  3. Looking for some template for court papers, links above lead me nowhere, anyone point me in the right direction, reclaiming default charges. Using Scottish Small claims route, but wording will be the same.

Anyway Capone say last letter was their final response, so on to court we go, though the interest rate question seems to have been forgotten by them, have e-mailed them to remind them. I think that they are avoiding the rates question so it really should go to the OFT/FSA not sure which. Getting my barristers wig shampooed as I type.

  6. I also have current account plus, my credit ref account is shot to bits, had to practically beg to get card renewal after first year. Operator at other end went through any reasons why DD's were bounced or agreed O/D was breached, I think he even looked at my credit report. Anyway new card issued but only 12 month validity.
  7. Well got my finger out as their monthly payments are really getting on my goat. Have gone back to March 2010 when I originally contacted them, and then back to March 2004 and it comes up to just under £3000 they are due me, interest at 31.9% the rate they are charging me at just now. I have also included default charges for the last year and it brings it all within the Scottish Small Claims Court. I also reminded them of my request to why my interest rate had gone from 7.7% up to 31.9%?????? on this they have become obstructive, saying I have to SAR them along with £10. I have already all statements and my account logs and I cannot see any reasons for rate increases on the log and the statements do not show interest rates. I am not paying them another penny, their call centre in The Far East keeps phoning me regarding payments, I as them if they are phoning to tell me when they are sending me the money???? They can't understand that response, not in the script!!!

Well decided to get the finger out and do something about Crapone, they are charging me a fortune just now in interest (31.9%) I have asked them how my rate went from 7.7%APR to this eyewatering rate, but as usual the crapone avoid the question letter. I have looked at the court procedures for small claims, anyone know if you just copy and paste the same POC's used in the English court systems? I also understand small claims to be £3000 limit, is this due to be increased?

  11. I had a claim against HSBC some years ago but had to use my sister's address for correspondence as she lived in Yorkshire. You had to have an English address to raise the case at that time, I understand that the condition has now been dropped. It was handy to raise through the English system as their small claim limit was £5000 and Scotland, although now raised to £3000, was a lot less at that point in time.   12. If going through small claims, does the total claim £3000 in Scotland and £500 in England include the interest charged in restitution and the 8% statutory interest?
  13. So got reply back from these to**ers and they say that the only way I can get these figures is for them to supply statements at £10 charge, and I go through them to see when and what the rate change was. Well Crapone, I already have the statements and will be doing my own calculations.
  14. Having read moneysavingexpert, I can see what has happened with regard to the T&C's on the statement. On March statement it says:- Crapone is now authorised by the FSA as an Authorised Payment Institution. Your interest rates are now linked to the BOE base rate. This is really quite handy for them as the BOE interest rate is not likely to go any lower, and can only go upwards, so any increase cannot realy be challenged. That is my reading of the situation, anyone got any other line of thought?
  15. Cheers for that Rebel, I take it that BOE base rate has had various titles since it was first implemented. I can see that it has never reached double figures since 1997 and has never been as high as 7.9%, which was the rate when the card was issued. I know their rate will shadow the BOE rate IE when it goes up CRAPONE goes up, so their rate should go down in October 98 and continue falling till June 1999. I somehow doubt that will be the case.

  17. Have decided just to accept the £1000+ that they paid into my account, has taken a sizeable chunk off the balance, so a kind of victory. Anyway onwards and upwards, Capone next.

  19. 8% is £155.86 and it is neither 26.6 nor 28.8. They say this is their final response and it is take it or leave it.
  20. Letter back from Crapone today, prepared to offer £580 in default sums, (which is correct for going back 6 years) but only giving interest of £324.95. total £904.95. They have hit me with further charges of £36.00 since the complaint went in, on the figure of £580. the interest is neither in restitution 29.9%= £795.77 nor their headline rate 31.95%= £873.97 Anyone know what rate they are going at ? I have asked them for a breakdown of interest charges on my account since its inception as I feel they are breaching UTCCR.
  21. Well final response from Barclaycard today. Not paying out any further than 6 years, so i can go and sing for it, they state:- The charges applied to your account before April 2005 are not recoverable. They are time barred under the Limitation Act 1980, as over 6 years have elapsed from the cause of action. You claim however, that you are entitled to recovery of these charges as you have received statements from Barclaycard for that period. End of message, will just have to be happy with the £1000+ that I got back.
  22. I should have said Scottish limit is £3000. On reducing my claim it takes it down to December 2003, this plus 8% statutory interest could be the way to go.
  23. Just drafted letter to Crap One after looking at my agreement/statements. Card was issued in 1997 at 7.9% APR and has now gone to an eye watering 31.95% APR, that is just horrendous. Will wait their reply with baited breath.
