  1. blfuk1 has the decency to come on her and defend his corner, which I agree with. Just a quick one, as far as I am aware, the up to the value of £150 for tools of the trade has been changed. The 1981 magistrates crt act, rule 54 no longer puts an amount on tools of the trade. The way I understand it is that bailiffs cannot take the tools of your trade full stop. I may be wrong.
  2. blfuk1, you can take my goods, but, and this is the big but, only if I let you in. I am not saying all bailiffs are bad, the ones I have dealt with have all lied in one way or another. Because I choose to fight illegal parking tickets I have alot of dealings with bailiffs, and the ones I have dealt with try to intimidate people.
  3. blfuk1, I agree with alot of what you say, the problem I have is with illegally issued parking tickets, despite writing to the councils involved they still will not back down. I have to keep doing late stat dec's until I can get in front of the adjudicator, and the adjudicator always finds in my favour. Whilst all this is going on I have bailiffs chasing me and trying to break the law. I understand the need for bailiffs, the problem I have is when they break the law to do thier job.
  4. What we must remember is that what bailiffs are and are not allowed to do is largely irrevellant. They take no notice of the law and do what they want. Most people have no dealings with bailiffs until it's to late, by this stage the big heavy is standing on your door demanding money. What people need to do is find out the law before the bailiff comes. If a bailiff knocks on my door I walk straight out and shut the door behind me, I then get out my dictaphone and ask them; What company they work for. Are they certified and with which court and ask for proof. What debt they are chasing. They get very flusterd!.

  6. I had the same thing happen about two years ago and it was JBW that took the car. I contacted Blackhorse finance and they went mad!, they made JBW bring the car back. Be prepeard for a long hard slog, the law states quite clearly they cannot take a car on finance, it does not belong to you, but, and this is a big but, bailiffs do whatever they want. Download bailiff law, print it off and go to the local police and report it stolen, you will have to drive the police mad!, the bailiffs will give the police a load of crap about how they can take the car, but you will have the law in front of you saying they cannot, if the police get funny, show them the law and make a right fuss, ask to speak to the duty inspector. The guy at Blackhorse said that bailiffs are suppossed to do a check before they take a car to see if its on finance, I am not sure if that is law though. You will find the whole process very frustrating! I feel for you mate.
  7. If I ever have to talk to a bailiff, I get my dictaphone out and ask him; 1, full name and date of birth. 2, which court he is certified at and when. 3, which company he works for. 4, which debt he is trying to collect. They normally leg it!!

Don't get me wrong guys, i'm not saying that the information is irrelevent, its just that bailiffs take no notice of law, there is a guy who had his car taken by the bailiffs even though its on HP, and they won't give it back and the police won't get involved. The point I am trying to make is that bailiffs break the law all the time and get away with it.
  9. What bailiffs can and can't do is, unfortunatley irrevelant, they do what they like. They will take cars/vans even if they are on HP or used for bussiness. This is why sites like this exist-because bailiffs break the law on a regular basis.
  10. Make sure you file the late stat declaration and put in a letter explaining everything you have said here. Send the late stat dec by recorded and registared post. When you have done this, phone the bailiff and tell them. Wait to hear back from northampton county court and they will probably cancel the order for unpaid penalty charges, but not the original parking ticket(PCN). If northampton cancel the order for unpaid penaly charge, you must then write to the council and ask for a copy of the original PCN and NTO. Do not let the bailiffs into your house under any circumstances, they will give you all kinds of b*ll****, can I use your toilet/phone etc etc. If northampton cancel the order for unpaid penalty charges the bailiffs will stop calling. I have had the same thing this week and have filed two late stat decs. I have PM'd you my phone number, call me.
  11. Hi binny, Have a good look through this site and you will find all the information you need about bailiffs and council tax. Lets deal with the bailiffs first. Bailiffs cannot come into your home to sieze goods unless you let them in, do not, I repeat, do not let them in under any circumstances, do not open the door to them, they will try every trick in the book to gain entry, can I use your phone/toilet, i'm a nice guy I won't take anything today etc etc. They have no power of entry. If you have a car registered to you-hide it, do not park outside your home. Bailiffs can however, enter through a open window or door, so keep windows shut. There is a template letter on here somewhere to send to the bailiffs, you need to look for it. Watch out for bailiffs charges, they all try to overcharge you. Do your research on here and you will find everything you need. Above all try not to worry to much, I have had loads of trouble with bailiffs in the past over parking tickets, since joining this site and pepipoo I have had a huge wieght lifted of my shoulders. Go to the department of constitucianal affairs website and the CAb website and print of the information about bailiffs, it will put your mind at rest. The best advice is this, nice cup of tea, packet of choccy bikkies and a couple of hours browsing this site. Good luck.
  12. I watched it this morning(taped it last night as I was at work). To be honest, nothing surprised me at all. We all know what has been going on for years, will anything get done?, no. The police don't even know the law, this is why we must educate ourselves, and when the bailiffs come knocking we can rebuff them. If I have contact with a bailiff I always get my dictaphone out and make them state thier name, debt they are enforceing, the court who issued them thier certificate etc etc, they go very quiet!!!. This is a terrible thing to say, but people are so frustrated that nobody is helping us that someone will kill a bailiff one day, and you know what, I could not care less. What has this country come to, making a statement like that goes completely against my principals, but I am so fed up with bailiffs. I thought it was great when the bailiffs got clamped!!, could not stop laughing.
  13. What really worries me about this bill is the fact that bailiffs lie alot of the time, what if I had a gold ring in my house and it dissapeard after the bailiffs had been in?. I cannot believe the goverment are thinking of giving bailiffs extra powers when they are complete cowboy's.
  14. If I have to talk to a bailiff, I always tell them i'm taping the conversation or if I am talking to them face to face I ask them to state thier name, what court issued them thier licence and what debt the are pursueing. They go very quiet, funny that.
  15. Just a quick one here. I bought a new car on finance and it did not stop breaking down, so I told the finance company to come and get it, which they did. They want £5000 in settlement. Here is the really interesting part, when I signed the credit agrement, they spelt my name wrong ie SMITH, when it should be SMETH. I made payments and would have kept the car if had not of kept going wrong, am I still liable as I did sign the credit agreement?.
  16. I cannot believe the line the police are taking on this, its a bloody disgrace!!. I had a guy by a land rover off me via ebay, he sent me a cheque and I paid it into my bank, the bank spotted that it was forged and cancelled it. When I went to the police to report it, they said that because the bank had cancelled the cheque no crime had been commited!!. I asked the police about attempted fraud, and they said that it does'nt exist. I am not anti police, but I cannot understand the way they act somtimes.

  18. Another case of a bailiff taking the p*ss. They are a law unto themselves and nobody seems to do anything about them.
  19. In my experience they will take the car as soon as they can get thier greedy hands on it. I had a car on finance and the bailiffs took it over a parking ticket, they dragged it of my drive and put it on a low loader. Every car I buy now I put in my friends name. Can you sell the car to a friend?. They can't take what is not yours.
  20. This whole case is a disgrace. By law the bailiffs cannot take anything that does not belong to you. They are breaking the law, simple. The court that issued the warrant to the bailiff should be involved in getting this sorted. Could the bailiffs be reported to the police for theft?.

  23. I am so angry reading this!!!!. How can any human being treat a woman like this, it's a bloody disgrace. I do not know how bailiffs can sleep at night. It's getting to the stage now in this country where someone is going to badly hurt a bailiff one day. Freebird, please post on here again so we know you are ok.
