  2. Hi all, i have had a lloyds tsb credit card since 2007, which i have allways paid on time but last year my father became very sick and i had to give up work and become his fulltime carer so now i am basicly living on £55 a week and still haveing to pay £180 to the credit card each month, which i have done so far by selling most of my stuff but i just cant afford it anymore. so my question is, is there any way i can get them to stop the interest or lower the monthly amount any help would be greatly appreciated
  3. A SAR request was sent to Lloyds TSB early June 2011 quoting various account numbers and the account holders names where more than one person was involved. Following drips of small information being received a follow up letter was sent end of June advising 'failure to comply' with SAR request and a small bundle was delivered to a branch of their choice this week for collection. The covering letter addressed the points raised in the original SAR request early June. One of the accounts was a Vantage Card Account going back to 2002 and they have supplied a copy of the agreement signed and ticked Optional PPI cover not realising that Self Employed person's were not covered. Further more, they have only provided 12months statements for this account covering 04/05. This has since been put in the hands of DCA's and they do not know how they have arrived at the balance outstanding, the amount they are claiming is currently still outstanding. Surely, if they can find copy Agreements from 2002 they would have copy statements from then also, I assume this is delay tactics? On the few statements they have sent we can identify PPI premiums and 'Unfair charges' which they intend to claim. LTSB then say that they only share information with Experian & Equifax when quite clearly on other documentation enclosed, they have sent agency letters to 4 other organisations! They have included screen prints and conversation thread from 3 of these but nothing from the other 1 but there are no copy letters, yet they have recorded that letters sent on various dates. Another of the accounts was a Personal Loan used as a Bridging facility during the sale and purchase of 2 houses. This was also in 2002 and included PPI and once again would not be eligible as both parties Self Employed but the premium was advanced as part of the loan yet the loan was totally repaid in 6 months. How is a one off PPI premium claimed? Is it through the same spreadsheet with interest in restitution at 29.9%? They have failed to supply Current Account Statements, Mortgage Account Statements, additional c/c statements as above and generally appear to have been selective with the information they have supplied. Due to the recent news bulletin that the banks have been granted an extension to comply with SAR requests (16 wks) as apposed to the usual 40 days, we calculate this will be due to expire early September. They have also advised that they are not the data controllers for Black Horse who provided the mortgage facility and anything to do with the Mortgage Account must be a new SAR request to SMSL RE SPML. Has anyone else had this response? I appreciate there is more than one account here but wasn't sure whether to create seperate threads but then it would complicate matters from the off, I thought. I would like to draft a new letter up advising they have failed to comply with the SAR request but due to the complexity I am not sure where to start. If anyone has any suggestions they would be willing to share I would very much appreciate your assistance. Shelley
  4. I have an old Lloyds TSB Trustcard, which is giving me some grief.... I have been trying to get copies of statements etc since 2006, and thought that I was finally collecting everything today, however I went to the bank and there was only a short letter saying they didn't have any information. There's some history.... I opened the Trustcard account in November 1998 just before I went travelling, I was 18 at the time and working part time. The account was closed in July 2003 when I lost my job and then sold to Activ Kapital in September 2005. I am still paying the remaining outstanding balance now, with about £1,400 left to pay. In November 2006 I wrote to Lloyds and asked for copies of my statements etc, but never received them. They were constantly looking in to the matter, but were proving difficult to find??? I unfortunately lost my copies when I moved house at a low point in 2005. I recently applied for a new SAR and received a letter a couple of weeks ago saying everything was now ready for me to collect and I could collect a PARCEL from my local branch, I turned up this afternoon and there was a short letter saying they couldn't find anything. "...We have been unable to find any other information regarding your credit card due to retention periods. Unfortunately, we have not yet been able to locate a copy of your signed agreement. We can assure you that before we opened your credit card account we would have required sight of a signed agreement. if you take this matter further, the bank is confident in their ability to be able to prove this. If you require information regarding your debt after September 2005, you will need to contact Activ Kapital as we are not the Data Controllers of data held by this company." I know there were quite a lot of charges on the account in the last few months of it being active, but I'm not sure what it was like before that, I can't remember if I had PPI or not, but now it seems I can't find out. I am still repaying this account, I have been since it was closed in 2003, along with a considerable amount of other debt. However I am now feeling stronger mentally and my ambition is to get out of debt 100%. Anything I can get back that I should't have paid is going to help massively... so any help on where to go next with LLoyds is going to be a massive help... I know it's an old debt, but it's still current as I'm still paying it....
