Having problems with UNUM myself, can I bypass FOS and proceed to Small Claims Court? -
See they have started to rethink their refunding, some people on MSE are now being rejected with no case to answer. Seems the gravy train is now drying up.

I was in same boat as you regarding the charges over 6 years old, letter from them worded the same, "if you have copy of statements please send them in" They sent the statements out to me! Anyway, added them up sent in claim, refused, wont pay out over 6 years old. Went back with statute of limitations arguement, silence. Have sent LBA, once again no acknowledgement. Going to small claims court shortly, bit distracted just now with capital One on the backburner along with First Plus, both cases at the FOS. -
What amazes me is that they sent me a cheque for £5K and never took it off the outstanding balance, this is confirmed by the statement they sent last week, surely if I was due them money they should have reduced balance? Also saying that loan will now run at 20% + interest rate, no calculation shown, though some are saying their rate has been reduced to 0%. If I continue paying the loan at those rates, the refund will only be a drop in the ocean. Santander are only refunding to those who e-mail/write in and in their reply they are accepting no liability and refund is a gesture of goodwill.

King123, what sort of redress did you get? Did they clear your loan, reduce interest rate? You can PM me if you dont want it in the public domain.

I know what you are saying, but the original question to them was, Date of Interest Rise? Amount of rise? Reason for rise? They are deliberately concealing this information and it is noticeable that there has been no rate reduction, this in my opinion is unfare considering where interest rates are at this point in time. T&C's state rates can rise and fall in line with BOE base rates, coincidentally now stated on the front of your CC statement. -

Well got a shock today, just opened mail from Santander and there is a cheque for just over £5000. Since the last statement I got from them over a year ago was for £12000, I have not got a clue what is going on. They say account will continue at current interest rate, but make no reference to balance on account. WEIRD.

When I first started to claim back default charges they initially offered £45.00., obviously I declined this and through various correspondence they offered £975.00., they never said what interest they were refunding but I believe it to be 6% to 8%. Now considering they are charging me 37.7% they are having a laugh, I have issued a LBA to move to Small claims Court in the next 4 weeks, claiming statutory interest at 24.4% brings the claim to just under £3000.00, will pay off card and give me money in hand. I have a 2 threads under Capital One section, and by the way still waiting on them telling me how my interest rates went from 7.7% up to 37.7% Beware the Ides of March, don't trust them. -

It was Moorcroft that were threatening me, I ignored them and they returned account to santander. I E-mailed them about flexi loan and received a letter from them saying they are looking into my complaint.

Well surprise this morning, letter from Lowells on M&S headed paper saying they are now collecting the debt, you just couldn't make this up. Going to send CPUTR 2008 letter and see what happens from that.

And the question is:- How do you get UNUM to pay out? When I spoke to my HR department, they basically said that UNUM considered that I was fit to attend work, this was on Doctor's reports that were 2 months out of date, they also said that even if I appealed there would be little chance of them reversing their decision. HR advised that if I was off with something that could be cured UNUM were unlikely to pay out. Still waiting on letter regarding the appeal.

I have just returned to work after 9 months on the sick, starved back to work might be a better description. During the deep freeze at the start of 2011, I slipped on the ice and fell on my shoulder, banging my head at the same time, the latter blow causing me the most discomfort. After 2 months the pain in my shoulder became worse, causing sleep problems, inflammation and inability to raise my arms above my head. Gabapentin and Tramadol being prescribed, putting me in lala land. I then embarked on a course of physiotherapy, steroid injections, accupuncture and regular doctor appointments along with meetings with an orthopaedic surgeon, after 6 months it was decided that only surgery would resolve the problem. The operation cleared up the problem along with physio and I have now returned to work. When my company sick pay was due to end I was referred to UNUM and a form was received from them, almost identical to the one issued by the DWP. Anyway result was that I was turned down for any of their benefits, and on appeal this has once again been declined. I am now appealing again against their decision, and having read various forums about them, I am in for a battle.

My Cahoot account is currently with Moorcroft and they are corresponding with me, will have to tell them in the next few weeks to lower their figures due to the interest clawback.

Last increase January 2010 according to Crapone, 37.07% for purchases and 31.32% for cash transactions. Statement gives rates of Purchase 31.95% and Cash 27.56% Obviously copying and pasting from another customer's case correspondence,you couldn't make it up. -

Well keeping this claim back just now, POC's ready to go , but I am going for details of interest they are charging, going through FOS for this so court will have to wait. They say in their letter that rate for purchases is 37.7% which is different from the rate shown on statements. Thread below gives interest rate fight. -

Beware that when you get a letter from Crapone that they are that short of money page 2 is on the rear of page one!!!!!! Found second page by accident last night, they say my rate has gone from 7.7% to 37.7% in 4 increases over the lifetime of the card, 14 years. As a gesture of goodwill they have refunded all default charges since July 2011 plus a further goodwill contribution of a further £40, this comes to a total of £124.00 (whoopedoo) Maybe they think they can wriggle off the hook with that? I don't think so. -

Well after writing to them again for interest rate tracking on my account and a further 2 e-mails chasing them up for a reply, I finally get an answer. They say account opened in 1997 and rates have been increased under their changes to T&C's, have been informed of rises and had chance to decline rises by paying off card, or just not use it and pay balance up at new rate. Since I asked for dates and rate increases with reasons, they have really just said that it is none of my business and given me leaflet for FOS. Good customer service my arse, complaint form going in. -
Have been following this thread at Moneysavingexpert, many of their posters are being settled for their Flexiloans, calculations not really being made transparent by Santander. Also note that refunds to running accounts are being done, but the hiked rate of interest is being applied on the balance (20%+) I have asked if anyone is claiming interest in restitution, but they all seem to be glad to be receiving a cheque that they are not bothered about any more cash. I personally think Santander are getting off quite easily. Any caggers received refunds?

Well wrote back to them to say the interest rates were not on statements and their phone/account logs could not be translated. I am going to court regarding default charges but understand that the FOS may not touch UTCRR problems if I have case at court. E-mailed them twice since letter and still they are not revealing the interest rate mystery. -
