  1. Well now being threatened that they will claim expenses when they win their case at the Small claims Court, nothing like confidence. Have comeback with an improved offer but still nowhere near my claim.

  3. Hi Mr Brooks, I know exactly how you feel, because I haven't paid them they have passed account to a DCA, whom I informed about the ongoing case with the FOS and my court papers. They came back with the following answer, Capone have given their final response to me and the FOS, by giving FOS details of rate rises over the years, this was in exchange for me agreeing to no court proceedings for refund of charges, seemingly this was agreed to by the FOS??????? On contacting the FOS they have told me that the case is still open, the adjudicator has spoken to them on several occasions since their "Final Response" and the case is waiting on allocation to an ombudsman, no such deal regarding court action has been brokered. How can a financial institution of their size get away with this? Another one to add to the corrupt club such as RBS, Barclays, Santander etc.
  4. Well after a couple of administrative mistakes on my part, Court Papers issued, hearing late September.
  5. Hi PPC, last fishing trip from a DCA was May, just ignored them, they just hope people will feel threatened and scared and pay up to get them to go away. The Santander case wont even be on their agenda unless we raise the question.

  7. I have made complaint to OFT, got their standard response, also complained to OFCOM at the same time, and had their standard response. Just going round in circles it would appear.
  8. OFT do not deal with individual cases, regulatory body is the FOS.
  9. So where do we go from here, private prosecution?, after all the threats to them, we run out of steam.
  10. Well they went back to M&S to follow the paper trail, they even state I disputed transfer from Storecard to Credit Card, they now want me to contact them to clear outstanding balance. Hope they are not holding their breath.
  11. Well FOS have replied, and I quote:- I have noted the legal clauses that you have quoted, but as we are not a legislative body, we do not have the power to judge if businesses may have acted outside of the law. This shower are needing shut down, complete waste of space.

    Only one bank at fault here, our friends at Santander, wonder how many people will be affected and will be oblivious till they get their statements. My letter is away to Santander.

    Spoke to HBOS this morning, they tell me it went through their system as a faster payment, it was rejected by Santander, and taken on the Monday, therefore incurring 2 penalties of £12.00 each, how much money have they managed to generate over the weekend and from how many customers?

    From the faster Payments website:- Single immediate payments Customer input using online or telephone banking or using a branch based service. Payments are available 24 hours a day, 7 days a week. The system provides a positive response to the customer bank within 15 seconds, and providing a reason for any rejected payment. The money must be available in the receiving customer account within 2 hours. Value limit of up to £100,000. When my wife spoke to the Asian call centre she was told it was a Bank Holiday, hence the reason it did not go through. It was certainly a Bank Holiday one year ago as it was the Royal Wedding, Santander probably have just carried the date forward. Some schools in our area were closed on Monday due to heating that was turned off, this was controlled by a central computer that had a holiday programmed in because of the Royal Wedding one year ago, it shut about 20 schools.

    Thought faster Payments take 2-3 HOURS, any I have made before went through that quick.

    Paid my wife's store cards on line on Saturday, went through as faster payment on the new account details Santander supplied some months ago. Thought nothing more of it until this evening when I start getting automated calls from their collection department, saying the account is in arrears. My wife went through to their Asian call centre and the operator said Saturday was not counted as a working day, payment did not process in time and there would be a £12 charge for late payment, he could not stop the default charge. When my wife asked to speak to a supervisor she was cut off. Thought faster payments were meant to go through at anytime, is the fault at their end, or have I made the late payment? It was due on Saturday so they should have the process in place to deal with payments.
  20. Any complaints regarding Debt Collection should be raised to the FOS, this has already been done with the FOS siding with Barclays First Plus, according to them they are entitled to do this. Barclays also received complaint from me direct, their legals say they are entirely within their rights!!!!
  21. Had 4/5 calls a day from Barclays First Plus running from July 2011 to January 2012 some 800/900 phone calls on mobile/landline eventually followed up with a visit from a DCA. First Plus say they are entitled to do this, even though I sent them no phone calls letter and no visit letter, worringly FOS agrees with them. This was when I was off work sick and First Plus were informed by this in writing and were regularly updated on when the arrears would be cleared.
  22. Hopefully it'll be a long summer for the Hibbies with them looking forward to the First Division, but then again there is only one club heading for liquidation.
