  1. Anyway have got PPI charges back plus interest, with no admission of liability from Crapone, they say it was sold via phone call in May 2001 and all bases were covered. This is unusual as I was self employed then, having just been prematurely retired on medical grounds, hardly an ideal candidate. The refund has been put on my account, so now on to the charges side as they are only prepared to refund £118 which is about £900 short. The application form they have sent complies with what they have to provide and a made up version complies, obviously since the Manchester case. They also say the application form had all T&C's on the rear and a further copy was sent out with original card, agree it must have been in very tiny writing. Will keep you up to date with any further developments.

  3. Well donw SFU, I'm dealing with these muppets just now and their henchmen down in the basement, Capital Credit Agencies. They phone the house and ask to speak to me, they carry out no further DPA and then start rambling on, having said that, ain't heard from them for over a week. Keep at them SFU!!!
  4. Well received statements for last 6b years and nothing else. Now going to write back to get rest of info. Funny how Cap One sent agreement (Application Form) and others don't, something to hide perhaps?
  5. I would have thoght contractual interest would have been a lot higher than 8% e.g. 20% or am I on the wrong track here? Thanks Dotty, no rush.

  7. Dotty, will have to PM you to find out how to work out contractual interest. Have 5 cases going just now, Capone (PPI+Charges) Egg (Charges) TSB (No CCA) Barclaycard (SAR) HBOS (Bank Charges) Life is never dull.

Well wrote back rejecting offer and stating I was claiming the charges back plus contractual interest, also complained about their DPA verification on calls and asked them to confirm that Capital Collections were now acting on their behalf, asked for letter of assignment. As usual Egg ignore and come back with original offer ignore reat of letter. Where now? Think I'll move to small claims court (Scotland) How easy is it?
  9. Have asked Capone for details of PPI, when it was applied and why? Asked for statements back to start of card, and have given them total so far which is over £1000, and said I want all charges back with interest at the contractual rate.

    Lloyds CCA

    Now getting daily phone calls from AIC, Lloyds still have not supplied copy of CCA for either account and still they just ramble along. TSB have never contacted me for months, no statement or demand for repayment. Could go the SAR route and reclaim charges, anyone got any suggestions?
  11. Tony's would appear to be an agreement for a Morgan Stanley Gold Card, which is different from a Goldfish Card who I believe were an independent company when Billy Connolly fronted adverts for them. Anyway have SAR'd them so it's just wait and see.
  12. Hi maroondevo, thanks for your feedback, I see someone else on the PPI forum has ben busy working the figures out for PPI in relation to Capone. Will have to compose a letter to deal with all queeries, will keep you all posted.

  14. Cheers slick, a reliable Cagger has informed me that Barclaycard will probably have no Agreement for this Card as Morgan Stanley wiped the systems some time ago. Still, wait and see.
  15. Hi Dotty, Just starting to get into these muppets, got info through SAR but only going back to October 99, card was taken out in 1997. Was astonished to find I had been paying PPI on this Credit Card as application form(which they sent as agreement) does not have box ticked. The interest side of the claim is a bit baffling and will take a while to calculate as statements they supplied do not show rate, but onward and upward. Watching with interest (at 27%)
  16. Sent away SAR on 27th Feb., clock is ticking, Cap. One have responded within 10 days, me thinks there may be a problem!!!

    Going to SAR them on Monday in light of the amount of info I got from Cap. One., they have opened up a goldmine.
  18. Well have had Credit Card with this lot since April 1997, thought it was time to get started, so I SAR'd them. I must say I got a swift reply with a load of info supplied, couldn't really fault them. On dissecting said info I saw the original agreement was an Application Form (Clearly Headed) with a balance transfer on the base of the card, no limit on form and T&C's on 16 lines in middle advising it was CCA covered by 1974 act, form signed by me and someone from their company, also noticed PPI box not ticked. On going through statements supplied by Capone, they only start back in October 1999 and are only showing account activity after September 2001. I then noticed I have paid PPI at least from October 2001 (probably before) up to April 2006 (when I told them to RAM it) Charges from October 2001 to now amount to £1050 not including interest nor PPI, but I am missing the first 4 years. I am not in default, payments up to date, can I claim charges back to start of card? Whet interest rate do I add to PPI payments once I find out how much I have paid them?
  19. Spoke to Capital Credit Agencies today, didn't verify who they were speaking to (No DPA) then said they wanted to talk about my EGG account. I stated to them that I did not know who they were and would not be indulging in any conversation regarding the account without a letter of assignment. By the way the lady representing them must have been paid off by the gestapo, her charm was amazing.

    Well still getting nowhere with these Muppets, Westcott have disappeared of the horizon, and I think Mr Dickey phoned this weekend, will be sending standard letter.
  21. Capital Credit Agencies are their in house DCA's, I'm getting calls from them on a daily basis, ask them for a letter of assignment and a fully compliant CCA the next time they call. By the way their DPA is absolutely shocking.

    Account now gone to Wescott and they have currently been repelled with Bog off letter, with added request for fully compliant signed and original agreement, also letter of assignment, so far silence. Other part of card has gone to a Mr Dickey in Glasgow, so he will be getting same response.
