Statements that I received did not show interest rate applied, have being trying for 6 months along with the FOS to find out rates, date increases applied, they have denied me and the FOS with excuses such as "Commercial Sensitivity" and generally mind your own business, nothing to do with you!!!!! -

Used MCOL some years ago and was very easy to use, going through Sherriff Court this time Small Claims, I take it I should refer to Statute of Limitations and Interest in Restitution in the main body of the Claim, giving reference to the relevant cases? Or should they be mentioned in Section 4 of the Claim? -

Cheers ims, the POC on Scottish procedure thread looks pretty basic, whilst the one on English court POC is more like War & Peace and seems to cover all bases. Would it be OK to use the latter? -

Using POC maroondevo mentions above, with slight adjustments in wording, still slightly confused with Compound Interest calculator. Have run it at 24.4%..... Charges £1014. Compound Interest £1948.14. this is going back to January 2002, gives total claim of £2962.14. Is this right seems high? -

Now allocated to an Ombudsman, Crap One still refusing to supply info, say they don't have data that old, although they supplied me with statements (not showing interest rates) and the original application form. The suggestion by our friendly FOS was the CCA was issued some 14 years ago, why start pursuing them now? My reply was that they are all crooks and recent revelations confirm that e.g. PPI. Silence from the FOS puppet. -

I take it that in the original POC that you do not mention that your claim is "Interest in Restitution" @ 24.4% and "S32.1980 Limitation Act". Is this used as an argument when Crap One try to blow your claim out of the water? i.e. when they launch a defence. -
There seems to be a large amount of rejection letters going out from Santander, some people have had further refunds as adjustments to their settlement figures, but rejection is the main way they are going. Most are now going to the FOS, hope they are not holding their breath as in my experience you would be better talking to a rocking horse than the FOS.

Actually stopped paying them whilst this dispute plus default charges was ongoing, so they have defaulted me and say that they are sending someone round to collect payment, this they have landed in iQOR's lap. Despite telling them that doorstep callers are only by invite, they say that will not stop a visit, they were also told that all communication should only be in writing, they say phone calls will continue!!!!! My case with FOS is still ongoing, Crapone have given list of statements with dates and the rate applied, unfortunately they have failed to supply the first 3 years of statements, FOS are banging their heads of the wall. The suggestion is that we appoint case to an Ombudsman in the FOS, maybe then Crapone will take notice. Will now proceed to small claims court next week, will have to check if it is a holiday on Monday. Don't some Financial Institutions just **** you off, considering they supplied an application form in response to my SAR, I don't think they have much leverage. -
When we asked about my wife's Goldfish account, Barclaycard put their hand up and said they did not have a copy of the agreement and as such would be unable to pursue the debt through legal channels.

Well FOS could not get the information either, fobbed them off with the claim that reason for rises are commercially sensitive and would give competitors unfair advantage. Surprise, FOS sides with Crapone. Well on to Small Claims Court to get back charges. -
Symptoms were that I could not lift my arms above my head and could not lift heavy weights, as I am a Customer Advisor in a Call Centre they said this would not affect my ability to attend work and do my duties. Luckily I have 4 reports from my companies OCC health department over the 9 month period stating I was unfit for work.

Going through Scottish Courts, already have 2 cases with FOS, would be just as well writing to Santa. -
OFCOM & Trading Standards were reported to, does not change FOS point of view, confirmed by FO are part of Scotcall, who are on their list. I must say FOS are a total waste of time, Barclays seem to be untouchable as far as they are concerned, whole system is corrupt. BB, I work for my Telecom provider, most numbers changed immediately with a police incident number, normal change under harassment takes 10 - 14 days.

I will inform FOS that they are part of the infamous Scotcall, lets see if that rings any bells with them.

I was in arrears with my Firstplus Secured loan and due them around £1332, this was due to being off my work for some 9 months. I received an arrears letter from FP threatening doorstep visit, I responded with standard DCA rejection letter, anyway totally ignored and had a visit from an overweight person along with an Asian girl from the said Scotcall, told them I had refused the visit and asked them to go away. After they sat in their 4x4 for some time, obviously phoning up to find out what to do, they disappeared into the horizon, the letter from Resolvecall arriving after the visit, I then e-mailed them with the standard bog-off letter and they responded by telling me account returned to FP. I had the FOS involved at an early stage over this debt due to telephone harassment 700+ phonecalls, despite sending letter and keeping them up to date with my circumstances, and FOS carried out their enquiry?????? Result:- Not considered as telephone harassment, no maladministration despite some other customer's payment going on my account, and DCA Resolvecall not listed in their approved list of DCA's this was even after quoting their licence number. As you can see FOS have once again ducked out, anyone know who Resolvecall are regulated by? By the way all arrears are now paid as was promised some 6 months ago, no doubt Resolvecall will be patting themselves on the back re their success.
