2014 but there are now £76.90 arrears on the account. At the end of the deferrment period the full amount of outstanding arrears will become due immediately and not clearing the arrears during the current deferrement period will cause the loan to accelerate through their collection process and ultimately may affect abilty to obtain future credit. As an aside I am currently on a DMP due to losing my job 6 years ago which is serviced through CCCS - now Step Change so am aware of the tricks DCA can play. My credit file is currently okayish and any defaults have been put on my file and I only have a couple of years until they expire. I do not want another one one there now. I am unsure how to respond to them - if at all? Many thanks
  7. I have a Moorcroft "home collections division " letter for a Lloyds TSB debt asking me to give them £90 a month....nice try. Where should I start with tis as I have already told TSB I cannot pay due to their high requests for payment and interest wiping out the payment...help ?
  8. Hi guys, Got a quick query about an issue I've had regarding my pre 1997 student loans. My account has been passed to Thesis and I've been trying for quite some time to get copies of the credit agreements. They've sent me through unreadable copies a number of times, to which I requested further legible copies. I've now (much later - months) received copies of the agreement and terms and conditions that are readable but I've noticed a discrepancy between the various copies of the documents I've received. The earlier copies (without legible terms and conditions) have my signature on them but have not been signed by anybody from the Student Loans Company, whereas on the most recent copies (that are legible) a signature has appeared (and has been dated back to a time a few days after my dated signature) in the box designated to be signed my a representative of the Student Loans Company. There's no mistaking that this signature has been added after the initial copies were sent to me. In the earlier copies my own signature is perfectly noticeable, but the box which should be signed by SLC is unmistakably empty. All the photocopies of documents I've been sent have the word "original" on them so it doesn't appear that the reason signatures are missing is because they originally sent a duplicate of the original agreement. Hopefully this is a clear explanation...does anybody have an understanding of what this means? Thanks in advance.
  9. I took out two student loans in 1992 & 1993. I deferred them for a number of years and in 2000 I moved house and forgot all about it. They eventually caught up with me by letter in about 2004ish and I called them and negotiated a repayment of £70/month. When the debt got sold to Thesis there was a period where I didn't pay them anything due to a lack of provision of details of how to pay on their part, but I did resume payments eventually. Last year the debt got passed on again, this time to FFHE, and once again I was told to change my standing order details. The details are hazy but I recall speaking to someone from FFHE last year, the standing order form they were going to send me never arrived and there was a brief delay where no payments were made. I started paying FFHE £70/month in July this year. There was only around £500 left so I was due to make a final payment in February 2011. I’ve been happily repaying this for several years albeit with a couple of brief interludes when they passed on the debt and changed their payment details. So I was naturally astonished and furious to receive a phone call two weeks ago from LINK, saying I was in breach of the agreement (because I spoke to someone in May but they didn’t receive a payment till July) and demanding immediate payment of the outstanding balance of around £260. They have contacted me several times since, threatening me with bailiffs and/or court action to recover the debt if I refuse to pay it now, in full. Continuing with my £70/month for the next 4 months is not an option. The woman from LINK suggested I seek advice from a solicitor. I haven’t received any correspondence whatsoever from them since May when I spoke to them to sort out the remaining payments and change the standing order details. Yet they say they’ve been trying to contact me. Well they can’t have been trying very hard – no letters, no phone calls, nothing. I would like to know: How can a debt I have been willingly repaying regularly have been passed to a DCA? Is it binding if I haven’t signed anything? How can I be in breach of an agreement I wasn’t aware of making? Are they not in breach of the Data Protection Act, since I never authorised my details to be sold/passed on? Can they issue a CCJ? How long would it take for them to get bailiffs or take me to court? Would it be before February? How can they suddenly demand this out of the blue with absolutely no prior correspondence when I’ve been paying? Will this affect my credit rating? My intention is to ignore them and just carry on paying the £70 until it’s paid off in February. Surely any court would throw it out as a complete waste of time to pursue a debt that’s almost honoured and where there is hard evidence that it’s regularly being repaid in substantial amounts? I’d just like to know where I stand legally and what I should do next time she calls, which I know won’t be long. She’s calling my mobile and home number. I could understand (a bit) if I wasn’t paying them anything but I am. Is this not harassment?

Hi All, Firstly, I would implore any other first-time posters to write any lengthy posts like these in a separate program and copy paste, as I just spent ages writing this, only to lose it all when I hit “Preview Post” as I had been logged out!!! :mad2: You never know, maybe this version is more concise!: Been reading this site quite a lot recently due to recent contact with Link. The sheer size and number of threads is a little overwhelming - especially for a "forum novice"! I'm after a little advice on my situation, so here's the rundown: 1995/96, 1996/97, 1997/98 - I took out three student loans. 1998, 1999 - I deferred payment. After this, things get a bit hazy (it was a long time ago!), suffice to say that I lost contact/failed to defer (between 1998 and 2007, I lived at 13 addresses!). Sometime in 2002 I was contacted by the "Student Loans Company" (I presume by this point, this was actually "Thesis"?). They said I had defaulted on the loan (a sum of about £4,400), and that interest had been frozen, but that I had to start making payments. As I was on benefits at the time, I set up a DD for £5/month. After this, I must admit, I just forgot about it, and the £5/month has been going out ever since. Last month, I took a call on my mobile that turned out to be from Link Financial. They asserted that I now owed them payment in full, as I had failed to pay off the balance within 60 months. They also stated that the balance was now about £5,600 (not exact figures, I don't have the paperwork to hand) due to interest and charges (I didn't think you could accrue interest on a defaulted loan?) As I had no idea of Link's DCA pedigree, I started off trying to come to some arrangement with them, saying that I would like to arrange to increase my payments and come to some payment plan agreement. This is when all the usual harassment tactics came into play, such as threatening "Bailiffs", "House attachment", "Criminal proceedings", etc. if I did not pay in full. This is when I started doing some internet research on my rights in general, and realised they had no grounds to make these threats. The last contact I had with them, just before I started reading these forums, I told them I may be in a position to pay a lump sum of £1000 when my next invoice was paid. This was mainly to get them off my back for a bit. I am possibly in a better situation than most, in that I could find the money and have done with it (though £5.5K is a lot of money in anyone’s eyes), though that hasn’t made me feel any less stressed about the situation, and makes me really angry when I think of all those who are in much worse positions and have to deal with these heavy-handed thugs. The long and the short of it is that I took the credit in the first place, and do not feel that I should be exempt from repayment. But I have endured 6 years of CCJ’s and bad credit in the past, due to my complete financial ignorance around my student days, and I would rather not go back there. Ideally, I would like to come to an agreed (greatly reduced) sum that I can pay off in full, and walk away knowing that the debt is settled (especially as I balk at the “interest and charges” that they say have accrued). Any advice on how to move forward?
