  1. I know policy was known as Goldfish Accident Plan and was started in April 2004 from a phone call from one of the Goldfish phone jockeys. It changed to Unat Direct and then AIG and continued through to the end of 2007, when it was cancelled we do not know. Barclaycard did not respond to any questions regarding the policy in the original letter.

My wife has had a Goldfish card since about 2003, taken out same time as mine via a store promotion, I found an insurance policy document supplied by Goldfish, covering her for sickness/redundancy etc. and wanted to know when it was started, was it requested etc. I sent a SAR to Barclaycard who now run the card and have received a letter today stating that they cannot find the agreement for the card and as such debt would be unenforceable though they would still put markers on her credit file, without explanation of "no agreement." They quote various court cases, Carey v HSBC & McGuffick v RBS and do not mention the policy in any shape or form. My wife's payments are up to date and want to keep her credit rating in good health so where to go from here? Total shambles that an institution this size cannot give you any info on a card taken out in the last 10 years, and cannot even give you a date when it was created. I am also pursuing them for default charges and am hitting the same brick wall, my Credit rating is shot already.
  3. Well letter from CSL this morning, nice pink colour, on an alleged debt of £5400 they will accept £1500, and if not sent sending someone nice to my door. Don't think so CSL,letter going out to them on Monday.

  5. I see Barclays along with others are being taken to court for manipulation of the LIBOR rate, the rate used to calculate the inetrest you pay on various loans. This could have an effect on the FP rates.
  6. Only one has been Seriously Fed Up, which is the one I think you mention. They have threatened me with everything apart from getting my manhood cut off, still I await for their next move. Many threads on here regarding the change from storecard to mastercard, read and enjoy.

    Well APEX have sebt me copies of Credit Card statements going back 2 years for an American Express Card, and have failed to answer any of the questions I put to them:- Date of original agreement, Any default Charges applied to account, Any paperwork that confirms the account number they are quoting on their letter head. Think I'll SAR them to see what they produce, very little I think.

  9. Well got an answer today, another load of statements going back 6 years (which they had sent a year ago) only difference they gave me last 12 months, which I will have to add on. Letter going back asking if they read the letters that come in, have asked for Original date card was issued and any defaults tween date of issue and 2004?

    Still no response from CSL who could not even acknowledge my original letter (surely dont have template answer) and Apex have not come back either. Enjoying the lull in proceedings.

    Well, a month now passed, no word from Apex regarding the search for the CCA and no further correspondence from CSL, should I now ask for confirmation that there is no agreement. I think I read on the forum that they had to acknowledge that the agreement does not exist?

Have decide to resurrect the claim for charges which come to over £700 over last 6 years, have also asked for details of charges back to cards creation date, I am still making regular payments to the card and am not in default. I am adding on contractual interest and advising them of a further 8% that could be added. Can anyone point me in direction of spreadsheet for working out contractual interest.

    CSL chasing Amex CC, did not recognise account number on letter head, have asked for clarification i.e. agreement, date taken out, any default charges etc. Have heard nothing from them. Same position with Apex, have sent same letter, have asked who the alleged debt is with them or HL Legal, actually received acknowledgement, they are going back to TSB to verify, collection suspended in meantime. Both have had only contact me by letter message and no doorstep collections. I await with baited breath.

    I wrote to APEX over 10 days ago asking for copy of agreement, date taken out and default charges on account, sent recorded delivery. No reply back but letter this morning from HL legal AKA Sampson threatening legal action and not prepared to enter into any correspondence etc. Anyone had any dealings with these muppets? I seem to be on a merry go round of DCA's and lawyers.

    Sorry trampling over some one elses posts, thought I would resurrect my original post from November 2009. My Lloyds Credit Card dispute, is split between, LLoyds themselves and American Express, the latter was just a card issue, I know there was no paperwork signed. My original CC was taken out some 21 years ago as part of their Elect account, cannot remember if anything was signed for the card but probably for the Current Account. The alleged debt has been doing the rounds, wescott, AIC, CSL and now a letter from Apex this morning, who am I supposed to reply to? TSB only supplied a reconstructed agreement and said they were attempting to find originals,......... still waiting, also said they would not enter into any further correspondence, could have fooled me, SCM solicitors sent threatogram over a year ago. As I am in Scotland I understand that they have to produce original if they waht to go to Court, am I correct in that assumption?

  21. Debt has a good 4 years till SB, asked LLOYDS for CCA but they sent made up T&C's, could not provide original agreement. Usual crap, "we know you signed an agreement or you would not have got a card etc., cannot put our hands on it just now, this is final response will not enter into any correspondence regading the issue". The jobsworth collector, said he represented TSB to my wife, never mentioned amount, just asked my wife if I was in. Wish I had asked for ID or business card, told him all communication in writing. My wife was pretty shaken up by it, I am seriously not happy.
  22. CSL are the ones chasing me, had a doorstep visit last night from one of their reps., told to go away very politely.

Well got a visit last night from one of their doorstep collectors, standing there with a leger, told my wife he was representing Lloyds/TSB for a debt of £3800 which is about another £200 on the alleged balance. Told him to go away quite politely and shut the door in his face, with him butting in the background. TSB were unable to produce a valid CCA and were not prepared to enter into any further correspondence regarding the Credit Card agreement, so that put an end to that. Was briefly chased by Wescott then these muppets CSL, will see what happens next, wish I had asked for his business card as the only mention of CSL was at top of leger page.
  24. Should have told M&S to ram it, their CCA is not worth the paper it is written on. They try to tell you the CCA for a Chargecard is the same one as the Credit Card one, don't think so!!!
  25. Currently disputing interest rates with Barclays/FP, had reply from OFT, other customers of FP are chasing them also. The main point being that though interest rates are at their lowest for years, FP have not followed suit and if the rates go up FP will probably increase them also.