  5. Hi, I'm planning to start a Lloyds PPI claim and I would be grateful for any help on process. I had a personal load from 1998 I think and finally paid off in 2004/2005 through full and final settlement, plus two credit card with them which I finally paid off (the last in March 2011) throught DCA. I have the account no for the loan and the credit card nos. If it's possible I would like to claim back any money since they put me through a lot plus have to wait six years to clean my credit my file. My quetions are:- 1) Can I claim back the PPIs for 3 accounts? 2) Do I send a SAR for the agreement details or claim stating the account details? 3) I found some the letter template but not sure the right one and the correct order
  6. I have put me in the heading but it is my brother-in-law. He has a credit card balance £17K in court next Friday having been adjourned back in September as TSB did not have all their information to hand! This has been brought on by TSB who do not want to go to trial but are looking at summary judgement. He has now got a Solicitor and Barrister representing him, they have complimented him on getting this far, so that is also down to you good people on here, thanks. TSB are relying on the following cases, American Express (claimant) and Karl Robert Brandon, Tuesday 25th May 2010, Patrick Brophy (claimant) Vs HFC Bank, Emma Carey (Cliamant) Vs HSBC, Shafeel Venus Vs Barclays and Sam Conniff (claimant) Vs Barclays, I don't know whether this helps anyone. Also does anyone have any experience of these previous cases? Are there any succesful cases where the bank being the claimant have lost ? Any views experiences would be beneficial
  7. I have a thread on the BC account regarding my various cards. With the Lloyds one, I've been unable to keep up with payments and requested a short term freeze on interest and reduced payments. Both of these were refused so I've haven't paid them for three months now. I sent off the CCA request and got sent a print out of their current T&C's but nothing else other than, going by other threads, a standard we don't need to supply you with anything else as the account pre dates May 1985. I then sent off the improperly supplied CCA second letter and have now had the, we have supplied you with sufficient information pay us and make a complaint to FOS if not happy. I haven't yet sent off an SAR but aside from this is there anything else I can respond with? I simply don't have the funds to pay them and without them agreeing to my request I can't see what else to do now. Thanks.
  8. Recently CCAd Lloyds TSB Here is their reply. I would appreciate your comments as to next step. Thank you.
  9. Hello, Could somebody please give me some advice. I was involved in claiming back my bank charges from lloyds like a lot of others. I didnt use the account i had with them, but because they wouldnt close the account i accrued an unauthorised overdraft of around £1300 - all charges! I attemted and hoped to get this overdraft wiped clean and to reclaim other previous charges with them. While the court case was going on, i applied to the FOS to have my case looked at through the Financial hardship route - I genuinely couldnt afford the repayments lloyds wanted me to repay the overdraught. Lloyds eventually told me all they could do was to refer my debt to a recovery company. THIS IS THE BIT THAT WORRIES ME - just before Christmas i had a phone call off a company, I think it is Allied International?, i explained that the case was still with the FOS, which at the time it was. I have now had another phone call off this company demanding my employers details so that they can take the £1300 out of my wages. They have asked me if I drive a car that they could take and they have asked how i intend to repay the debt. As well as asking if i have any savings. I have offered to pay a small monthly amount (of which i can afford), until October and then settle the rest of the debt in one payment. (i will be given shares in October that will cover the debt). i have refused to give my employers details at the moment, but the worry is getting to me of what powers they have and what they could do. If anyone has a bit of knowledge or advice about these things i would be very grateful. Thank you Lee
  10. Hi All I wonder if someone could give me some advice please. We have been paying about half-a-dozen DCA's minimum amounts for 5-6 years or so, amongst them BLS on behalf of Lloyds. I've recently had a letter from BLS threatening CCJ action etc if we don't contact them. The letter says they assume we have no intention of paying this debt on a voluntary basis but as I say, we are and have been paying without fail £6 per month. Shall I phone them or write to them? Or just ignore it? Any help would be appreicated. Many thanks, Pru (the debt is around £600)
  11. Hi, I'd really appreciate some guidance on the following: I've requested an SAR from Lloyds TSB a couple of weeks ago and yesterday, I received a letter from LTSB requesting a signature and completion of a Data Subject Access Request Form (4 pages of pointless questions as far as I can see). Tackling the form first, can I politely tell them to stick their form as I have already given them ample information in my original SAR letter with the £10 postal order and remind them that the clock is still ticking? Regarding the signature, I can go one of three ways: Continue as before, with a printed name only and enclose the template signature letter. Use the CAG Anti-Tamper signature. Get a mate to sign my name for me. Any advice on the above would be much appreciated. Ta, Krysp
  12. Hi everyone, tonight had this guy knock on the door said he was a agent for credit solutions trying to recover a debt owed to lloyds tsb. I replied i no nothing about it and asked the gentleman to leave, he said the company would be in touch. I remember only having dealings with lloyds around 8 years ago. Any advice would be appreciated
  13. in 2006 we took out a loan, it was taking over an old loan as well as borrowing additional money, my husband was off work at the time due to an accident, at the time we thought this would be short term however on further investigation we found out he was going to be off indefinantly, blackhorse knew about him being off at the time of the loan, they also only suggested PPI - added in a lump sum to the balance of the loan, on finding out about my husbands long term work prospects we called to cancel the ppi, we had only had it for a very short time. however the staff at blackhorse were sure we could still claim as it was running on from another loan. they "investigated " this for afew months and came back to us saying we could not claim, again my husband told them to cancel the ppi, which he was told was done. we didnt know it hadnt been taken off as we are on a repayment plan so our payment wouldnt have changed , 2 days ago we got a letter off them, it stated we are still paying ppi! we have never had any indication ppi was still applied to the loan, it was never mentioned in other letters. i rang them yestoday and was told theyd look into it and would call me back today at 12. well obviuosly they didnt call so i called them they have looked into it and decided they have no record of the cancellation, i asked him why would we keep ppi when we cant claim on it? he said he can see my point and told me to make a complaint. did they missell us ppi? im sure they did. im also planning on getting a cca from them, my hubby was sold a loan based on his income when he was at work even though he was on sick. also the man on the phone today told me their were boxes missing on the aggreement when we appiled in 2006?? not sure how we stand on this , i really dont know what im doing any advise would be great. i know i need to print off a templete letter and send a £1 po, but other than that im pretty stummped. i have also posted this in ppi section
